Amends the School Code. With respect to the requirement that a high school student or his or her parent or guardian file a Free Application for Federal Student Aid with the United States Department of Education or, if applicable, an application for State financial aid, requires a school district to provide notice to each student and to the parent or guardian of each student about the option to file a waiver. Effective June 1, 2020.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The School Code is amended by renumbering and | 5 | | changing Section 22-85, as added by Public Act 101-180, as | 6 | | follows: | 7 | | (105 ILCS 5/22-87) | 8 | | (This Section may contain text from a Public Act with a | 9 | | delayed effective date ) | 10 | | Sec. 22-87 22-85 . Graduation requirements; Free | 11 | | Application for Federal Student Aid. | 12 | | (a) Beginning with the 2020-2021 school year, in addition | 13 | | to any other requirements under this Code, as a prerequisite to | 14 | | receiving a high school diploma from a public high school, the | 15 | | parent or guardian of each student or, if a student is at least | 16 | | 18 years of age or legally emancipated, the student must comply | 17 | | with either of the following: | 18 | | (1) File a Free Application for Federal Student Aid | 19 | | with the United States Department of Education or, if | 20 | | applicable, an application for State financial aid. | 21 | | (2) On a form created by the State Board of Education, | 22 | | file a waiver with the student's school district indicating | 23 | | that the parent or guardian or, if applicable, the student |

| 1 | | understands what the Free Application for Federal Student | 2 | | Aid and application for State financial aid are and has | 3 | | chosen not to file an application under paragraph (1). The | 4 | | school district must provide notice to each student and to | 5 | | the parent or guardian of each student about the option to | 6 | | file a waiver under this paragraph (2). | 7 | | (b) Each school district with a high school must require | 8 | | each high school student to comply with this Section and must | 9 | | provide to each high school student and, if applicable, his or | 10 | | her parent or guardian any support or assistance necessary to | 11 | | comply with this Section. A school district must award a high | 12 | | school diploma to a student who is unable to meet the | 13 | | requirements of subsection (a) due to extenuating | 14 | | circumstances, as determined by the school district, if (i) the | 15 | | student has met all other graduation requirements under this | 16 | | Code and (ii) the principal attests that the school district | 17 | | has made a good faith effort to assist the student or, if | 18 | | applicable, his or her parent or guardian in filing an | 19 | | application or a waiver under subsection (a). | 20 | | (c) The State Board of Education may adopt rules to | 21 | | implement this Section.
