Amends the Rescue Squad Districts Act. Provides that a rescue squad district may, by ordinance, submit a referendum to the voters for a special annual tax for the purpose of providing funds to pay the costs of emergency and rescue crews and equipment. Provides the special annual tax rate may not exceed 0.10% of the value of all taxable property within the district. Includes the language to be used in the referendum. Provides that after approval of the referendum by the voters of the district, the board of trustees of the rescue squad district shall, by resolution, set or amend the rate of the special tax to be levied by the district at a rate not to exceed 0.10% of the value of all taxable property in the district as equalized or assessed by the Department of Revenue. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Rescue Squad Districts Act is amended by | 5 | | adding Section 11.5 as follows: | 6 | | (70 ILCS 2005/11.5 new) | 7 | | Sec. 11.5. Special annual tax. | 8 | | (a) In addition to any other tax authorized by law, a | 9 | | rescue squad district may, subject to the requirements of
this | 10 | | Section, by ordinance and referendum, levy a special annual tax | 11 | | at a rate not exceeding
0.10% of the value, as equalized or | 12 | | assessed by the Department of Revenue,
on all taxable property | 13 | | within the district, for the purpose of obtaining
funds to pay | 14 | | for the costs of emergency and rescue crews and equipment. The | 15 | | board of trustees shall determine and certify the amount to be | 16 | | levied and shall return the same to the county clerk. The | 17 | | limitation upon the tax rate may be increased or decreased | 18 | | under the referendum provisions of the General Revenue Law of | 19 | | Illinois.
| 20 | | In case the district is located in more than one county, | 21 | | the board of
trustees shall determine and certify the amount to | 22 | | be levied upon the
taxable property lying in each county and | 23 | | return the same to the
respective county clerks of the counties |

levied. In order to determine the | 2 | | amount to be levied upon the taxable
property of that part of | 3 | | the district lying in each county, the board
shall ascertain | 4 | | from the county clerk of the respective counties in
which the | 5 | | district lies the last ascertained equalized value of the
| 6 | | taxable property of the district lying in their respective | 7 | | counties,
then shall ascertain the rate per cent required and | 8 | | shall, accordingly,
apportion the whole amount to be raised | 9 | | between the several parts of the
district so lying in the | 10 | | different counties. The tax provided for in
this Section shall | 11 | | be levied at the same time and in the same manner as
nearly as | 12 | | practicable as taxes are now levied for municipal
purposes | 13 | | under the laws of this State. | 14 | | The tax under this Section, when collected, shall be paid | 15 | | over to the
treasurer of the board of trustees, who is | 16 | | authorized to receive and
receipt for the same. | 17 | | (b) Whenever a rescue squad district desires
to levy a | 18 | | special tax under this Section, it shall certify the question
| 19 | | to the proper election officials, who shall submit that | 20 | | question at an election
to the voters of the district in | 21 | | accordance with the general election law.
The result of the | 22 | | referendum shall be entered upon the records of the
district. | 23 | | If a majority of the votes on the referendum are in favor of
| 24 | | the referendum, the rescue squad district may then levy a | 25 | | special tax
under this Section at a rate not to exceed 0.10% of | 26 | | the value
of all taxable property within the district as |

Department of Revenue. The | 2 | | referendum shall be in substantially the following form:
