SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/10-20.73 new
105 ILCS 5/34-18.67 new

    Amends the School Code. With respect to school districts with more than 275,000 inhabitants, requires a school to provide written notification to (i) the parent or guardian of any student who commits an act or acts of misconduct and (ii) the parent or guardian of any student who is the victim of that act of misconduct and requires a copy of any statement made by the student who committed the act of misconduct to be provided to the student's or guardian within 24 hours after the statement has been made. Sets forth the information that must be included in the disciplinary report. Requires that a copy of the disciplinary report be provided to the parent or guardian of the disciplined student. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Sections
510-20.73 and 34-18.67 as follows:
 
6    (105 ILCS 5/10-20.73 new)
7    Sec. 10-20.73. Parental notification of student
8discipline.
9    (a) This Section applies only to school districts with
10more than 275,000 inhabitants.
11    (b) If a student commits an act or acts of misconduct, the
12student's school must provide written notification of that
13misconduct to the parent or guardian of the student. A copy of
14any statement made by the student relating to the act or acts
15of misconduct must be provided by the school to the parent or
16guardian within 24 hours after the statement has been made.
17The school must also provide written notification of the
18misconduct to the parent or guardian of any student who is the
19victim of the act of misconduct.
20    (c) A copy of any disciplinary report resulting from an
21investigation into the student's act or acts of misconduct
22must be provided by the school to the parent or guardian within
2348 hours after the completion of the report. The disciplinary

1report must include the following:
2        (1) A description of the student's act or acts of
3    misconduct that resulted in disciplinary action, including
4    whether any other student or students were involved in the
5    misconduct. The names and identifying information of any
6    other student or students involved must be redacted from
7    the report.
8        (2) A description of the disciplinary action, if any,
9    imposed on each student involved in the misconduct,
10    including the duration of the disciplinary action.
11        (3) The school's justification and rationale for the
12    disciplinary action imposed on each student involved,
13    including reference to the applicable student discipline
14    policies, procedures, or guidelines.

16    Sec. 34-18.67. Parental notification of student
17discipline.
18    (a) If a student commits an act or acts of misconduct, the
19student's school must provide written notification of that
20misconduct to the parent or guardian of the student. A copy of
21any statement made by the student relating to the act or acts
22of misconduct must be provided by the school to the parent or
23guardian within 24 hours after the statement has been made.
24The school must also provide written notification of the

2    (b) A copy of any disciplinary report resulting from an

548 hours after the completion of the report. The disciplinary
6report must include the following:
7        (1) A description of the student's act or acts of
8    misconduct that resulted in disciplinary action, including
9    whether any other student or students were involved in the
10    misconduct. The names and identifying information of any

12    the report.
13        (2) A description of the disciplinary action, if any,
14    imposed on each student involved in the misconduct,
15    including the duration of the disciplinary action.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.
