AMENDMENT TO SENATE BILL 1673

2    AMENDMENT NO. ______. Amend Senate Bill 1673 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Animal Control Act is amended by changing
5Sections 2.11c, 3.5, and 9 as follows:
 
6    (510 ILCS 5/2.11c)
7    Sec. 2.11c. Intact animal. "Intact animal" means an animal
8that has not been sterilized spayed or neutered.

11    Sec. 3.5. County animal population fund use limitation.
12Funds placed in the county animal population control fund may
13only be used to (1) spay, neuter, vaccinate, or sterilize
14adopted dogs or cats; (2) sterilize spay, neuter, or vaccinate
15dogs or cats owned by low income county residents who are

1eligible for the Food Stamp Program or Social Security
2Disability Benefits Program; or (3) sterilize spay, neuter,
3and vaccinate feral cats in programs recognized by the county
4or a municipality. This Section does not apply to a county with
53,000,000 or more inhabitants.

8    Sec. 9. Any dog found running at large contrary to
9provisions of this Act may be apprehended and impounded. For
10this purpose, the Administrator shall utilize any existing or
11available animal control facility or licensed animal shelter.
12The dog's owner shall pay a $25 public safety fine to be
13deposited into the county animal control fund or the county
14pet population control fund. Funds transferred to or retained
15by a municipality before the effective date of this amendatory
16Act of the 100th General Assembly under this paragraph shall
17continue to be transferred to and be retained by that
18municipality. A dog found running at large contrary to the
19provisions of this Act a second or subsequent time must be
20sterilized spayed or neutered within 30 days after being
21reclaimed unless already sterilized spayed or neutered;
22failure to comply shall result in impoundment.
23    A dog that is actively engaged in a legal hunting
24activity, including training, is not considered to be running
25at large if the dog is on land that is open to hunting or on

1land on which the person has obtained permission to hunt or to
2train a dog. A dog that is in a dog-friendly area or dog park
3is not considered to be running at large if the dog is
4monitored or supervised by a person.
