1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Sections
510-22.39 and 34-18.7 as follows:
 
6    (105 ILCS 5/10-22.39)
7    Sec. 10-22.39. In-service training programs.
8    (a) To conduct in-service training programs for teachers.
9    (b) In addition to other topics at in-service training
10programs, at least once every 2 years, licensed school
11personnel and administrators who work with pupils in
12kindergarten through grade 12 shall be trained to identify the
13warning signs of mental illness and suicidal behavior in youth
14and shall be taught appropriate intervention and referral
15techniques. A school district may utilize the Illinois Mental
16Health First Aid training program, established under the
17Illinois Mental Health First Aid Training Act and administered
18by certified instructors trained by a national association
19recognized as an authority in behavioral health, to provide the
20training and meet the requirements under this subsection. If
21licensed school personnel or an administrator obtains mental
22health first aid training outside of an in-service training
23program, he or she may present a certificate of successful

1completion of the training to the school district to satisfy
2the requirements of this subsection.
3    (c) School guidance counselors, nurses, teachers and other
4school personnel who work with pupils may be trained to have a
5basic knowledge of matters relating to acquired
6immunodeficiency syndrome (AIDS), including the nature of the
7disease, its causes and effects, the means of detecting it and
8preventing its transmission, and the availability of
9appropriate sources of counseling and referral, and any other
10information that may be appropriate considering the age and
11grade level of such pupils. The School Board shall supervise
12such training. The State Board of Education and the Department
13of Public Health shall jointly develop standards for such
14training.
15    (d) In this subsection (d):
16    "Domestic violence" means abuse by a family or household
17member, as "abuse" and "family or household members" are
18defined in Section 103 of the Illinois Domestic Violence Act of
191986.
20    "Sexual violence" means sexual assault, abuse, or stalking
21of an adult or minor child proscribed in the Criminal Code of
221961 or the Criminal Code of 2012 in Sections 11-1.20, 11-1.30,
2311-1.40, 11-1.50, 11-1.60, 12-7.3, 12-7.4, 12-7.5, 12-12,
2412-13, 12-14, 12-14.1, 12-15, and 12-16, including sexual
25violence committed by perpetrators who are strangers to the
26victim and sexual violence committed by perpetrators who are

1known or related by blood or marriage to the victim.
2    At least once every 2 years, an in-service training program
3for school personnel who work with pupils, including, but not
4limited to, school and school district administrators,
5teachers, school guidance counselors, school social workers,
6school counselors, school psychologists, and school nurses,
7must be conducted by persons with expertise in domestic and
8sexual violence and the needs of expectant and parenting youth
9and shall include training concerning (i) communicating with
10and listening to youth victims of domestic or sexual violence
11and expectant and parenting youth, (ii) connecting youth
12victims of domestic or sexual violence and expectant and
13parenting youth to appropriate in-school services and other
14agencies, programs, and services as needed, and (iii)
15implementing the school district's policies, procedures, and
16protocols with regard to such youth, including
17confidentiality. At a minimum, school personnel must be trained
18to understand, provide information and referrals, and address
19issues pertaining to youth who are parents, expectant parents,
20or victims of domestic or sexual violence.
21    (e) At least every 2 years, an in-service training program
22for school personnel who work with pupils must be conducted by
23persons with expertise in anaphylactic reactions and
24management.
25    (f) At least once every 2 years, a school board shall
26conduct in-service training on educator ethics,

1teacher-student conduct, and school employee-student conduct
2for all personnel.

5    Sec. 34-18.7. Youth mental illness and suicide detection
6and intervention. At least once every 2 years, licensed school
7personnel and administrators who work with pupils in
8kindergarten through grade 12 shall be trained to identify the
9warning signs of mental illness and suicidal behavior in youth
10and shall be taught various intervention techniques. The school
11district may utilize the Illinois Mental Health First Aid
12training program, established under the Illinois Mental Health
13First Aid Training Act and administered by certified
14instructors trained by a national association recognized as an
15authority in behavioral health, to provide the training and
16meet the requirements under this Section. If licensed school
17personnel or an administrator obtains mental health first aid
18training outside of an in-service training program, he or she
19may present a certificate of successful completion of the
20training to the school district to satisfy the requirements of
21this Section. The Such training shall be provided within the
22framework of existing in-service training programs offered by
23the Board or as part of the professional development activities
24required under Section 21-14 of this Code.
