Amends the Board of Higher Education Act. Provides that all powers, duties, rights, and responsibilities, including all relevant books, records, papers, and documents, of the Department of Central Management Services regarding higher education supplier diversity reports are transferred to the Board of Higher Education. Requires specified private institutions of higher education to submit an annual report on its voluntary supplier diversity program to the Board of Higher Education. Sets forth provisions on what the report must include and how and when the report must be submitted. Provides that, for each report, the Board shall publish the results on its Internet website for 5 years after submission. Requires the Board to hold an annual higher education supplier diversity workshop to discuss the reports with representatives of the institutions of higher education and vendors. Provides that the Board shall prepare a template for voluntary supplier diversity reports. Provides that any institution of higher education may submit to the Board, and the Board shall publish, a buying plan to assist potential vendors with understanding specific opportunities to do business with the institution of higher education. Amends the Department of Central Management Services Law of the
Civil Administrative Code of Illinois to repeal provisions concerning higher education supplier diversity reports. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | (20 ILCS 405/405-530 rep.) | 5 | | Section 5. The Department of Central Management Services | 6 | | Law of the
Civil Administrative Code of Illinois is amended by | 7 | | repealing Section 405-530. | 8 | | Section 10. The Board of Higher Education Act is amended | 9 | | by adding Section 17 as follows: | 10 | | (110 ILCS 205/17 new) | 11 | | Sec. 17. Higher education supplier diversity report; | 12 | | buying plan. | 13 | | (a) Beginning on the effective date of this amendatory Act | 14 | | of the 102nd General Assembly, all powers, duties, rights, and | 15 | | responsibilities, including all relevant books, records, | 16 | | papers, and documents, of the Department of Central Management | 17 | | Services regarding higher education supplier diversity reports | 18 | | are transferred to the Board of Higher Education. The Board | 19 | | shall exercise all powers, duties, rights, responsibilities | 20 | | regarding higher education supplier diversity reports as | 21 | | provided in this Section. | 22 | | (b) Every private institution of higher education approved |

| 1 | | by the Illinois Student Assistance Commission for purposes of | 2 | | the Monetary Award Program shall submit a 2-page report on its | 3 | | voluntary supplier diversity program to the Board of Higher | 4 | | Education. The report shall set forth all of the following: | 5 | | (1) The name, address, phone number, and e-mail | 6 | | address of the point of contact for the supplier diversity | 7 | | program (or the institution's procurement program if there | 8 | | is no supplier diversity program) for vendors to register | 9 | | with the program. | 10 | | (2) Local and State certifications the institution
| 11 | | accepts or recognizes for minority-owned, women-owned, or | 12 | | veteran-owned business status. | 13 | | (3) On the second page, a narrative explaining the
| 14 | | results of the report and the tactics to be employed to | 15 | | achieve the goals. | 16 | | (4) The voluntary goals, if any, for either fiscal
| 17 | | year or calendar year 2024 in each category for the entire | 18 | | budget of the institution (expending both public and | 19 | | private moneys, including any fee-supported entities) and | 20 | | the commodity codes or a description of particular goods | 21 | | and services for the area of procurement in which the | 22 | | institution expects most of those goals to focus on in the | 23 | | next year. However, a private institution of higher | 24 | | education may report the information under this paragraph | 25 | | (4) for fiscal year or calendar year 2023 instead. With | 26 | | respect to private institutions of higher education, |

| 1 | | beginning with the 2025 report, the actual spending for | 2 | | the entire budget of the institution (expending both | 3 | | public and private moneys, including any fee-supported | 4 | | entities) for minority business enterprises, women's | 5 | | business enterprises, and veteran-owned businesses, | 6 | | expressed both in actual dollars and as a percentage of | 7 | | the total budget of the institution. However, if a private | 8 | | institution of higher education elects to report the | 9 | | information under paragraph (3) of this subsection (b) for | 10 | | fiscal year or calendar year 2023 instead, then the | 11 | | information under this paragraph (4) must be reported | 12 | | beginning with the 2024 report. | 13 | | Each private institution of higher education is required | 14 | | to submit a searchable Adobe PDF report to the Board on or | 15 | | before November 15, 2024 and on or before November 15 of every | 16 | | year thereafter. However, if a private institution of higher | 17 | | education elects to report the information under paragraph (3) | 18 | | of this subsection (b) for fiscal year or calendar year 2023 | 19 | | instead, then the institution is required to submit the report | 20 | | on or before November 15, 2023 and on or before November 15 | 21 | | every year thereafter. | 22 | | (c) For each report submitted under subsection (b), the | 23 | | Board shall publish the results on its Internet website for 5 | 24 | | years after submission. The Board is not responsible for | 25 | | collecting the reports or for the content of the reports. | 26 | | (d) The Board shall hold an annual higher education |

| 1 | | supplier diversity workshop in February of 2023 and every | 2 | | February thereafter to discuss the reports with | 3 | | representatives of the institutions of higher education and | 4 | | vendors. | 5 | | (e) The Board shall prepare a one-page template (not | 6 | | including the narrative section) for the voluntary supplier | 7 | | diversity reports. | 8 | | (f) Beginning on and after the effective date of this | 9 | | amendatory Act of the 102nd General Assembly, and for each | 10 | | fiscal year or calendar year thereafter, any institution of | 11 | | higher education may submit to the Board a buying plan to | 12 | | assist potential vendors with understanding specific | 13 | | opportunities to do business with the institution of higher | 14 | | education. The Board shall publish each buying plan submitted | 15 | | to it under this subsection (f) on its Internet website.
| 16 | | Section 99. Effective date. This Act takes effect upon | 17 | | becoming law.
