Amends the Mosquito Abatement District Act. Creates a new Section that provides for the cessation of the Des Plaines Valley Mosquito Abatement District, North Shore Mosquito Abatement District, Northwest Mosquito Abatement District, and South Cook County Mosquito Abatement District. Provides that the terms of existing trustees of the 4 mosquito abatement district boards expire on January 1, 2015. Provides for transfer of the powers, duties, employees, property, records, and unexpended revenues of the 4 mosquito abatement districts to the Cook County Department of Environmental Control. Provides for a Cook County Mosquito Abatement Advisory Board composed of 5 members. Provides that the Board of Commissioners of Cook County may pass a resolution or ordinance assigning the powers and duties transferred under this Act to another unit of county government. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Mosquito Abatement District Act is amended | 5 | | by adding Section 15 as follows: | 6 | | (70 ILCS 1005/15 new) | 7 | | Sec. 15. Cessation of the Des Plaines Valley Mosquito | 8 | | Abatement District, North Shore Mosquito Abatement District, | 9 | | Northwest Mosquito Abatement District, and South Cook County | 10 | | Mosquito Abatement District. | 11 | | On January 1, 2015, the Des Plaines Valley, North Shore, | 12 | | Northwest, and South Cook County Mosquito Abatement Districts | 13 | | shall cease. | 14 | | (a) On and after the effective date of this amendatory Act | 15 | | of the 98th General Assembly, no new trustees may be appointed | 16 | | to the boards of the Des Plaines Valley Mosquito Abatement | 17 | | District, the North Shore Mosquito Abatement District, the | 18 | | Northwest Mosquito Abatement District, or the South Cook County | 19 | | Mosquito Abatement District. Those trustees serving on the | 20 | | effective date of this amendatory Act of the 98th General | 21 | | Assembly shall continue in office until January 1, 2015, when | 22 | | their terms shall end. | 23 | | (b) On and after January 1, 2015, the Cook County |

| 1 | | Department of Environmental Control shall exercise the powers | 2 | | of a mosquito abatement district under the Mosquito Abatement | 3 | | District Act within the areas served by the former mosquito | 4 | | abatement districts, except that it shall not exercise the | 5 | | taxing authority provided under Section 9 of the Act. | 6 | | (c) The personnel of the former mosquito abatement | 7 | | districts shall be transferred to the Cook County Department of | 8 | | Environmental Control. The rights of the employees, and Cook | 9 | | County and its agencies, under any applicable contracts or | 10 | | collective bargaining agreements, or under any pension, | 11 | | retirement, or annuity plan, shall not be affected by this | 12 | | amendatory Act. | 13 | | (d) All books, records, papers, documents, property (real | 14 | | and personal), unexpended appropriations, and pending business | 15 | | pertaining to the rights, powers, and duties transferred by | 16 | | this amendatory Act of the 98th General Assembly from the | 17 | | former mosquito abatement districts, including but not limited | 18 | | to material in electronic or magnetic format and necessary | 19 | | computer hardware and software, shall be delivered to the Cook | 20 | | County Department of Environmental Control, pursuant to the | 21 | | direction of the Director of the Department. The Cook County | 22 | | Department of Environmental Control shall have the authority to | 23 | | sell or dispose of the property of the former mosquito | 24 | | abatement districts to help it fulfill its responsibilities | 25 | | under this amendatory Act of the 98th General Assembly. | 26 | | (e) All unexpended revenues and other funds available for |

| 1 | | use by the former mosquito abatement districts shall be | 2 | | transferred for use by the Cook County Department of | 3 | | Environmental Control, pursuant to the direction of the | 4 | | Director of the Department. Unexpended revenues so transferred | 5 | | shall be expended only for the purposes for which the revenues | 6 | | were originally collected. | 7 | | (f) Whenever reports or notices are now required to be made | 8 | | or given, or papers or documents furnished or served by any | 9 | | person to or upon one of the former mosquito abatement | 10 | | districts, the same shall be made, given, furnished, or served | 11 | | in the same manner to or upon the Cook County Department of | 12 | | Environmental Control. | 13 | | (g) This amendatory Act of the 98th General Assembly does | 14 | | not affect any act done, ratified, or canceled, or any right | 15 | | occurring or established, or any action or proceeding had or | 16 | | commenced in an administrative, civil, or criminal cause by the | 17 | | former mosquito abatement districts before this amendatory Act | 18 | | of the 98th General Assembly takes effect; such actions or | 19 | | proceedings may be prosecuted and continued by the Cook County | 20 | | Department of Environmental Control. | 21 | | (h) On January 1, 2015, a Cook County Mosquito Abatement | 22 | | Advisory Board is created, composed of 5 members. The President | 23 | | of the Board of Commissioners of Cook County shall appoint 4 | 24 | | members, each residing in a different one of the 4 areas served | 25 | | by the former mosquito abatement districts, plus one additional | 26 | | member as the chairperson of the Advisory Board. | 1 | | Board shall meet at the call of the chairperson, and its | 2 | | members shall serve without compensation. | 3 | | (i) The Board of Commissioners of Cook County may by | 4 | | ordinance or resolution provide that the powers and duties | 5 | | transferred under this amendatory Act of the 98th General | 6 | | Assembly be transferred to another unit of county government.
| 7 | | Section 99. Effective date. This Act takes effect upon | 8 | | becoming law.
