AMENDMENT TO SENATE BILL 3166

2    AMENDMENT NO. ______. Amend Senate Bill 3166 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The University of Illinois Hospital Act is
5amended by adding Section 8g as follows:
 
6    (110 ILCS 330/8g new)
7    Sec. 8g. University of Illinois Hospital employee
8assistance programs. The University of Illinois Hospital shall
9ensure that nurses employed by the University of Illinois
10Hospital are aware of employee assistance programs or other
11like programs available for the physical and mental well-being
12of the employee. The University of Illinois Hospital shall
13provide information on these programs, no less than at the
14time of employment and during any benefit open enrollment
15period, by an information form about the respective programs
16that a nurse must sign during onboarding at the University of

1Illinois Hospital. The signed information form shall be added
2to the nurse's personnel file. The University of Illinois
3Hospital may provide this information to nurses
4electronically.
 
5    Section 10. The Assisted Living and Shared Housing Act is
6amended by adding Section 77 as follows:
 
7    (210 ILCS 9/77 new)
8    Sec. 77. Establishment employee assistance programs. An
9establishment shall ensure that licensed health care
10professionals employed by the establishment are aware of
11employee assistance programs or other like programs available
12for the physical and mental well-being of the employee. The
13establishment shall provide information on these programs, no
14less than at the time of employment and during any benefit open
15enrollment period, by an information form about the respective
16programs that a licensed health care professional must sign
17during onboarding at the establishment. The signed information
18form shall be added to the licensed health care professional's
19personnel file. The establishment may provide this information
20to licensed health care professionals electronically.
 
21    Section 15. The Community Living Facilities Licensing Act
22is amended by adding Section 5.10 as follows:

1    (210 ILCS 35/5.10 new)
2    Sec. 5.10. Community Living Facility employee assistance
3programs. A Community Living Facility shall ensure that
4licensed health care professionals employed by the Community
5Living Facility are aware of employee assistance programs or
6other like programs available for the physical and mental
7well-being of the employee. The Community Living Facility
8shall provide information on these programs, no less than at
9the time of employment and during any benefit open enrollment
10period, by an information form about the respective programs
11that a licensed health care professional must sign during
12onboarding at the Community Living Facility. The signed
13information form shall be added to the licensed health care
14professional's personnel file. The Community Living Facility
15may provide this information to licensed health care
16professionals electronically.
 
17    Section 20. The Life Care Facilities Act is amended by
18adding Section 10.2 as follows:
 
19    (210 ILCS 40/10.2 new)
20    Sec. 10.2. Facility employee assistance programs. A
21facility shall ensure that nurses employed by the facility are
22aware of employee assistance programs or other like programs
23available for the physical and mental well-being of the
24employee. The facility shall provide information on these

1programs, no less than at the time of employment and during any
2benefit open enrollment period, by an information form about
3the respective programs that the nurse must sign during
4onboarding at the facility. The signed information form shall
5be added to the nurse's personnel file. The facility may

7    Section 25. The Nursing Home Care Act is amended by adding
8Section 3-613 as follows:
 
9    (210 ILCS 45/3-613 new)
10    Sec. 3-613. Facility employee assistance programs. A
11facility shall ensure that nurses employed by the facility are
12aware of employee assistance programs or other like programs
13available for the physical and mental well-being of the
14employee. The facility shall provide information on these
15programs, no less than at the time of employment and during any
16benefit open enrollment period, by an information form about
17the respective programs that a nurse must sign during
18onboarding at the facility. The signed information form shall
19be added to the nurse's personnel file. The facility may
20provide this information to nurses electronically.
 
21    Section 30. The MC/DD Act is amended by adding Section

2    Sec. 3-613. Facility employee assistance programs. A
3facility shall ensure that nurses employed by the facility are
4aware of employee assistance programs or other like programs
5available for the physical and mental well-being of the
6employee. The facility shall provide information on these
7programs, no less than at the time of employment and during any
8benefit open enrollment period, by an information form about
9the respective programs that a nurse must sign during
10onboarding at the facility. The signed information form shall
11be added to the nurse's personnel file. The facility may
12provide this information to nurses electronically.
 
13    Section 35. The ID/DD Community Care Act is amended by
14adding Section 3-613 as follows:
 
15    (210 ILCS 47/3-613 new)
16    Sec. 3-613. Facility employee assistance programs. A
17facility shall ensure that nurses employed by the facility are
18aware of employee assistance programs or other like programs
19available for the physical and mental well-being of the
20employee. The facility shall provide information on these
21programs, no less than at the time of employment and during any
22benefit open enrollment period, by an information form about
23the respective programs that a nurse must sign during

3    Section 40. The Hospital Licensing Act is amended by
4adding Section 6.33 as follows:
 
5    (210 ILCS 85/6.33 new)
6    Sec. 6.33. Hospital employee assistance programs. A
7hospital licensed under this Act shall ensure that employees
8of the hospital are made aware of employee assistance programs
9or other like programs available for the physical and mental
10well-being of the employees. Hospitals shall provide
11information on these programs, no less than at the time of
12employment and during any benefit open enrollment period, by
13an information form about the respective programs that an
14employee must sign during onboarding at the hospital. A
15hospital may provide this information to employees
16electronically.".
