2    AMENDMENT NO. ______. Amend House Bill 116 by replacing
3everything after the enacting clause with the following:
4    "Section 5. The Rent Control Preemption Act is amended by
5changing Sections 5 and 10 as follows:
6    (50 ILCS 825/5)
7    Sec. 5. Rent control prohibited; exceptions.
8    (a) Except as provided in this Section, a A unit of local
9government, as defined in Section 1 of Article VII of the
10Illinois Constitution, shall not enact, maintain, or enforce
11an ordinance or resolution that would have the effect of
12controlling the amount of rent charged for leasing private
13residential or commercial property.
14    (b) This Act does not impair the right of a unit of local
15government to manage and control residential property in which
16the unit of local government has a property interest.

1    (c) If a unit of local government chooses to adopt,
2maintain, or enforce an ordinance or resolution that would
3have the effect of controlling the amount of rent charged for
4leasing private residential or commercial property, it shall
5take measures to address the economic impact of such an
6ordinance or resolution upon owner-occupied residential
7properties of 8 or fewer units.

10    Sec. 10. Home rule preemption.
11    Except as provided in Section 5, a A home rule unit may not
12regulate or control the amount of rent charged for leasing
13private residential or commercial property. This Section is a
14denial and limitation of home rule powers and functions under
15subsection (g) of Section 6 of Article VII of the Illinois
