1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Revenue Sharing Act is amended by
5changing Section 3 as follows:
 
6    (30 ILCS 115/3)  (from Ch. 85, par. 613)
7    Sec. 3. Use of Fund.
8    (a) The amounts allocated and paid to the municipalities
9and counties of this State pursuant to the provisions of this
10Act shall be used solely for the general welfare of the people
11of the State of Illinois, including financial assistance to
12school districts, any part of which lie within the
13municipality or county, through unrestricted block grants for
14school purposes carried out within the municipality or county
15making the grant, and also including, but not limited to,
16mental health programs, wastewater projects, road and bridge
17construction and repair and social service programs.
18    (b) Beginning on the effective date of this amendatory Act
19of the 102nd General Assembly, the amounts allocated and paid
20to municipalities and counties under this Act may also be used
21for the procurement of black-owned media services as provided
22under subsection (b) of Section 35-45 of the Illinois
23Procurement Code.

2    Section 10. The Illinois Procurement Code is amended by
3adding Section 35-45 as follows:
 
4    (30 ILCS 500/35-45 new)
5    Sec. 35-45. Purchase of black-owned media services.
6    (a) Beginning on the effective date of this amendatory Act
7of the 102nd General Assembly, it shall be the aspirational
8goal of the State that for any State agency subject to the
9provisions of this Code, no less than 10% of the total dollar
10amount used by that State agency for the purchase of media
11services shall be used to procure the services of black-owned
12media.
13    (b) As soon as practicable after the effective date of
14this amendatory Act of the 102nd General Assembly, each
15municipality, county, school district, and community college
16district shall adopt an ordinance or resolution that
17establishes an aspirational goal that no less than 10% of the
18total dollar amount used for the purchase of media services
19shall be used to procure the services of black-owned media.
20Municipalities and counties may use moneys allocated and
21disbursed under Section 2 of the State Revenue Sharing Act for
22the purposes of this subsection (b).
23    (c) If any State agency or public institution of higher
24education contract is eligible to be paid for or reimbursed,

1in whole or in part, with federal-aid funds, grants, or loans,
2and the provisions of this Section would result in the loss of
3those federal-aid funds, grants, or loans, then the contract
4is exempt from the provisions of this Section in order to
5remain eligible for those federal-aid funds, grants, or loans.
6    (d) Each State agency under the jurisdiction of this Code
7shall file with the Commission on Equity and Inclusion an
8annual compliance plan which shall outline the State agency's
9efforts and progress towards the goal of using media services
10funds to procure services of black-owned media for the then
11immediately preceding fiscal year.
12    (e) For the purposes of this Section, "black-owned media"
13means a newspaper or other periodical issued at regular
14intervals whether in print or electronic format, a news
15service whether in print or electronic format, a radio
16station, a television station, a television network, a
17community antenna television service, or any other person,
18business, or corporation that is (i) majority owned by black
19or African American persons, (ii) certified by the Business
20Enterprise Program as a minority-owned business or women-owned
21business, and (iii) engaged in making any written, oral, or
22electronic communication that contains news, promotion, or
23inducement.
 
24    Section 15. The Counties Code is amended by adding Section
255-3004 as follows:

2    Sec. 5-3004. Purchase of black-owned media services. The
3county board of each county shall adopt an ordinance that
4establishes an aspirational goal that no less than 10% of the
5total dollar amount used for the purchase of media services by
6the county shall be used to procure the services of
7black-owned media as provided under subsection (b) of Section
835-45 of the Illinois Procurement Code.
 
9    Section 20. The Illinois Municipal Code is amended by
10adding Section 8-1-19 as follows:
 
11    (65 ILCS 5/8-1-19 new)
12    Sec. 8-1-19. Purchase of black-owned media services. The
13corporate authorities of each municipality shall adopt an
14ordinance that establishes an aspirational goal that no less
15than 10% of the total dollar amount used for the purchase of
16media services by the municipality shall be used to procure
17the services of black-owned media as provided under subsection
18(b) of Section 35-45 of the Illinois Procurement Code.
 
19    Section 25. The School Code is amended by adding Section
2022-94 as follows:

1    Sec. 22-94. Purchase of black-owned media services. The
2school board of each school district shall adopt a resolution
3that establishes an aspirational goal that no less than 10% of
4the total dollar amount used for the purchase of media
5services by the school district shall be used to procure the
6services of black-owned media as provided under subsection (b)
7of Section 35-45 of the Illinois Procurement Code.
 
8    Section 30. The Public Community College Act is amended by
9adding Section 3-29.20 as follows:
 
10    (110 ILCS 805/3-29.20 new)
11    Sec. 3-29.20. Purchase of black-owned media services. The
12board of trustees of each community college district shall
13adopt a resolution that establishes an aspirational goal that
14no less than 10% of the total dollar amount used for the
15purchase of media services by the community college district
16shall be used to procure the services of black-owned media as
17provided under subsection (b) of Section 35-45 of the Illinois
18Procurement Code.
