AMENDMENT TO HOUSE BILL 165

2    AMENDMENT NO. ______. Amend House Bill 165 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The University of Illinois Act is amended by
5adding Section 120 as follows:
 
6    (110 ILCS 305/120 new)
7    Sec. 120. Carbon capture, utilization, and storage report.
8    (a) Subject to appropriation, the Prairie Research
9Institute at the University of Illinois at Urbana-Champaign,
10in consultation with an intergovernmental advisory committee,
11must file a report on the potential for carbon capture,
12utilization, and storage as a climate mitigation technology
13throughout Illinois with the Governor and the General Assembly
14no later than December 31, 2022. The report must provide an
15assessment of Illinois subsurface storage resources, state of
16readiness, and provide recommendations for policy and

1regulatory needs at the State level based on its findings, and
2shall, at a minimum, address all the following areas:
3        (1) carbon capture, utilization, and storage current
4    status and future storage resource potential in the State.
5    Enhanced Oil Recovery shall remain outside the scope of
6    this study;
7        (2) procedures, standards, and safeguards for the
8    storage of carbon dioxide;
9        (3) permitting processes and the coordination with
10    applicable federal law or regulatory commissions,
11    including the Class VI injection well permitting process;
12        (4) economic impact, job creation, and job retention
13    from carbon capture, utilization, and storage that both
14    protects the environment and supports short-term and
15    long-term economic growth;
16        (5) development of knowledge capacity of appropriate
17    State agencies and stakeholders;
18        (6) environmental justice and stakeholder issues
19    related to carbon capture, utilization, and storage
20    throughout the State;
21        (7) leveraging federal policies and public-private
22    partnerships for research, design, and development to
23    benefit the State;
24        (8) liability for the storage and monitoring
25    maintenance of the carbon dioxide after the completion of
26    a carbon capture, utilization, and storage project;

1        (9) acquisition, ownership, and amalgamation of pore
2    space for carbon capture, utilization, and storage;
3        (10) methodologies to establish any necessary fees,
4    costs, or offsets; and
5        (11) any risks to health, safety, the environment, and
6    property uses or values.
7    (b) In developing the report under this Section, the
8Prairie Research Institute shall form an advisory committee,
9which shall be composed of all the following members:
10        (1) the Director of the Environmental Protection
11    Agency, or his or her designee;
12        (2) the Director of Natural Resources, or his or her
13    designee;
14        (3) the Director of Commerce and Economic Opportunity,
15    or his or her designee;
16        (4) the Director of the Illinois Emergency Management
17    Agency, or his or her designee;
18        (5) the Director of Agriculture, or his or her
19    designee;
20        (6) the Attorney General, or his or her designee;
21        (7) one member of the Senate, appointed by the
22    President of the Senate;
23        (8) one member of the House of Representatives,
24    appointed by the Speaker of the House of Representatives;
25        (9) one member of the Senate, appointed by the
26    Minority Leader of the Senate; and

1        (10) one member of the House of Representatives,
2    appointed by the Minority Leader of the House of
3    Representatives.
4    (c) No later than 60 days after the effective date of this
5amendatory Act of the 102nd General Assembly, the advisory
6committee shall hold its first meeting at the call of the
7Executive Director of the Prairie Research Institute, at which
8meeting the members shall select a chairperson from among
9themselves. After its first meeting, the committee shall meet
10at the call of the chairperson. Members of the committee shall
11serve without compensation. The Prairie Research Committee
12shall provide administrative support to the committee.
13    (d) The Prairie Research Institute shall also engage with
14interested stakeholders throughout the State to gain insights
15into socio-economic perspectives from environmental justice
16organizations, environmental non-governmental organizations,
17industry, landowners, farm bureaus, manufacturing, labor
18unions, and others.
19    (e) This Section is repealed on January 1, 2023.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
