AMENDMENT TO HOUSE BILL 2220

2    AMENDMENT NO. ______. Amend House Bill 2220, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Innkeeper Protection Act is amended by
6adding Sections 10 and 11 as follows:
 
7    (740 ILCS 90/10 new)
8    Sec. 10. Refusal of admission. A proprietor or manager of
9a hotel may refuse to admit or refuse service or
10accommodations to a person who:
11        (1) while on the premises of the hotel, destroys or
12    threatens to destroy hotel property or causes or threatens
13    to cause a public disturbance; or
14        (2) is seeking accommodations for the unlawful
15    possession or use of controlled substances or the use of
16    the premises for the consumption of alcoholic liquor by a

1    person under the age of 21.
 
2    (740 ILCS 90/11 new)
3    Sec. 11. Right to eject.
4    (a) A proprietor or manager of a hotel may remove or cause
5to be removed from a hotel a guest or other person who:
6        (1) refuses to pay for accommodations or services;
7        (2) while on the premises of the hotel, destroys or
8    threatens to destroy hotel property, verbally or
9    physically threatens employees or guests, or causes or
10    threatens to cause a public disturbance;
11        (3) is using the premises for the unlawful possession
12    or use of controlled substances by the person or using the
13    premises for the consumption of alcoholic liquor by a
14    person under the age of 21 years of age;
15        (4) violates any federal, State, or local laws,
16    ordinances, or rules relating to the hotel;
17        (5) violates a rule of the hotel that is clearly and
18    conspicuously posted at or near the front desk or posted
19    online where the guest can view it before making a
20    reservation at the hotel; or
21        (6) uses verbally abusive language toward the hotel's
22    employees or guests. As used in this Section, "verbally
23    abusive language" means any language that would reasonably
24    be found to be threatening or demeaning.
25    (b) If the guest has paid in advance, the proprietor or

1manager of a hotel shall tender to the guest any unused portion
2of the advance payment at the time of removal.
3    (c) Nothing in this Section shall be used as a pretext to
4discriminate against a guest on the basis of characteristics
5protected under local, State, or federal antidiscrimination
6laws. This Section does not limit any rights or protections
7that a guest or other person may have under local, State, or
8federal antidiscrimination or civil rights laws.
 
9    Section 99. Effective date. This Act takes effect upon
10becoming law.".
