AMENDMENT TO HOUSE BILL 4228

2    AMENDMENT NO. ______. Amend House Bill 4228 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Decennial Committees on Local Government
5Efficiency Act is amended by changing Sections 5, 10, 20, and
625 as follows:
 
7    (50 ILCS 70/5)
8    Sec. 5. Definitions Definition. As used in this Act: ,
9    "Governing board" means the governing body of a
10governmental unit. If the governmental unit is a road
11district, then "governing board" means the governing body of
12the road district, as provided in Division 1 of Article 6 of
13the Illinois Highway Code, including, but not limited to, the
14highway board of auditors, the highway commissioner of a
15township road district, the township board of trustees, the
16city council, the municipal president and board of trustees,

1or the county board, as applicable.
2    "Governmental unit" means all entities that levy taxes and
3are also units of local government, as defined in Section 1 of
4Article VII of the Illinois Constitution, governmental unit"
5includes all units of local government that may levy any tax,
6except municipalities and counties.

9    Sec. 10. Formation of committee; members; vacancy;
10administrative support.
11    (a) By June 10, 2023 ( Within one year after the effective
12date of this Act) and at least once every 10 years after June
1310, 2023 thereafter, each governmental unit must form a
14committee to study local efficiencies and report
15recommendations regarding efficiencies and increased
16accountability to the county board in which the governmental
17unit is located.
18    (b) Each committee's membership shall include the elected
19or appointed members of the governing board of the
20governmental unit; at least 2 residents within the territory
21served by of the governmental unit, who are appointed by the
22chair of the governing board of the governmental unit, with
23the advice and consent of the governing board; and any chief
24executive officer or other officer of the governmental unit.
25The committee shall be chaired by the president or chief

1elected or appointed official of the governing board of the
2governmental unit, or his or her designee. The chairperson may
3appoint additional members to the committee as the chairperson
4he or she deems appropriate.
5    Committee members shall serve without compensation but may
6be reimbursed by the governmental unit for their expenses
7incurred in performing their duties.
8    (b-5) In lieu of the committee described in subsection
9(a), a highway commissioner of a township road district in a
10county with a population under 400,000 and the township board
11of the same township may form a joint committee for the
12purposes described in subsection (a). That joint committee
13shall include: the township trustees; the highway
14commissioner; at least 2 residents of the territory served by
15the governmental unit appointed by the township supervisor
16with the advice and consent of the township board; at least one
17resident of the governmental unit appointed by the highway
18commissioner; and the township supervisor. The joint committee
19shall be chaired by the township supervisor and shall issue a
20joint report with 2 sections, one section for the township and
21one section for the road district. Except with respect to its
22composition and report, the joint committee shall otherwise
23comply with subsection (b). References in this Act to a
24"committee" shall also include a joint committee formed under
25this subsection.
26    (c) A committee may employ or use the services of

1specialists in public administration and governmental
2management and any other trained consultants, analysts,
3investigators, and assistants it considers appropriate, and it
4may seek assistance from community colleges and universities
5as necessary to prepare the report required under Section 25.
6    (d) If a vacancy occurs in the committee membership, the
7vacancy shall be filled in the same manner as the appointments
8under subsection (b).
9    (e) Each governmental unit shall provide administrative
10and other support to its committee.

13    Sec. 20. Meetings. Each committee shall meet at least 3
14times. The committee may meet during a regularly scheduled
15meeting of the governmental unit as long as: (1) separate
16notice is given in conformance with the Open Meetings Act; (2)
17the committee meeting is listed as part of the governing
18board's board of the governmental unit's agenda; and (3) at
19least a majority of the members of the committee are present at
20the committee's meeting. Each meeting of the committee shall
21be public, and the committee shall provide an opportunity for
22any person to be heard at the public hearings for at least 3
23minutes. The committee may require speakers to register. The
24committee shall meet in accordance with the Open Meetings Act,
25and the committee shall be a public body to which the Freedom

1of Information Act applies.
2    At the conclusion of each meeting, the committee shall
3conduct a survey of residents who attended asking for input on
4the matters discussed at the meeting. A survey conducted via
5email to all residents who attended the meeting and provided a
6valid email address will be sufficient to satisfy the
7requirements of this paragraph.

10    Sec. 25. Report. Each committee shall summarize its work
11and findings within a written report, which shall include
12recommendations in respect to increased accountability and
13efficiency, and shall provide the report to the administrative
14office of each county board in which the governmental unit is
15located no later than 18 months after the formation of the
16committee. The report shall be made available to the public.
17    For purposes of this Section, if a governmental unit is
18located in multiple counties, the committee may, if required,
19provide the same report to the county board of each of those
20counties.

22    Section 10. The State Mandates Act is amended by adding
23Section 8.47 as follows:

1    (30 ILCS 805/8.47 new)
2    Sec. 8.47. Exempt mandate. Notwithstanding Sections 6 and
38 of this Act, no reimbursement by the State is required for
4the implementation of any mandate created by the Decennial
5Committees on Local Government Efficiency Act.
 
6    Section 99. Effective date. This Act takes effect upon
7becoming law.".
