Amends the Illinois Governmental Ethics Act. Provides that no spouse of a member of the General Assembly shall be appointed to a board, commission, authority, task force, or other similar body authorized or created by State law if such appointment offers compensation for service as a member of that body. Specifies that this requirement shall only apply to persons appointed to a board, commission, authority, task force, or other similar body on and after the effective date of this amendatory Act. Effective January 1, 2021.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Governmental Ethics Act is amended | 5 | | by adding Section 3A-35 as follows: | 6 | | (5 ILCS 420/3A-35)
| 7 | | Sec. 3A-35. Conflicts of interests.
| 8 | | (a) In addition to the provisions of subsection (a) of | 9 | | Section 50-13 of the
Illinois Procurement Code, it is unlawful | 10 | | for an
appointed member of a board, commission, authority, or | 11 | | task force authorized
or created by State law or by executive | 12 | | order of the Governor, the spouse of
the appointee, or an | 13 | | immediate family
member of the appointee living in the | 14 | | appointee's residence to have or acquire
a contract or have or | 15 | | acquire a direct pecuniary interest in a contract with
the | 16 | | State that relates to the board, commission, authority, or task | 17 | | force of
which he or she is an appointee during and for one | 18 | | year after the conclusion
of the person's term of office.
| 19 | | (b) If (i) a person subject to subsection (a) is entitled | 20 | | to receive more
than 7
1/2% of the total distributable income | 21 | | of a partnership, association,
corporation, or other business | 22 | | entity or (ii) a person subject to subsection
(a) together with | 23 | | his or her
spouse and immediate family members living in that |

entitled to receive more than 15%, in | 2 | | the aggregate, of the total distributable
income of a | 3 | | partnership, association, corporation, or other business | 4 | | entity
then it is unlawful for
that partnership, association, | 5 | | corporation, or other business entity to have or
acquire a | 6 | | contract or a
direct pecuniary interest in a contract | 7 | | prohibited by subsection (a) during
and for one year after the | 8 | | conclusion of the person's term of office.
| 9 | | (c) Notwithstanding any provision of law to the contrary, | 10 | | no spouse of a member of the General Assembly shall be | 11 | | appointed to a board, commission, authority, task force, or | 12 | | other similar body authorized or created by State law if such | 13 | | appointment offers compensation for service as a member of that | 14 | | body. The provisions of this subsection (c) shall only apply to | 15 | | persons appointed to a board, commission, authority, task | 16 | | force, or other similar body on and after the effective date of | 17 | | this amendatory Act of the 101st General Assembly. | 18 | | (Source: P.A. 93-615, eff. 11-19-03 .)
