1    AN ACT concerning animals.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Animal Control Act is amended by changing
5Sections 2.11c, 3.5, and 9 as follows:
 
6    (510 ILCS 5/2.11c)
7    Sec. 2.11c. Intact animal. "Intact animal" means an animal
8that has not been sterilized spayed or neutered.

11    Sec. 3.5. County animal population fund use limitation.
12Funds placed in the county animal population control fund may
13only be used to (1) spay, neuter, vaccinate, or sterilize
14adopted dogs or cats; (2) sterilize spay, neuter, or vaccinate
15dogs or cats owned by low income county residents who are
16eligible for the Food Stamp Program or Social Security
17Disability Benefits Program; or (3) sterilize spay, neuter,
18and vaccinate feral cats in programs recognized by the county
19or a municipality. This Section does not apply to a county with
203,000,000 or more inhabitants.

2    Sec. 9. Any dog found running at large contrary to
3provisions of this Act may be apprehended and impounded. For
4this purpose, the Administrator shall utilize any existing or
5available animal control facility or licensed animal shelter.
6The dog's owner shall pay a $25 public safety fine to be
7deposited into the county animal control fund or the county
8pet population control fund. Funds transferred to or retained
9by a municipality before the effective date of this amendatory
10Act of the 100th General Assembly under this paragraph shall
11continue to be transferred to and be retained by that
12municipality. A dog found running at large contrary to the
13provisions of this Act a second or subsequent time must be
14sterilized spayed or neutered within 30 days after being
15reclaimed unless already sterilized spayed or neutered;
16failure to comply shall result in impoundment.
17    A dog that is actively engaged in a legal hunting
18activity, including training, is not considered to be running
19at large if the dog is on land that is open to hunting or on
20land on which the person has obtained permission to hunt or to
21train a dog. A dog that is in a dog-friendly area or dog park
22is not considered to be running at large if the dog is
23monitored or supervised by a person.
