SYNOPSIS AS INTRODUCED:
 
225 ILCS 85/15.15 new

    Amends the Pharmacy Practice Act. Provides that a pharmacy shall notify each person to whom a prescription drug is dispensed that an accessible prescription label is available to the person upon request at no additional cost. Provides that if a person informs the pharmacy that the person is blind, visually impaired, or otherwise print disabled, then the pharmacy shall provide to the person an accessible prescription label affixed to the bottle and the conditions of that label. Provides that a pharmacy shall ensure that a prescription label is compatible with the prescription reader if a prescription reader is provided. Provides that the provisions do not apply to prescription drugs dispensed or administered by an institutional pharmacy or correctional institution. Provides that the Department of Financial and Professional Regulation shall adopt rules to implement these provisions.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Pharmacy Practice Act is amended by adding
5Section 15.15 as follows:
 
6    (225 ILCS 85/15.15 new)
7    Sec. 15.15. Accessible prescription labels.
8    (a) As used in this Section:
9    "Prescription reader" means a device that is designed to
10audibly convey the information contained on the label of a
11prescription drug.
12    "Institutional pharmacy" means a pharmacy that is part of
13or is operated in conjunction with any of the following health
14care facilities: hospital, ambulatory surgical facility,
15nursing home, residential care facility, freestanding
16rehabilitation facility, hospice care program, home and
17community-based service provider, residential facility for
18individuals with mental illness or developmental disabilities,
19or any similar health care facility.
20    (b) A pharmacy shall notify each person to whom a
21prescription drug is dispensed that an accessible prescription
22label is available to the person upon request at no additional
23cost.

1    (c) If a person informs the pharmacy that the person is
2blind, visually impaired, or otherwise print disabled, then
3the pharmacy shall provide to the person an accessible
4prescription label affixed to the bottle that:
5        (1) is available to the person in a timely manner
6    comparable to other patient wait time and lasts for at
7    least the duration of the prescription;
8        (2) is appropriate to the disability of the person
9    making the request through use of large print, braille, or
10    other appropriate methods;
11        (3) conforms to the format specific best practices as
12    established by the United States Access Board; and
13        (4) contains all the label information required by
14    State statute and federal law, including cautions,
15    warnings, and any other information available to sighted
16    individuals reading the printed label.
17    (d) A pharmacy shall ensure that a prescription label is
18compatible with the prescription reader if a prescription
19reader is provided.
20    (e) This Section does not apply to prescription drugs
21dispensed or administered by an institutional pharmacy or
22correctional institution.
23    (f) The Department shall adopt rules to implement this
24Section.
