SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/6-30005 new
65 ILCS 5/8-1-2.3 new

    Amends the Counties Code and Illinois Municipal Code. Provides that a county or municipality may not use payments received from the Local Government Distributive Fund for payments for travel, lodging, or dining. Limits home rule powers. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by adding Section
56-30005 as follows:
 
6    (55 ILCS 5/6-30005 new)
7    Sec. 6-30005. Expenses for travel, lodging, or dining. A
8county may not use payments received from the Local Government
9Distributive Fund for payments for travel, lodging, or dining.
10A home rule county may not use payments received from the Local
11Government Distributive Fund in a manner inconsistent with this
12Section. This Section is a limitation under subsection (i) of
13Section 6 of Article VII of the Illinois Constitution on the
14concurrent exercise by home rule units of powers and functions
15exercised by the State.
 
16    Section 10. The Illinois Municipal Code is amended by
17adding Section 8-1-2.3 as follows:
 
18    (65 ILCS 5/8-1-2.3 new)
19    Sec. 8-1-2.3. Expenses for travel, lodging, or dining. A
20municipality may not use payments received from the Local
21Government Distributive Fund for payments for travel, lodging,

1or dining. A home rule municipality may not use payments
2received from the Local Government Distributive Fund in a
3manner inconsistent with this Section. This Section is a
4limitation under subsection (i) of Section 6 of Article VII of
5the Illinois Constitution on the concurrent exercise by home
6rule units of powers and functions exercised by the State.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.
