AMENDMENT TO HOUSE BILL 423

2    AMENDMENT NO. ______. Amend House Bill 423 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Sections
52-3.11d, 14-9.01, 21B-15, 21B-20, 21B-30, 21B-35, 21B-50, and
621B-55 as follows:
 
7    (105 ILCS 5/2-3.11d)
8    Sec. 2-3.11d. Teacher preparation institution listing.
9Data on tests required for teacher preparation and
10certification. Beginning with the effective date of this
11amendatory Act of the 94th General Assembly, to collect and
12maintain all of the following data for each institution of
13higher education engaged in teacher preparation in this State:
14        (1) The number of individuals taking the test of basic
15    skills under Section 21-1a of this Code.
16        (2) The number of individuals passing the test of basic

1    skills under Section 21-1a of this Code.
2        (3) The total number of subject-matter tests attempted
3    under Section 21-1a of this Code.
4        (4) The total number of subject-matter tests passed
5    under Section 21-1a of this Code.
6The data regarding subject-matter tests shall be reported in
7sum, rather than by separately listing each subject, in order
8to better protect the identity of the test-takers.
9    On or before August 1, 2007, the State Board of Education
10shall file with the General Assembly and the Governor and shall
11make available to the public a report listing the institutions
12of higher education engaged in teacher preparation in this
13State, along with the data listed in items (1) and (2) of this
14Section pertinent to each institution.
15    On or before October 1, 2012 and every 3 years thereafter,
16the State Board of Education shall file with the General
17Assembly and the Governor and shall make available to the
18public a report listing the institutions of higher education
19engaged in teacher preparation in this State, along with the
20data listed in items (1) through (4) of this Section pertinent
21to each institution.

24    Sec. 14-9.01. Qualifications of teachers, other
25professional personnel and necessary workers. No person shall

1be employed to teach any class or program authorized by this
2Article who does not hold a valid teacher's license as provided
3by law and unless he has had such special training as the State
4Board of Education may require. No special license or
5endorsement to a special license issued under Article 21B
6Section 21B-30 of this Code shall be valid for teaching
7students with visual disabilities unless the person to whom the
8license or endorsement is issued has attained satisfactory
9performance on an examination that is designed to assess
10competency in Braille reading and writing skills according to
11standards that the State Board of Education may adopt. Evidence
12of successfully completing the examination of Braille reading
13and writing skills must be submitted to the State Board of
14Education prior to an applicant's taking of the content area
15test required under Section 21B-30 of this Code. In addition to
16other requirements, a candidate for a teaching license in the
17area of the deaf and hard of hearing granted by the Illinois
18State Board of Education for teaching deaf and hard of hearing
19students in grades pre-school through grade 12 must demonstrate
20a minimum proficiency in sign language as determined by the
21Illinois State Board of Education. All other professional
22personnel employed in any class, service, or program authorized
23by this Article shall hold such licenses and shall have had
24such special training as the State Board of Education may
25require; provided that in a school district organized under
26Article 34, the school district may employ speech and language

1pathologists who are licensed under the Illinois
2Speech-Language Pathology and Audiology Practice Act but who do
3not hold a license issued under this Code if the district
4certifies that a chronic shortage of certified personnel
5exists. Nothing contained in this Act prohibits the school
6board from employing necessary workers to assist the teacher
7with the special educational facilities, except that all such
8necessary workers must have had such training as the State
9Board of Education may require.
10    No later than January 1, 1993, the State Board of Education
11shall develop, in consultation with the Advisory Council on the
12Education of Children with Disabilities and the Advisory
13Council on Bilingual Education, rules governing the
14qualifications for certification of teachers and school
15service personnel providing services to English learners
16receiving special education and related services.
17    The employment of any teacher in a special education
18program provided for in Sections 14-1.01 to 14-14.01,
19inclusive, shall be subject to the provisions of Sections 24-11
20to 24-16, inclusive. Any teacher employed in a special
21education program, prior to the effective date of this
22amendatory Act of 1987, in which 2 or more districts
23participate shall enter upon contractual continued service in
24each of the participating districts subject to the provisions
25of Sections 24-11 to 24-16, inclusive.

