| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2172 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The Pharmacy Practice Act is amended by | 5 | | changing Sections 9.5 and 17.1 as follows: | 6 | | (225 ILCS 85/9.5) | 7 | | (Section scheduled to be repealed on January 1, 2023)
| 8 | | Sec. 9.5. Registered certified pharmacy technician. | 9 | | (a) An individual licensed as a registered pharmacy | 10 | | technician under this Act may be licensed as a registered | 11 | | certified pharmacy technician, if he or she meets all of the | 12 | | following requirements: | 13 | | (1) He or she has submitted a written application in | 14 | | the form and manner prescribed by the Department. | 15 | | (2) He or she has attained the age of 18. | 16 | | (3) He or she is of good moral character, as |

| 1 | | determined by the Department. | 2 | | (4) Beginning on January 1, 2024 2022 , a new pharmacy | 3 | | technician is required to have (i) graduated from a | 4 | | pharmacy technician training program that meets the | 5 | | requirements set forth in subsection (a) of Section 17.1 | 6 | | of this Act or (ii) obtained documentation from the | 7 | | pharmacist-in-charge of the pharmacy where the applicant | 8 | | is employed verifying that he or she has successfully | 9 | | completed a standardized nationally accredited education | 10 | | and training program, and has successfully completed an | 11 | | objective assessment mechanism prepared in accordance with | 12 | | rules established by the Department. | 13 | | (5) He or she has successfully passed an examination | 14 | | accredited by the National Commission for Certifying | 15 | | Agencies, as approved and required by the Board or by | 16 | | rule. | 17 | | (6) He or she has paid the required licensure fees. | 18 | | (b) No pharmacist whose license has been denied, revoked, | 19 | | suspended, or restricted for disciplinary purposes may be | 20 | | eligible to be registered as a certified pharmacy technician | 21 | | unless authorized by order of the Department as a condition of | 22 | | restoration from revocation, suspension, or restriction. | 23 | | (c) The Department may, by rule, establish any additional | 24 | | requirements for licensure under this Section.
| 25 | | (d) A person who is not a licensed registered pharmacy | 26 | | technician and meets the requirements of this Section may be |

| 1 | | licensed as a registered certified pharmacy technician without | 2 | | first being licensed as a registered pharmacy technician. | 3 | | (e) As a condition for the renewal of a license as a | 4 | | registered certified pharmacy technician, the licensee shall | 5 | | provide evidence to the Department of completion of a total of | 6 | | 20 hours of continuing pharmacy education during the 24 months | 7 | | preceding the expiration date of the certificate as | 8 | | established by rule. One hour of continuing pharmacy education | 9 | | must be in the subject of pharmacy law. One hour of continuing | 10 | | pharmacy education must be in the subject of patient safety. | 11 | | The continuing education shall be approved by the | 12 | | Accreditation Council on Pharmacy Education. | 13 | | The Department may establish by rule a means for the | 14 | | verification of completion of the continuing education | 15 | | required by this subsection (e). This verification may be | 16 | | accomplished through audits of records maintained by | 17 | | licensees, by requiring the filing of continuing education | 18 | | certificates with the Department or a qualified organization | 19 | | selected by the Department to maintain such records, or by | 20 | | other means established by the Department. | 21 | | Rules developed under this subsection (e) may provide for | 22 | | a reasonable annual fee, not to exceed $20, to fund the cost of | 23 | | such recordkeeping. The Department may, by rule, further | 24 | | provide an orderly process for the restoration of a license | 25 | | that has not been renewed due to the failure to meet the | 26 | | continuing pharmacy education requirements of this subsection |

| 1 | | (e). The Department may waive the requirements of continuing | 2 | | pharmacy education, in whole or in part, in cases of extreme | 3 | | hardship as defined by rule of the Department. | 9 | | Sec. 17.1. Registered pharmacy technician training.
| 10 | | (a) It shall be the joint responsibility of a
pharmacy
and | 11 | | its pharmacist in charge to have trained all of its registered | 12 | | pharmacy technicians
or obtain
proof of prior training in all | 13 | | of the following practice areas as they apply to Illinois law | 14 | | and relate to the
specific practice site and job | 15 | | responsibilities:
| 16 | | (1) The duties and responsibilities of the technicians | 17 | | and pharmacists.
| 18 | | (2) Tasks and technical skills, policies, and | 19 | | procedures.
| 20 | | (3) Compounding, packaging, labeling, and storage.
| 21 | | (4) Pharmaceutical and medical terminology.
| 22 | | (5) Record keeping requirements.
| 23 | | (6) The ability to perform and apply arithmetic | 24 | | calculations.

| 1 | | responsibility of a pharmacy and its pharmacist in charge to | 2 | | ensure that all new pharmacy technicians are educated and | 3 | | trained using a standard nationally accredited education and | 4 | | training program, such as those accredited by the | 5 | | Accreditation Council for Pharmacy Education (ACPE)/the | 6 | | American Society of Health-System Pharmacists (ASHP) or other | 7 | | board approved education and training programs. The pharmacist | 8 | | in charge is not required to provide the required education to | 9 | | the pharmacy technician, but the pharmacist in charge must | 10 | | ensure that the pharmacy technician has presented proof that | 11 | | he or she completed a standard nationally accredited or board | 12 | | approved education and training program. | 13 | | (b) Within 2 years of initial licensure as a pharmacy | 14 | | technician and within 6 months before beginning any new duties | 15 | | and
responsibilities of a registered pharmacy technician, it
| 16 | | shall be
the joint responsibility of the pharmacy and the | 17 | | pharmacist in charge to
train the registered
pharmacy | 18 | | technician or obtain proof of prior training in the areas | 19 | | listed in
subsection (a)
of this Section as they relate to the | 20 | | practice site or to document that the pharmacy technician is | 21 | | making appropriate progress.
| 22 | | (c) All pharmacies shall maintain an up-to-date training
| 23 | | program policies and procedures manual
describing the duties | 24 | | and responsibilities of a registered pharmacy technician and | 25 | | registered certified pharmacy technician.

training or proof of training as required in this | 2 | | Section.
