Amends the Illinois Vehicle Code. Provides that the Secretary of State shall remove the registration and license plate number record on file associated with a vehicle's serial number before issuing a new certificate of title for that vehicle.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing | 5 | | Section 3-106 as follows:
| 6 | | (625 ILCS 5/3-106) (from Ch. 95 1/2, par. 3-106)
| 7 | | Sec. 3-106. Certificate of title - Issuance - Records. | 8 | | (a) The Secretary of State shall file each application | 9 | | received and,
when satisfied as to its genuineness and | 10 | | regularity, and that no tax
imposed by the "Use Tax Act" or the | 11 | | vehicle use tax, as imposed by Section
3-1001 of "The Illinois | 12 | | Vehicle Code", or pursuant to the "Municipal Use
Tax Act" or | 13 | | pursuant to the "County Use Tax Act" is owed as evidenced by
| 14 | | the receipt for payment or determination of exemption from the | 15 | | Department
of Revenue provided for in Section 3-104 of this | 16 | | Act, and that the
applicant is entitled to the issuance of a | 17 | | certificate of title, shall
issue a certificate of title of the | 18 | | vehicle.
| 19 | | (b) The Secretary of State shall maintain a record of all
| 20 | | certificates of title issued by him under a distinctive title | 21 | | number
assigned to the vehicle; and, in the discretion of the | 22 | | Secretary of
State, in any other method determined.
| 23 | | (c) The Secretary of State shall not issue a certificate of |

| 1 | | title, including a certificate of title issued in accordance | 2 | | with subsection (b) of Section 3-109, to a manufactured home | 3 | | for which there has been recorded an affidavit of affixation | 4 | | pursuant to the Conveyance and Encumbrance of Manufactured | 5 | | Homes as Real Property and Severance Act unless with respect to | 6 | | the same manufactured home there has been recorded an affidavit | 7 | | of severance pursuant to the Conveyance and Encumbrance of | 8 | | Manufactured Homes as Real Property and Severance Act. | 9 | | (d) The Secretary of State shall file, upon receipt, each | 10 | | affidavit of affixation and each affidavit of severance | 11 | | relating to a manufactured home that is delivered in accordance | 12 | | with the Conveyance and Encumbrance of Manufactured Homes as | 13 | | Real Property and Severance Act, when satisfied as to its | 14 | | genuineness and regularity. | 15 | | (e) The Secretary of State shall maintain a record of each | 16 | | affidavit of affixation and each affidavit of severance filed | 17 | | in accordance with subsection (d) of this Section. The record | 18 | | shall state the name of the owner of the related manufactured | 19 | | home, the name of manufacturer, model year, manufacturer's | 20 | | serial number, and any other data the Secretary of State | 21 | | prescribes. | 22 | | (f) The Secretary of State shall file, upon receipt, each | 23 | | application for surrender of the Manufacturer's Statement of | 24 | | Origin relating to a manufactured home that is delivered in | 25 | | accordance with Section 3-116.1, when satisfied as to its | 26 | | genuineness and regularity. |

| 1 | | (g) The Secretary of State shall file, upon receipt, each | 2 | | application for surrender of the certificate of title relating | 3 | | to a manufactured home that is delivered in accordance with | 4 | | Section 3-116.2, when satisfied as to its genuineness and | 5 | | regularity. | 6 | | (h) The Secretary of State shall maintain a record, | 7 | | including a record in the form of a searchable electronic | 8 | | database accessible to the public, of each Manufacturer's | 9 | | Statement of Origin accepted for surrender as provided in | 10 | | Section 3-116.1. The record shall state the date the | 11 | | Manufacturer's Statement of Origin was accepted for surrender, | 12 | | the name of manufacturer, make, model name, model year, | 13 | | manufacturer's serial number, and any other data the Secretary | 14 | | of State prescribes. | 15 | | (i) The Secretary of State shall maintain a record, | 16 | | including a record in the form of a searchable electronic | 17 | | database accessible to the public, of each manufactured home | 18 | | certificate of title accepted for surrender as provided in | 19 | | Section 3-116.2. The record shall state the date the | 20 | | certificate of title was accepted for surrender, the name of | 21 | | manufacturer, model year, manufacturer's serial number, and | 22 | | any other data the Secretary of State prescribes. | 23 | | (j) The Secretary of State shall remove the registration | 24 | | and license plate number record on file associated with a | 25 | | vehicle's serial number before issuing a new certificate of | 26 | | title for that vehicle. |