1    (105 ILCS 5/21B-15)
2    Sec. 21B-15. Qualifications of educators.
3    (a) No one may be licensed to teach or supervise or be
4otherwise employed in the public schools of this State who is
5not of good character and at least 19 years of age.
6    In determining good character under this Section, the State
7Superintendent of Education shall take into consideration the
8disciplinary actions of other states or national entities
9against certificates or licenses issued by those states and
10held by individuals from those states. In addition, any felony
11conviction of the applicant may be taken into consideration;
12however, no one may be licensed to teach or supervise in the
13public schools of this State who has been convicted of (i) an
14offense set forth in subsection (b) of Section 21B-80 of this
15Code until 7 years following the end of the sentence for the
16criminal offense or (ii) an offense set forth in subsection (c)
17of Section 21B-80 of this Code. Unless the conviction is for an
18offense set forth in Section 21B-80 of this Code, an applicant
19must be permitted to submit character references or other
20written material before such a conviction or other information
21regarding the applicant's character may be used by the State
22Superintendent of Education as a basis for denying the
23application.
24    (b) No person otherwise qualified shall be denied the right
25to be licensed or to receive training for the purpose of

1becoming an educator because of a physical disability,
2including, but not limited to, visual and hearing disabilities;
3nor shall any school district refuse to employ a teacher on
4such grounds, provided that the person is able to carry out the
5duties of the position for which he or she applies.
6    (c) No person may be granted or continue to hold an
7educator license who has knowingly altered or misrepresented
8his or her qualifications, in this State or any other state, in
9order to acquire or renew the license. Any other license issued
10under this Article held by the person may be suspended or
11revoked by the State Educator Preparation and Licensure Board,
12depending upon the severity of the alteration or
13misrepresentation.
14    (d) No one may teach or supervise in the public schools nor
15receive for teaching or supervising any part of any public
16school fund who does not hold an educator license granted by
17the State Superintendent of Education as provided in this
18Article. However, the provisions of this Article do not apply
19to a member of the armed forces who is employed as a teacher of
20subjects in the Reserve Officers' Training Corps of any school,
21nor to an individual teaching a dual credit course as provided
22for in the Dual Credit Quality Act.
23    (e) Notwithstanding any other provision of this Code, the
24school board of a school district may grant to a teacher of the
25district a leave of absence with full pay for a period of not
26more than one year to permit the teacher to teach in a foreign

1state under the provisions of the Exchange Teacher Program
2established under Public Law 584, 79th Congress, and Public Law
3402, 80th Congress, as amended. The school board granting the
4leave of absence may employ, with or without pay, a national of
5the foreign state wherein the teacher on the leave of absence
6is to teach if the national is qualified to teach in that
7foreign state and if that national is to teach in a grade level
8similar to the one that was taught in the foreign state. The
9State Board of Education, in consultation with the State
10Educator Preparation and Licensure Board, may adopt rules as
11may be necessary to implement this subsection (e).
12    (f) No person shall be denied a license issued under this
13Article solely based on his or her citizenship status or
14immigration status. The General Assembly finds and declares
15that this subsection (f) is a State law within the meaning of
16subsection (d) of Section 1621 of Title 8 of the United States
17Code. Nothing in this subsection shall affect the requirements
18to obtain a license that are not directly related to
19citizenship status or immigration status. Nothing in this
20subsection shall be construed to grant eligibility for
21obtaining any public benefit other than a license issued under
22this Article.
23    (g) A candidate enrolled in a teacher preparation program
24must receive a letter grade of at least a "C", or its
25equivalent, in his or her student teaching program to obtain an
26educator license under this Article.

3    (105 ILCS 5/21B-20)
4    Sec. 21B-20. Types of licenses. The State Board of
5Education shall implement a system of educator licensure,
6whereby individuals employed in school districts who are
7required to be licensed must have one of the following
8licenses: (i) a professional educator license; (ii) an educator
9license with stipulations; (iii) a substitute teaching
10license; or (iv) until June 30, 2023, a short-term substitute
11teaching license. References in law regarding individuals
12certified or certificated or required to be certified or
13certificated under Article 21 of this Code shall also include
14individuals licensed or required to be licensed under this
15Article. The first year of all licenses ends on June 30
16following one full year of the license being issued.
17    The State Board of Education, in consultation with the
18State Educator Preparation and Licensure Board, may adopt such
19rules as may be necessary to govern the requirements for
20licenses and endorsements under this Section.
21        (1) Professional Educator License. Persons who (i)
22    have successfully completed an approved educator
23    preparation program and are recommended for licensure by
24    the Illinois institution offering the educator preparation
25    program, (ii) have successfully completed the required

1    testing under Section 21B-30 of this Code, (iii) have
2    successfully completed coursework on the psychology of,
3    the identification of, and the methods of instruction for
4    the exceptional child, including without limitation
5    children with learning disabilities, (iv) have
6    successfully completed coursework in methods of reading
7    and reading in the content area, and (v) have met all other
8    criteria established by rule of the State Board of
9    Education shall be issued a Professional Educator License.
10    All Professional Educator Licenses are valid until June 30
11    immediately following 5 years of the license being issued.
12    The Professional Educator License shall be endorsed with
13    specific areas and grade levels in which the individual is
14    eligible to practice.
15        Individuals can receive subsequent endorsements on the
16    Professional Educator License. Subsequent endorsements
17    shall require a minimum of 24 semester hours of coursework
18    in the endorsement area and passage of the applicable
19    content area test, unless otherwise specified by rule.
20        (2) Educator License with Stipulations. An Educator
21    License with Stipulations shall be issued an endorsement
22    that limits the license holder to one particular position
23    or does not require completion of an approved educator
24    program or both.
25        An individual with an Educator License with
26    Stipulations must not be employed by a school district or

