SYNOPSIS AS INTRODUCED:

210 ILCS 5/7d new
210 ILCS 85/6.28 new
225 ILCS 85/15.10 new

    Amends the University of Illinois Hospital Act, the Ambulatory Surgical Treatment Center Act, the Hospital Licensing Act, and the Pharmacy Practice Act. Requires hospitals and facilities to offer a patient any unused portion of a facility-provided medication upon discharge when it is administered to a patient at the hospital or facility and is required for continuing treatment. Defines "facility-provided medication". Provides that an unused portion of a facility-provided medication required for continuing treatment must be provided to a patient upon discharge when the facility-provided medication is ordered at least 24 hours in advance for surgical procedures. Requires facility-medications to be consistent with labeling requirements under specified provisions of the Pharmacy Practice Act. Provides that if a facility-provided medication is used in an operating room or emergency department setting, the prescriber is responsible for counseling the patient on its proper use and administration and the requirement of pharmacist counseling is waived. Effective July 1, 2021.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The University of Illinois Hospital Act is
5amended by adding Section 8d as follows:
 
6    (110 ILCS 330/8d new)
7    Sec. 8d. Facility-provided medication upon discharge.
8    (a) The General Assembly finds that this Section is
9necessary for the immediate preservation of the public peace,
10health, and safety.
11    (b) In this Section, "facility-provided medication" has
12the same meaning as provided under Section 15.10 of the
13Pharmacy Practice Act.
14    (c) When a facility-provided medication is ordered at
15least 24 hours in advance for surgical procedures and is
16administered to a patient at the University of Illinois
17Hospital, any unused portion of the facility-provided
18medication must be offered to the patient upon discharge when
19it is required for continuing treatment.
20    (d) A facility-provided medication shall be labeled
21consistent with labeling requirements under Section 22 of the
22Pharmacy Practice Act.
23    (e) If the facility-provided medication is used in an

6is amended by adding Section 7d as follows:

17administered to a patient at a facility licensed under this
18Act, any unused portion of the facility-provided medication
19must be offered to the patient upon discharge when it is
20required for continuing treatment.
21    (d) A facility-provided medication shall be labeled
22consistent with labeling requirements under Section 22 of the
23Pharmacy Practice Act.

1operating room setting, the prescriber is responsible for
2counseling the patient on its proper use and administration
3and the requirement of pharmacist counseling is waived.
 
4    Section 15. The Hospital Licensing Act is amended by
5adding Section 6.28 as follows:
 
6    (210 ILCS 85/6.28 new)
7    Sec. 6.28. Facility-provided medication upon discharge.
8    (a) The General Assembly finds that this Section is
9necessary for the immediate preservation of the public peace,
10health, and safety.
11    (b) In this Section, "facility-provided medication" has
12the same meaning as provided under Section 15.10 of the
13Pharmacy Practice Act.
14    (c) When a facility-provided medication is ordered at
15least 24 hours in advance for surgical procedures and is
16administered to a patient at a hospital licensed under this
17Act, any unused portion of the facility-provided medication
18must be offered to the patient upon discharge when it is
19required for continuing treatment.
20    (d) A facility-provided medication shall be labeled
21consistent with labeling requirements under Section 22 of the
22Pharmacy Practice Act.
23    (e) If the facility-provided medication is used in an

4    Section 20. The Pharmacy Practice Act is amended by adding
5Section 15.10 as follows:
 
6    (225 ILCS 85/15.10 new)
7    Sec. 15.10. Facility-provided medication upon discharge.
8    (a) The General Assembly finds that this Section is
9necessary for the immediate preservation of the public peace,
10health, and safety.
11    (b) In this Section, "facility-provided medication" means
12any topical antibiotic, anti-inflammatory, dilation, or
13glaucoma drop or ointment.
14    (c) When a facility-provided medication is administered to
15a patient at the facility, any unused portion of the
16facility-provided medication must be offered to the patient
17upon discharge when it is required for continuing treatment.
18    (d) A facility-provided medication shall be labeled
19consistent with labeling requirements under Section 22.
20    (e) If the facility-provided medication is used in an
21operating room or emergency department setting, the prescriber
22is responsible for counseling the patient on its proper use
23and administration and the requirement of pharmacist
24counseling is waived.

1    Section 99. Effective date. This Act takes effect July 1,
22021.
