SYNOPSIS AS INTRODUCED:
 
ILCON Art. XIII, Sec. 5

    Proposes to amend the General Provisions Article of the Illinois Constitution. Removes language that provides that membership in any pension or retirement system of the State, any unit of local government or school district, or any agency or instrumentality thereof shall be an enforceable contractual relationship, the benefits of which shall not be diminished or impaired. Provides that nothing in the Illinois Constitution or in any law shall be construed to limit the power of the General Assembly to reduce or change pension benefits or other benefits of membership in any public pension or public retirement system, regardless of whether those benefits have accrued or have been earned and regardless of when those benefits were established. Effective upon being declared adopted.

3    RESOLVED, BY THE SENATE OF THE ONE HUNDRED SECOND GENERAL
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF
5REPRESENTATIVES CONCURRING HEREIN, that there shall be
6submitted to the electors of the State for adoption or
7rejection at the general election next occurring at least 6
8months after the adoption of this resolution a proposition to
9amend Section 5 of Article XIII of the Illinois Constitution
10as follows:

GENERAL PROVISIONS

14SECTION 5. PENSION AND RETIREMENT BENEFITS RIGHTS
15    Nothing in this Constitution or in any law shall be
16construed to limit the power of the General Assembly to reduce
17or change pension benefits or other benefits of membership in
18any public pension or public retirement system, regardless of
19whether those benefits have accrued or have been earned and
20regardless of when those benefits were established. Membership
21in any pension or retirement system of the State, any unit of
22local government or school district, or any agency or

SCHEDULE
5    This Constitutional Amendment takes effect upon being
6declared adopted in accordance with Section 7 of the Illinois
7Constitutional Amendment Act.
