| AN ACT concerning local government.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Township Code is amended by changing | 5 |
| Sections 140-5, 145-5, and 150-10 as follows: | 6 |
| (60 ILCS 1/140-5)
| 7 |
| Sec. 140-5. Petition and referendum for township hall.
| 8 |
| (a) Whenever it is desired to build, purchase, or lease, | 9 |
| for a longer period
than 10 years, a township hall, a | 10 |
| multi-purpose senior center, or a
combined
township hall and | 11 |
| multi-purpose senior center in any township, at least 25
| 12 |
| electors of the township may, before the time of giving notice | 13 |
| of the annual
township meeting, file with the township clerk a | 14 |
| petition in writing that the
proposition of building, | 15 |
| purchasing, or leasing a township hall, a
multi-purpose senior | 16 |
| center, or a combination township hall and multi-purpose
senior | 17 |
| center and issuing bonds for the building, purchase, or lease | 18 |
| be
submitted to the voters of the township at the next ensuing | 19 |
| general election.
The proposition shall be clearly stated in | 20 |
| the petition substantially as
follows: "Shall (name of | 21 |
| township) borrow $(amount) to (build, purchase, or
lease) a | 22 |
| (township hall, multi-purpose senior center, or combination
| 23 |
| multi-purpose township hall and senior center) and issue bonds |

| for the
(building, purchase, or lease)?" The petition shall be | 2 |
| filed in the office of
the township clerk.
| 3 |
| (b) The township clerk shall certify the proposition to the | 4 |
| proper election
officials, who shall submit the proposition to | 5 |
| the legal voters of the township
at an election in accordance | 6 |
| with the general election law. The form of the
proposition | 7 |
| shall be substantially as follows:
| 8 |
| Shall (name of township) borrow $(amount) to (build, | 9 |
| purchase, or lease) a
(township hall, multi-purpose senior | 10 |
| center, or combination township hall and
multi-purpose | 11 |
| senior center) and issue bonds for the (building, purchase, | 12 |
| or
lease)?
| 13 |
| The votes shall be recorded as "Yes" or "No".
| 14 |
| (c) Notwithstanding any provision of this Section to the | 15 |
| contrary, any township may, by ordinance or resolution, build, | 16 |
| purchase, or lease a township hall, a multi-purpose senior | 17 |
| center, or a combined township hall and multi-purpose senior | 18 |
| center within the township without referendum approval, if the | 19 |
| building, purchasing, or leasing of the township hall, | 20 |
| multi-purpose senior center, or combined township hall and | 21 |
| multi-purpose senior center is paid or provided for with funds | 22 |
| that are not the proceeds of bonds authorized under this | 23 |

| Sec. 145-5. Petition and referendum to build or purchase | 2 |

| (a) Whenever it is desired to build or purchase a township | 4 |
| hall in any
township whose boundaries are coextensive with the | 5 |
| limits of an incorporated
city, 25 electors of the township | 6 |
| may, before the time of giving notice of the
annual township | 7 |
| meeting, file with the township clerk a petition in writing
| 8 |
| that the proposition of building or purchasing a township hall, | 9 |
| as the case may
be, and the issuing of bonds for the building | 10 |
| or purchase be submitted to the
voters of the township at an | 11 |
| election. The proposition shall be clearly stated
in the | 12 |
| petition substantially as follows: "Shall (name of township) | 13 |
| borrow
$(amount) to build or purchase a township hall and issue | 14 |
| bonds for the building
or purchase?" The petition shall be | 15 |
| filed in the office of the township clerk.

| (b) The township clerk shall certify the proposition to the | 17 |
| proper election
officials, who shall submit the proposition to | 18 |

| the limits of an incorporated city may, by ordinance or | 2 |
| resolution, build or purchase a township hall without | 3 |
| referendum approval, if the building or purchasing of the | 4 |
| township hall is paid or provided for with funds that are not | 5 |
| the proceeds of bonds authorized under this Article. | 6 |

| (60 ILCS 1/150-10)
| 8 |
| Sec. 150-10. Resolution for bond issuance; referendum. | 9 |
| Beginning August 16,
1993, the board of managers elected under | 10 |
| Section 150-15 in a township having a
population of not more | 11 |
| than 25,000 (according to the last preceding federal
census) | 12 |
| shall initiate proceedings for the issuance of bonds under this | 13 |
| Article
by adopting a resolution proposing the issuance of | 14 |
| bonds and describing briefly
the authority under which the | 15 |
| bonds are to be issued, the nature of the project
to be | 16 |
| financed, the estimated total cost of the project, and the | 17 |
| maximum amount
of bonds authorized to be issued. The resolution | 18 |
| shall direct that the
proposition to issue the bonds be | 19 |
| submitted to the electors of the township.
The township clerk | 20 |
| shall certify the proposition to the proper election
officials, | 21 |
| who shall submit the proposition at an election in accordance | 22 |
| with
the general election law.
| 23 |
| The proposition shall be in substantially the following | 24 |
| form:
| 25 |
| Shall bonds for community building purposes be issued |

| to the amount of
$(amount)?
| 2 |
| The votes shall be recorded as "Yes" or "No".
| 3 |
| If a majority of the votes cast on the proposition are in | 4 |
| the affirmative,
the bonds may be issued.
| 5 |
| The provisions of Public Act 88-360 incorporated into this | 6 |
| Section by this
amendatory Act of 1994 do not affect the | 7 |
| obligations of a township or the
rights of bondholders with | 8 |
| respect to bonds issued under this Article or its
predecessor | 9 |
| Act before August 16, 1993.
| 10 |
| Notwithstanding any provision of this Section to the | 11 |
| contrary, any township may, by ordinance or resolution, | 12 |
| purchase, erect, equip, remodel, or renovate a community | 13 |
| building without referendum approval, if the purchasing, | 14 |
| erecting, equipping, remodeling, or renovating of the | 15 |
| community building is paid or provided for with funds that are | 16 |
| not the proceeds of bonds authorized under this Article. | 17 |

| 19 |
| Section 99. Effective date. This Act takes effect upon | 20 |
| becoming law.