1    any other entity to replace any presently employed teacher
2    who otherwise would not be replaced for any reason.
3        An Educator License with Stipulations may be issued
4    with the following endorsements:
5            (A) (Blank). A A provisional educator endorsement
6        for a service member or a spouse of a service member is
7        valid until June 30 immediately following 3 years of
8        the license being issued, provided that any remaining
9        testing and coursework deficiencies are met under this
10        Section. In this Section, "spouse of a service member"
11        means any person who, at the time of application under
12        this Section, is the spouse of an active duty member of
13        the United States Armed Forces or any reserve component
14        of the United States Armed Forces or the National Guard
15        of any state, commonwealth, or territory of the United
16        States or the District of Columbia.
17            Except as otherwise provided under this
18        subparagraph, a
19            (B) Alternative provisional educator. An
20        alternative provisional educator endorsement on an
21        Educator License with Stipulations may be issued to an
22        applicant who, at the time of applying for the
23        endorsement, has done all of the following:
24                (i) Graduated from a regionally accredited
25            college or university with a minimum of a
26            bachelor's degree.

1                (ii) Successfully completed the first phase of
2            the Alternative Educator Licensure Program for
3            Teachers, as described in Section 21B-50 of this
4            Code.
5                (iii) (Blank). Passed a test of basic skills
6            and content area test, as required under Section
7            21B-30 of this Code.
8        The alternative provisional educator endorsement is
9    valid for 2 years of teaching and may be renewed for a
10    third year by an individual meeting the requirements set
11    forth in Section 21B-50 of this Code.
12            (C) Alternative provisional superintendent. An
13        alternative provisional superintendent endorsement on
14        an Educator License with Stipulations entitles the
15        holder to serve only as a superintendent or assistant
16        superintendent in a school district's central office.
17        This endorsement may only be issued to an applicant
18        who, at the time of applying for the endorsement, has
19        done all of the following:
20                (i) Graduated from a regionally accredited
21            college or university with a minimum of a master's
22            degree in a management field other than education.
23                (ii) Been employed for a period of at least 5
24            years in a management level position in a field
25            other than education.
26                (iii) Successfully completed the first phase

1            of an alternative route to superintendent
2            endorsement program, as provided in Section 21B-55
3            of this Code.
4                (iv) (Blank). Passed a test of basic skills and
5            content area tests required under Section 21B-30
6            of this Code.
7            The endorsement is valid for 2 fiscal years in
8        order to complete one full year of serving as a
9        superintendent or assistant superintendent.
10            (D) (Blank).
11            (E) Career and technical educator. A career and
12        technical educator endorsement on an Educator License
13        with Stipulations may be issued to an applicant who has
14        a minimum of 60 semester hours of coursework from a
15        regionally accredited institution of higher education
16        or an accredited trade and technical institution and
17        has a minimum of 2,000 hours of experience outside of
18        education in each area to be taught.
19            The career and technical educator endorsement on
20        an Educator License with Stipulations is valid until
21        June 30 immediately following 5 years of the
22        endorsement being issued and may be renewed. For
23        individuals who were issued the career and technical
24        educator endorsement on an Educator License with
25        Stipulations on or after January 1, 2015, the license
26        may be renewed if the individual passes a test of basic

1        skills or test of work proficiency, as required under
2        Section 21B-30 of this Code.
3            An individual who holds a valid career and
4        technical educator endorsement on an Educator License
5        with Stipulations but does not hold a bachelor's degree
6        may substitute teach in career and technical education
7        classrooms.
8            (F) Part-time provisional career and technical
9        educator or provisional career and technical educator.
10        A part-time provisional career and technical educator
11        endorsement or a provisional career and technical
12        educator endorsement on an Educator License with
13        Stipulations may be issued to an applicant who has a
14        minimum of 8,000 hours of work experience in the skill
15        for which the applicant is seeking the endorsement. It
16        is the responsibility of each employing school board
17        and regional office of education to provide
18        verification, in writing, to the State Superintendent
19        of Education at the time the application is submitted
20        that no qualified teacher holding a Professional
21        Educator License or an Educator License with
22        Stipulations with a career and technical educator
23        endorsement is available and that actual circumstances
24        require such issuance.
25            The provisional career and technical educator
26        endorsement on an Educator License with Stipulations

