    Amends the University of Illinois Hospital Act, the Assisted Living and Shared Housing Act, the Community Living Facilities Licensing Act, the Life Care Facilities Act, the Nursing Home Care Act, the MC/DD Act, the ID/DD Community Care Act, and the Hospital Licensing Act. Provides that hospitals, establishments, or facilities organized or licensed under the Acts shall ensure that nurses employed by the hospital, establishment, or facility are aware of the Illinois Professionals Health Program (IPHP) by completing specified requirements. Amends the Nurse Practice Act. In provisions regarding continuing education for RN and APRN licensees, requires one hour of training on substance abuse and disorders for nurses.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The University of Illinois Hospital Act is
5amended by adding Section 8g as follows:
 
6    (110 ILCS 330/8g new)
7    Sec. 8g. Illinois Professionals Health Program (IPHP);
8nurse awareness. The University of Illinois Hospital shall
9ensure that nurses employed by the University of Illinois
10Hospital are aware of the Illinois Professionals Health
11Program (IPHP) by completing the following:
12        (1) Include an information form about the Program that
13    a nurse must sign during onboarding at the University of
14    Illinois Hospital. The signed information form shall be
15    added to the nurse's personnel file.
16        (2) Conduct mandatory training on substance abuse
17    disorders for continued awareness and support. The
18    training may be added to continuing education training
19    University of Illinois Hospital nurses are otherwise
20    required to complete.
 
21    Section 10. The Assisted Living and Shared Housing Act is
22amended by adding Section 77 as follows:

2    Sec. 77. Illinois Professionals Health Program (IPHP);
3nurse awareness. An establishment shall ensure that licensed
4health care professionals employed by the establishment are
5aware of the Illinois Professionals Health Program (IPHP) by
6completing the following:
7        (1) Include an information form about the Program that
8    a licensed health care professional must sign during
9    onboarding at the establishment. The signed information
10    form shall be added to the licensed health care
11    professional's personnel file.
12        (2) Conduct mandatory training on substance abuse
13    disorders for continued awareness and support. The
14    training may be added to continuing education training
15    that establishment licensed health care professionals are
16    otherwise required to complete.
 
17    Section 15. The Community Living Facilities Licensing Act
18is amended by adding Section 5.10 as follows:
 
19    (210 ILCS 35/5.10 new)
20    Sec. 5.10. Illinois Professionals Health Program (IPHP);
21nurse awareness. A Community Living Facility shall ensure that
22licensed health care professionals employed by the Community
23Living Facility are aware of the Illinois Professionals Health

2        (1) Include an information form about the Program that

4    onboarding at the Community Living Facility. The signed

10    that Community Living Facility licensed health care
11    professionals are otherwise required to complete.
 
12    Section 20. The Life Care Facilities Act is amended by
13adding Section 10.2 as follows:

15    Sec. 10.2. Illinois Professionals Health Program (IPHP);
16nurse awareness. A facility shall ensure that facility
17employees who provide nursing services are aware of the
18Illinois Professionals Health Program (IPHP) by completing the
19following:
20        (1) Include an information form about the Program that
21    an employee who provides nursing services must sign during
22    onboarding at the facility. The signed information form
23    shall be added to the employee's personnel file.

20    Section 30. The MC/DD Act is amended by adding Section
213-613 as follows:

18by the facility are aware of the Illinois Professionals Health
19Program (IPHP) by completing the following:
20        (1) Include an information form about the Program that
21    a nurse must sign during onboarding at the facility. The

23    personnel file.

4    Section 40. The Hospital Licensing Act is amended by
5adding Section 6.33 as follows:
 
6    (210 ILCS 85/6.33 new)
7    Sec. 6.33. Illinois Professionals Health Program (IPHP);
8nurse awareness. A hospital licensed under this Act shall
9ensure that nurses employed by the hospital are aware of the
10Illinois Professionals Health Program (IPHP) by completing the
11following:
12        (1) Include an information form about the Program that
13    a nurse must sign during onboarding at the hospital. The
14    signed information form shall be added to the nurse's
15    personnel file.
16        (2) Conduct mandatory training on substance abuse
17    disorders for continued awareness and support. The
18    training may be added to the continuing education training
19    hospital nurses are otherwise required to complete.
 
20    Section 45. The Nurse Practice Act is amended by changing
21Sections 60-40 and 65-60 as follows:
 
22    (225 ILCS 65/60-40)

1    (Section scheduled to be repealed on January 1, 2028)
2    Sec. 60-40. Continuing education for RN licensees. The
3Department may adopt rules of continuing education for
4registered professional nurses licensed under this Act that
5require 20 hours of continuing education per 2-year license
6renewal cycle. The rules shall address variances in part or in
7whole for good cause, including without limitation illness or
8hardship. The continuing education rules must ensure that
9licensees are given the opportunity to participate in programs
10sponsored by or through their State or national professional
11associations, hospitals, or other providers of continuing
12education. The continuing education rules must allow for a
13licensee to complete all required hours of continuing
14education in an online format. The continuing education rules
15must ensure that each licensee completes one hour of training
16on substance abuse and disorders for nurses. Each licensee is
17responsible for maintaining records of completion of
18continuing education and shall be prepared to produce the
19records when requested by the Department.

23    Sec. 65-60. Continuing education. The Department shall
24adopt rules of continuing education for persons licensed under
25this Article as advanced practice registered nurses that

1require 80 hours of continuing education per 2-year license
2renewal cycle. Completion of the 80 hours of continuing
3education shall be deemed to satisfy the continuing education
4requirements for renewal of a registered professional nurse
5license as required by this Act.
6    The 80 hours of continuing education required under this
7Section shall be completed as follows:
8        (1) A minimum of 50 hours of the continuing education
9    shall be obtained in continuing education programs as
10    determined by rule that shall include no less than 20
11    hours of pharmacotherapeutics, including 10 hours of
12    opioid prescribing or substance abuse education.
13    Continuing education programs may be conducted or endorsed
14    by educational institutions, hospitals, specialist
15    associations, facilities, or other organizations approved
16    to offer continuing education under this Act or rules and
17    shall be in the advanced practice registered nurse's
18    specialty.
19        (2) A maximum of 30 hours of credit may be obtained by
20    presentations in the advanced practice registered nurse's
21    clinical specialty, evidence-based practice, or quality
22    improvement projects, publications, research projects, or
23    preceptor hours as determined by rule.
24        (3) One hour of training completed under paragraph (1)
25    or (2) must be dedicated to substance abuse and disorders
26    for nurses.

1    The rules adopted regarding continuing education shall be
2consistent to the extent possible with requirements of
3relevant national certifying bodies or State or national
4professional associations.
5    The rules shall not be inconsistent with requirements of
6relevant national certifying bodies or State or national
7professional associations. The rules shall also address
8variances in part or in whole for good cause, including but not
9limited to illness or hardship. The continuing education rules
10shall assure that licensees are given the opportunity to
11participate in programs sponsored by or through their State or
12national professional associations, hospitals, or other
13providers of continuing education. Each licensee is
14responsible for maintaining records of completion of
15continuing education and shall be prepared to produce the
16records when requested by the Department.
