AMENDMENT TO SENATE BILL 74

2    AMENDMENT NO. ______. Amend Senate Bill 74 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Housing Development Act is
5amended by adding Section 35 as follows:
 
6    (20 ILCS 3805/35 new)
7    Sec. 35. Property Tax Payment Plan Task Force.
8    (a) In counties with 3,000,000 or more inhabitants, the
9annual tax sale has a disproportionately negative impact on
10minority communities. The loss of owner-occupied homes
11following the annual tax sale results in a loss of home equity
12for impacted households and negatively impacts the ability of
13those households to build generational wealth. The creation of
14a well-designed payment plan program that allows
15owner-occupants to repay delinquent property taxes has the
16potential to help homeowners who are unable to afford their

1property taxes avoid the tax sale and the potential loss of
2their home while also ensuring that property taxes are
3collected for the benefit of local taxing districts. Such a
4payment plan program will result in a more equitable and
5effective property tax system.
6    (b) The Property Tax Payment Plan Task Force is hereby
7created. The Task Force shall consist of the following
8members:
9        (1) one member, who shall serve as co-chairperson of
10    the Task Force, appointed by the President of the Senate;
11        (2) one member, who shall serve as co-chairperson of
12    the Task Force, appointed by the Speaker of the House of
13    Representatives;
14        (3) one member appointed by the Minority Leader of the
15    Senate;
16        (4) one member appointed by the Minority Leader of the
17    House of Representatives;
18        (5) one member appointed by the Executive Director of
19    the Illinois Housing Development Authority;
20        (6) one member representing the Cook County
21    Treasurer's Office, appointed by the Governor;
22        (7) one member representing the Cook County Clerk's
23    office, appointed by the Governor;
24        (8) one member representing the Cook County
25    President's Office, appointed by the Governor;
26        (9) up to 2 members, appointed by the Governor,

1    representing nonprofit affordable housing organizations in
2    counties with 3,000,000 or more inhabitants, housing
3    counseling organizations in counties with 3,000,000 or
4    more inhabitants, or homeownership organizations in
5    counties with 3,000,000 or more inhabitants;
6        (10) up to 2 members, appointed by the Governor,
7    representing community, neighborhood, or resident
8    associations in counties with 3,000,000 or more
9    inhabitants;
10        (11) up to 2 members, appointed by the Governor,
11    representing public interest organizations from counties
12    with 3,000,000 or more inhabitants or civic organizations
13    from counties with 3,000,000 or more inhabitants;
14        (12) up to 3 members, appointed by the Governor,
15    representing local municipalities with properties that are
16    the most highly represented in the annual tax sale in
17    counties with 3,000,000 or more inhabitants; and
18        (13) up to 3 members, appointed by the Governor,
19    representing taxing districts, other than municipalities,
20    with properties that are the most highly represented in
21    the annual tax sale in counties with 3,000,000 or more
22    inhabitants.
23    Members of the Task Force shall be appointed no later than
2430 days after the effective date of this amendatory Act of the
25103rd General Assembly. If any members are not appointed
26within that 30-day period, the appointing authority shall be

1deemed to have waived the right to make that appointment.
2Vacancies in the Task Force, other than a vacancy occurring
3because of a waiver by the appointing authority under this
4subsection, shall be filled by the original appointing
5authority.
6    (c) Members of the Task Force shall serve without
7compensation. The Illinois Housing Development Authority shall
8provide administrative support to the Task Force as needed.
9    (d) The members of the Task Force are exempt from any
10training, disclosure, or filing requirements under the State
11Officials and Employees Ethics Act, the Illinois Governmental
12Ethics Act, or any other applicable State law or rule imposing
13such requirements.
14    (e) Once all of the members have been appointed, the Task
15Force shall meet not less than 4 times to carry out the duties
16prescribed in this Section. Members of the Task Force may
17attend those meetings virtually.
18    (f) The Task Force shall study and make recommendations
19for the implementation of one or more payment plan options in
20counties with 3,000,000 or more inhabitants to prevent
21eligible tax-delinquent owner-occupied properties in those
22counties from being sold at the annual tax sale. The Task Force
23shall take into consideration the impact of the payment plan
24option on homeowners, taxpayers, local agencies responsible
25for the collection of property taxes, and local taxing
26districts. These recommendations may be used to recommend

1legislation in the 103rd General Assembly or a subsequent
2General Assembly.
3    (g) A report detailing the Task Force's findings,
4conclusions, and recommendations shall be submitted to the
5General Assembly no later than November 15, 2023. The Task
6Force is dissolved upon submission of the report.
7    (h) This Section is repealed on January 1, 2025.
 
8    Section 99. Effective date. This Act takes effect upon
9becoming law.".
