AMENDMENT TO HOUSE BILL 3378

AMENDMENT NO. ______. Amend House Bill 3378 by replacing everything after the enacting clause with the following:

"Section 5. The Animal Welfare Act is amended by adding Section 23 as follows:

(225 ILCS 605/23 new)

Sec. 23. Animal sourcing database; certification board.

(a) In this Section, "Animal Sourcing Certification Board" or "the Board" means the board established by the Department of Agriculture.

(b) The duties of the Animal Sourcing Certification Board shall include all of the following:

(1) To assist the Department in the collection, analysis, and input of the data that is required to be submitted by an animal control facility or an animal shelter to the Department under this Act.

(2) To create an animal sourcing database or management system for the organization and compilation of the information collected by the Board.

(3) To develop a process to issue a certification of compliance to an animal control facility or animal shelter that is in compliance with all reporting requirements. The Board shall establish the certification requirements or standards that an animal control facility or animal shelter must satisfy to receive the certificate of compliance from the Department.

(c) The Board shall collect all of the following information for each cat or dog that occupies a space in an animal control facility or animal shelter:

(1) The species and breed.

(2) The age, sex, and weight.

(3) The location or origin of the cat or dog prior to entering the facility or shelter.

(4) The location of a cat or dog transferred through adoption, the return of the animal to the owner, or to another shelter.

(5) Behavioral information that was provided to the animal control facility or animal shelter or gathered while in the care of the facility or shelter.

(6) The medical history and all medical procedures performed on the cat or dog.

(7) A record of surgical sterilization or lack of surgical sterilization.

(8) If the cat or dog is microchipped and the microchip has been enrolled in a nationally searchable database.

(9) A record of vaccinations and veterinary care and treatment.

(d) The Board shall submit a report of its findings to the Department within one year after the effective date of this amendatory Act of the 102nd General Assembly. The Board shall submit a second report of its findings to the General Assembly for the following year.

(e) The Department shall analyze the information contained in the reports to review licensing issues, to identify issues and trends, and to develop supplemental certification requirements.

(f) The Department shall adopt rules necessary for the implementation of this Section.

Section 99. Effective date. This Act takes effect upon becoming law.".
