AMENDMENT TO SENATE BILL 2038

2    AMENDMENT NO. ______. Amend Senate Bill 2038 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Sections 2-112 and 6-109 and by adding Section
611-907.1 as follows:
 
7    (625 ILCS 5/2-112)  (from Ch. 95 1/2, par. 2-112)
8    Sec. 2-112. Distribution of synopsis laws.
9    (a) The Secretary of State may publish a synopsis or
10summary of the laws of this State regulating the operation of
11vehicles and may deliver a copy thereof without charge with
12each original vehicle registration and with each original
13driver's license.
14    (b) The Secretary of State shall make any necessary
15revisions in its publications including, but not limited to,
16the Illinois Rules of the Road, to accurately conform its

1publications to the provisions of the Pedestrians with
2Disabilities Safety Act.
3    (c) The Secretary of State shall include, in the Illinois
4Rules of the Road publication, information advising drivers to
5use the Dutch Reach method when opening a vehicle door after
6parallel parking on a street (checking the rear-view mirror,
7checking the side-view mirror, then opening the door with the
8right hand, thereby reducing the risk of injuring a bicyclist
9or opening the door in the path a vehicle approaching from
10behind).
11    (d) The Secretary of State shall include, in the Illinois
12Rules of the Road publication, information advising drivers to
13use the zipper merge method when merging into a reduced number
14of lanes (drivers in merging lanes are expected to use both
15lanes to advance to the lane reduction point and merge at that
16location, alternating turns).

19    Sec. 6-109. Examination of Applicants.
20    (a) The Secretary of State shall examine every applicant
21for a driver's license or permit who has not been previously
22licensed as a driver under the laws of this State or any other
23state or country, or any applicant for renewal of such driver's
24license or permit when such license or permit has been expired
25for more than one year. The Secretary of State shall, subject

1to the provisions of paragraph (c), examine every licensed
2driver at least every 8 years, and may examine or re-examine
3any other applicant or licensed driver, provided that during
4the years 1984 through 1991 those drivers issued a license for
53 years may be re-examined not less than every 7 years or more
6than every 10 years.
7    The Secretary of State shall require the testing of the
8eyesight of any driver's license or permit applicant who has
9not been previously licensed as a driver under the laws of this
10State and shall promulgate rules and regulations to provide for
11the orderly administration of all the provisions of this
12Section.
13    The Secretary of State shall include at least one test
14question that concerns the provisions of the Pedestrians with
15Disabilities Safety Act in the question pool used for the
16written portion of the driver's drivers license examination
17within one year after July 22, 2010 (the effective date of
18Public Act 96-1167).
19    The Secretary of State shall include, in the question pool
20used for the written portion of the driver's license
21examination, test questions concerning safe driving in the
22presence of bicycles, of which one may be concerning the Dutch
23Reach method as described in Section 2-112.
24    The Secretary of State shall include, in the question pool
25used for the written portion of the driver's license
26examination, at least one test question concerning driver

1responsibilities when approaching a stationary emergency
2vehicle as described in Section 11-907.
3    (b) Except as provided for those applicants in paragraph
4(c), such examination shall include a test of the applicant's
5eyesight, his or her ability to read and understand official
6traffic control devices, his or her knowledge of safe driving
7practices and the traffic laws of this State, and may include
8an actual demonstration of the applicant's ability to exercise
9ordinary and reasonable control of the operation of a motor
10vehicle, and such further physical and mental examination as
11the Secretary of State finds necessary to determine the
12applicant's fitness to operate a motor vehicle safely on the
13highways, except the examination of an applicant 75 years of
14age or older shall include an actual demonstration of the
15applicant's ability to exercise ordinary and reasonable
16control of the operation of a motor vehicle. All portions of
17written and verbal examinations under this Section, excepting
18where the English language appears on facsimiles of road signs,
19may be given in the Spanish language and, at the discretion of
20the Secretary of State, in any other language as well as in
21English upon request of the examinee. Deaf persons who are
22otherwise qualified are not prohibited from being issued a
23license, other than a commercial driver's license, under this
24Code.
25    (c) Re-examination for those applicants who at the time of
26renewing their driver's license possess a driving record devoid

1of any convictions of traffic violations or evidence of
2committing an offense for which mandatory revocation would be
3required upon conviction pursuant to Section 6-205 at the time
4of renewal shall be in a manner prescribed by the Secretary in
5order to determine an applicant's ability to safely operate a
6motor vehicle, except that every applicant for the renewal of a
7driver's license who is 75 years of age or older must prove, by
8an actual demonstration, the applicant's ability to exercise
9reasonable care in the safe operation of a motor vehicle.
10    (d) In the event the applicant is not ineligible under the
11provisions of Section 6-103 to receive a driver's license, the
12Secretary of State shall make provision for giving an
13examination, either in the county where the applicant resides
14or at a place adjacent thereto reasonably convenient to the
15applicant, within not more than 30 days from the date said
16application is received.
17    (e) The Secretary of State may adopt rules regarding the
18use of foreign language interpreters during the application and
19examination process.

23    Sec. 11-907.1. Move Over Task Force.
24    (a) The Move Over Task Force is created to study the issue
25of violations of Sections 11-907, 11-907.5, and 11-908 with

1particular attention to the causes of violations and ways to
2protect law enforcement and emergency responders.
3    (b) The membership of the Task Force shall consist of the
4following members:
5        (1) the Director of State Police or his or her
6    designee, who shall serve as chair;
7        (2) the Governor or his or her designee;
8        (3) the Secretary of State or his or her designee;
9        (4) the Secretary of Transportation or his or her
10    designee;
11        (5) the Director of the Illinois Toll Highway Authority
12    or his or her designee;
13        (6) the President of the Illinois State's Attorneys
14    Association or his or her designee;
15        (7) the President of the Illinois Association of Chiefs
16    of Police or his or her designee;
17        (8) the President of the Illinois Sheriffs'
18    Association or his or her designee;
19        (9) the President of the Illinois Fraternal Order of
20    Police or his or her designee;
21        (10) the President of the Associated Fire Fighters of
22    Illinois or his or her designee;
23        (11) one member appointed by the Speaker of the House
24    of Representatives;
25        (12) one member appointed by the Minority Leader of the
26    House of Representatives;

1        (13) one member appointed by the President of the
2    Senate;
3        (14) one member appointed by the Minority Leader of the
4    Senate; and
5        (15) the following persons appointed by the Governor:
6            (A) 2 representatives of different statewide
7        trucking associations;
8            (B) one representative of a Chicago area motor
9        club;
10            (C) one representative of a Chicago area transit
11        safety alliance;
12            (D) one representative of a statewide press
13        association;
14            (E) one representative of a statewide broadcast
15        association;
16            (F) one representative of a statewide towing
17        organization;
18            (G) the chief of police of a municipality with a
19        population under 25,000;
20            (H) one representative of a statewide organization
21        representing chiefs of police; and
22            (I) one representative of the solid waste
23        management industry.
24    (c) The members of the Task Force shall serve without
25compensation.
26    (d) The Task Force shall meet no fewer than 3 times and

1shall present its report and recommendations, including
2legislative recommendations, if any, on how to better enforce
3Scott's Law and prevent fatalities on Illinois roadways to the
4General Assembly no later than January 1, 2020.
5    (e) The Department of State Police shall provide
6administrative support to the Task Force as needed.
7    (f) This Section is repealed on January 1, 2021.".
