AMENDMENT TO HOUSE BILL 1162

2    AMENDMENT NO. ______. Amend House Bill 1162 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Section
527-13.2 as follows:
 
6    (105 ILCS 5/27-13.2)  (from Ch. 122, par. 27-13.2)
7    Sec. 27-13.2. Required instruction. In every public school
8there shall be instruction, study, and discussion of effective
9methods by which pupils may recognize the danger of and avoid
10abduction, and in every public school maintaining any of
11grades kindergarten through 8 there shall be, for such grades,
12instruction, study, and discussion of effective methods for
13the prevention and avoidance of drugs and the dangers of
14opioid drug and substance abuse. School boards may include
15such required instruction, study and discussion in the courses
16of study regularly taught in the public schools of their

1respective districts; provided, however, that such instruction
2shall be given each year to all pupils in grades kindergarten
3through 8. The State Superintendent of Education may prepare
4and make available to all public and non-public schools
5instructional materials which may be used by such schools as
6guidelines for development of a program of instruction under
7this Section; provided, however, that each school board shall
8itself determine the minimum amount of instruction time which
9shall qualify as a program of instruction which will satisfy
10the requirements of this Section.
11    The State Superintendent of Education, in cooperation with
12the Department of Children and Family Services, shall prepare
13and disseminate to all public schools and non-public schools,
14information on instructional materials and programs about
15child sexual abuse which may be used by such schools for their
16own or community programs. Such information may also be
17disseminated by such schools to parents.
18    Notwithstanding the foregoing provisions of this Section,
19no pupil in any of grades kindergarten through 8 shall be
20required to take or participate in any class or course
21providing instruction in recognizing and avoiding sexual abuse
22if the parent or guardian of the pupil submits written
23objection thereto; and refusal to take or participate in such
24class or course after such written objection is made shall not
25be reason for failing, suspending or expelling such pupil.
26Each school board intending to offer any such class or course

1to pupils in any of grades kindergarten through 8 shall give
2not less than 5 days written notice to the parents or guardians
3of such pupils before commencing the class or course.
