1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5adding Section 21.7 as follows:
 
6    (415 ILCS 5/21.7 new)
7    Sec. 21.7. Landfills.
8    (a) The purpose of this Section is to enact legislative
9recommendations provided by the Mahomet Aquifer Task Force,
10established under Public Act 100-403. The Task Force identified
11capped but unregulated or underregulated landfills that
12overlie the Mahomet Aquifer as potentially hazardous to
13valuable groundwater resources. These unregulated or
14underregulated landfills generally began accepting waste for
15disposal sometime prior to 1973.
16    (b) The Agency shall prioritize unregulated or
17underregulated landfills that overlie the Mahomet Aquifer for
18inspection. The following factors shall be considered:
19        (1) the presence of, and depth to, any aquifer with
20    potential potable use;
21        (2) whether the landfill has an engineered liner
22    system;
23        (3) whether the landfill has an active groundwater

1    monitoring system;
2        (4) whether waste disposal occurred within the
3    100-year floodplain; and
4        (5) landfills within the setback zone of any potable
5    water supply well.
6    (c) Subject to appropriation, the Agency shall use existing
7information available from State and federal agencies, such as
8the Prairie Research Institute, the Department of Natural
9Resources, the Illinois Emergency Management Agency, the
10Federal Emergency Management Agency, and the Natural Resources
11Conservation Service, to identify unknown, unregulated, or
12underregulated waste disposal sites that overlie the Mahomet
13Aquifer that may pose a threat to surface water or groundwater
14resources.
15    (d) Subject to appropriation, for those landfills
16prioritized for response action following inspection and
17investigation, the Agency shall use its own data, along with
18data from municipalities, counties, solid waste management
19associations, companies, corporations, and individuals, to
20archive information about the landfills, including their
21ownership, operational details, and waste disposal history.
 
22    Section 10. The Illinois Groundwater Protection Act is
23amended by adding Section 10 as follows:

1    Sec. 10. Pekin Metro Landfill; pilot projects.
2    (a) Subject to appropriation, the Agency shall design and
3implement up to 2 pilot studies of landfills that overlie the
4Mahomet Aquifer to identify threats to surface and groundwater
5resources that are posed by the landfills. One of the pilot
6projects shall be conducted at the Pekin Metro Landfill in
7Tazewell County. In conducting the pilot projects, the Agency
8shall:
9        (1) inspect and identify potential and current
10    contamination threats to the water quality of aquifers in
11    the same watershed as the landfill (for the Pekin Metro
12    Landfill, the Mahomet Aquifer);
13        (2) use geographic information systems and remote
14    sensing technology to track defects, structures,
15    appliances, and wells for routine inspection and
16    sustainable management;
17        (3) install or repair groundwater monitoring
18    mechanisms necessary to identify whether contaminants from
19    the landfill are affecting water quality in the Mahomet
20    Aquifer; and
21        (4) identify and provide cost estimates for any
22    additional response actions necessary or appropriate to
23    reduce or minimize potential threats to human health and
24    the environment resulting from current landfill
25    conditions.
26    (b) Following the completion of the pilot project response

1actions, the Agency shall:
2        (1) evaluate, in consultation with the Prairie
3    Research Institute, the use of aerial photography and other
4    remote sensing technologies, such as Light Detection and
5    Ranging (LiDAR), to identify land erosion, landslides,
6    barren areas, leachate seeps, vegetation, and other
7    relevant surface and subsurface features of landfills to
8    aid in the inspection and investigation of landfills; and
9        (2) identify additional procedures, requirements, or
10    authorities that may be appropriate or necessary to address
11    threats to human health and the environment from other
12    unregulated or underregulated landfills throughout the
13    State.
