AMENDMENT TO SENATE BILL 1079

2    AMENDMENT NO. ______. Amend Senate Bill 1079 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Professional Regulation Law
5of the Civil Administrative Code of Illinois is amended by
6changing Section 2105-15.5 as follows:
 
7    (20 ILCS 2105/2105-15.5)
8    Sec. 2105-15.5. Continuing education; sexual harassment
9prevention training.
10    (a) The Department shall require each licensee to complete
11sexual harassment prevention training provided by the
12licensee's employer, the Department of Human Rights, or any
13continuing education provider authorized to provide continuing
14education under an Act administered by the Department in
15accordance with Section 2-109 of the Illinois Human Rights
16Act. The training shall be completed, at a minimum, prior to a

1licensee's renewal of his or her license. As used in this
2Section, "sexual harassment" means any unwelcome sexual
3advances or requests for sexual favors or any conduct of a
4sexual nature when: (i) submission to such conduct is made
5either explicitly or implicitly a term or condition of an
6individual's employment; (ii) submission to or rejection of
7such conduct by an individual is used as the basis for
8employment decisions affecting such individual; or (iii) such
9conduct has the purpose or effect of substantially interfering
10with an individual's work performance or creating an
11intimidating, hostile, or offensive working environment. For
12the purpose of this definition, "working environment" is not
13limited to a physical location that an employee is assigned to
14perform his or her duties and does not require an employment
15relationship.
16    (b) For license renewals occurring on or after January 1,
172020 for a profession that has continuing education
18requirements, the required continuing education hours shall
19include at least one hour of sexual harassment prevention
20training.
21    (b) (c) The Department may adopt rules for the
22implementation of this Section.

24    Section 99. Effective date. This Act takes effect upon
25becoming law.".
