| 1 | | AN ACT concerning regulation. | 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly: | 4 | | Section 1. Short title. This Act may be cited as the Small | 5 | | Single-Use Plastic Act. | 6 | | Section 5. Definitions. As used in this Act: | 7 | | "Hotel" has the meaning given in the Hotel Operators' | 8 | | Occupation Tax Act. | 9 | | "Personal care products" includes shampoo, hair | 10 | | conditioner, and bath soap intended to be applied to or used on | 11 | | the human body in the shower or bath. | 12 | | "Small, single-use plastic bottle" means a plastic bottle | 13 | | or container with less than a 6-ounce capacity that is | 14 | | intended to be nonreusable by the end user. | 15 | | Section 10. Small, single-use plastic bottles at hotels. | 16 | | (a) Beginning July 1, 2025, a hotel with 50 rooms or more | 17 | | shall not provide small, single-use plastic bottles containing | 18 | | personal care products in any space within a sleeping room | 19 | | accommodation, within bathrooms shared by the public or | 20 | | guests, or to a customer of the establishment staying in a | 21 | | sleeping room accommodation. | 22 | | (b) Beginning January 1, 2026, a hotel shall not provide |

| 1 | | small, single-use plastic bottles containing personal care | 2 | | products in any space within a sleeping room accommodation, | 3 | | within bathrooms shared by the public or guests, or to a | 4 | | customer of the establishment staying in a sleeping room | 5 | | accommodation. | 6 | | (c) A hotel may provide personal care products in small, | 7 | | single-use plastic bottles to a person at no cost, upon | 8 | | request, at a place other than a sleeping room accommodation, | 9 | | a space within the sleeping room accommodation, or a space | 10 | | within bathrooms shared by the public or guests. | 11 | | (d) A unit of local government, including a home rule | 12 | | unit, shall not regulate the provision of small, single-use | 13 | | plastic bottles in a manner inconsistent with the regulation | 14 | | by the State of the provision of small, single-use plastic | 15 | | bottles under this Act. This Section is a limitation under | 16 | | subsection (i) of Section 6 of Article VII of the Illinois | 17 | | Constitution on the concurrent exercise by home rule units of | 18 | | powers and functions exercised by the State. | 19 | | Section 15. Penalties. A hotel in violation of this Act | 20 | | shall receive a written warning from the local unit of | 21 | | government in which the hotel is located for the first | 22 | | violation. The written warning shall recite the violation and | 23 | | advise that subsequent violations may result in citations and | 24 | | penalties. A hotel that commits a second or subsequent | 25 | | violation is guilty of a business offense and shall be fined |
