SYNOPSIS AS INTRODUCED:
 
New Act
30 ILCS 805/8.45 new

    Creates the Decennial Committees on Local Government Consolidation and Efficiency Act. Provides that within one year after the effective date of the Act and at least once every 10 years thereafter, each unit of local government (except municipalities and counties) must form a committee to: study local efficiencies, including an analysis of whether to consolidate with another governmental unit, municipality, or county; and create a report with recommendations regarding efficiencies, increased accountability, and consolidation. Provides that the duties of the committee include, but are not limited to, the study of the unit of local government's governing statutes, ordinances, rules, procedures, powers, jurisdiction, shared services, intergovernmental agreements, and interrelationships with other units of local government and the State. Provides that the committee shall collect data, research, analysis, and public input. Dissolves the committee after completion of its report and oral presentation of the report. Contains provisions about committee membership, meetings, and report requirements. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Decennial Committees on Local Government Consolidation and
6Efficiency Act.
 
7    Section 5. Definitions. As used in this Act:
8    "Governmental unit" includes all units of local government
9except municipalities and counties.
10    "Community college" means a public community college in
11this State.
12    "State university" means a public university in this
13State.
 
14    Section 10. Formation of committee; members; vacancy;
15administrative support.
16    (a) Within one year after the effective date of this Act
17and at least once every 10 years thereafter, each governmental
18unit must form a committee to: study local efficiencies,
19including an analysis of whether to consolidate with another
20governmental unit, municipality, or county; and provide a
21report with recommendations regarding efficiencies, increased
22accountability, and consolidation.

1    (b) Each committee's membership shall include the elected
2or appointed members of the governing board of the
3governmental unit, at least 2 residents of the governmental
4unit appointed by the county board chairperson or the
5president of the board of county commissioners in the county
6in which the governmental unit lies, any chief executive
7officer or officer of the governmental unit, and at least one
8government studies representative from a community college or
9State university appointed by the county board chairperson or
10the president of the board of county commissioners in the
11county in which the governmental unit lies. The committee
12shall be chaired by the president or chief elected or
13appointed official of the governing board of the governmental
14unit, or his or her designee. The chairperson may appoint
15additional members to the committee as he or she deems
16appropriate.
17    Committee members shall serve without compensation but may
18be reimbursed by the governmental unit for their expenses
19incurred in performing their duties.
20    (c) A committee may employ or use the services of
21specialists in public administration and governmental
22management and any other trained consultants, analysts,
23investigators, and assistants it considers appropriate.
24    (d) If a vacancy occurs in the committee membership, the
25vacancy shall be filled in the same manner as the appointments
26under subsection (b).

1    (e) The governmental unit shall provide administrative and
2other support to the committee.
 
3    Section 15. Duties of a committee. The duties of a
4committee include, but are not limited to, the study of the
5governmental unit's governing statutes, ordinances, rules,
6procedures, powers, jurisdiction, shared services,
7intergovernmental agreements, and interrelationships with
8other governmental units and the State. The committee shall
9collect data, research, and analysis for its purposes and
10shall allow public input through at least one public survey
11sent to at least 10% of residents within the governmental
12unit.
 
13    Section 20. Meetings. Each committee shall meet at least 3
14times. Each meetings of the committee shall be public and the
15committee shall provide an opportunity for any person to be
16heard at the public hearings for at least 3 minutes. The
17committee may require speakers to register. The committee
18shall meet in accordance with the Open Meetings Act and the
19committee shall be a public body to which the Freedom of
20Information Act applies.
 
21    Section 25. Report and oral presentation. Each committee
22shall summarize its work and findings within a report,
23including recommendations in respect to consolidation,

1increased accountability and efficiency, and shall provide
2both an oral presentation and the written report to the county
3board in which the governmental unit lies no later than 6
4months after the formation of the committee. The report shall
5be made available to the public.
 
6    Section 30. Dissolution of the committee. After a
7committee has made the report available to the public and
8presented all oral presentations required under Section 25,
9the committee is dissolved until it is reestablished with
10newly appointed members under Section 10.
 
11    Section 90. The State Mandates Act is amended by adding
12Section 8.45 as follows:
 
13    (30 ILCS 805/8.45 new)
14    Sec. 8.45. Exempt mandate. Notwithstanding Sections 6 and
158 of this Act, no reimbursement by the State is required for
16the implementation of any mandate created by this amendatory
17Act of the 102nd General Assembly.
 
18    Section 99. Effective date. This Act takes effect upon
19becoming law.