1        is valid until June 30 immediately following 5 years of
2        the endorsement being issued and may be renewed for 5
3        years. For individuals who were issued the provisional
4        career and technical educator endorsement on an
5        Educator License with Stipulations on or after January
6        1, 2015, the license may be renewed if the individual
7        passes a test of basic skills or test of work
8        proficiency, as required under Section 21B-30 of this
9        Code.
10            A part-time provisional career and technical
11        educator endorsement on an Educator License with
12        Stipulations may be issued for teaching no more than 2
13        courses of study for grades 6 through 12. The part-time
14        provisional career and technical educator endorsement
15        on an Educator License with Stipulations is valid until
16        June 30 immediately following 5 years of the
17        endorsement being issued and may be renewed for 5 years
18        if the individual makes application for renewal.
19            An individual who holds a provisional or part-time
20        provisional career and technical educator endorsement
21        on an Educator License with Stipulations but does not
22        hold a bachelor's degree may substitute teach in career
23        and technical education classrooms.
24            (G) Transitional bilingual educator. A
25        transitional bilingual educator endorsement on an
26        Educator License with Stipulations may be issued for

1        the purpose of providing instruction in accordance
2        with Article 14C of this Code to an applicant who
3        provides satisfactory evidence that he or she meets all
4        of the following requirements:
5                (i) Possesses adequate speaking, reading, and
6            writing ability in the language other than English
7            in which transitional bilingual education is
8            offered.
9                (ii) Has the ability to successfully
10            communicate in English.
11                (iii) Either possessed, within 5 years
12            previous to his or her applying for a transitional
13            bilingual educator endorsement, a valid and
14            comparable teaching certificate or comparable
15            authorization issued by a foreign country or holds
16            a degree from an institution of higher learning in
17            a foreign country that the State Educator
18            Preparation and Licensure Board determines to be
19            the equivalent of a bachelor's degree from a
20            regionally accredited institution of higher
21            learning in the United States.
22            A transitional bilingual educator endorsement
23        shall be valid for prekindergarten through grade 12, is
24        valid until June 30 immediately following 5 years of
25        the endorsement being issued, and shall not be renewed.
26            Persons holding a transitional bilingual educator

1        endorsement shall not be employed to replace any
2        presently employed teacher who otherwise would not be
3        replaced for any reason.
4            (H) Language endorsement. In an effort to
5        alleviate the shortage of teachers speaking a language
6        other than English in the public schools, an individual
7        who holds an Educator License with Stipulations may
8        also apply for a language endorsement, provided that
9        the applicant provides satisfactory evidence that he
10        or she meets all of the following requirements:
11                (i) Holds a transitional bilingual
12            endorsement.
13                (ii) (Blank). Has demonstrated proficiency in
14            the language for which the endorsement is to be
15            issued by passing the applicable language content
16            test required by the State Board of Education.
17                (iii) Holds a bachelor's degree or higher from
18            a regionally accredited institution of higher
19            education or, for individuals educated in a
20            country other than the United States, holds a
21            degree from an institution of higher learning in a
22            foreign country that the State Educator
23            Preparation and Licensure Board determines to be
24            the equivalent of a bachelor's degree from a
25            regionally accredited institution of higher
26            learning in the United States.

1                (iv) (Blank). Has passed a test of basic
2            skills, as required under Section 21B-30 of this
3            Code.
4            A language endorsement on an Educator License with
5        Stipulations is valid for prekindergarten through
6        grade 12 for the same validity period as the
7        individual's transitional bilingual educator
8        endorsement on the Educator License with Stipulations
9        and shall not be renewed.
10            (I) Visiting international educator. A visiting
11        international educator endorsement on an Educator
12        License with Stipulations may be issued to an
13        individual who is being recruited by a particular
14        school district that conducts formal recruitment
15        programs outside of the United States to secure the
16        services of qualified teachers and who meets all of the
17        following requirements:
18                (i) Holds the equivalent of a minimum of a
19            bachelor's degree issued in the United States.
20                (ii) Has been prepared as a teacher at the
21            grade level for which he or she will be employed.
22                (iii) Has adequate content knowledge in the
23            subject to be taught.
24                (iv) Has an adequate command of the English
25            language.
26            A holder of a visiting international educator

1        endorsement on an Educator License with Stipulations
2        shall be permitted to teach in bilingual education
3        programs in the language that was the medium of
4        instruction in his or her teacher preparation program,
5        provided that he or she passes the English Language
6        Proficiency Examination or another test of writing
7        skills in English identified by the State Board of
8        Education, in consultation with the State Educator
9        Preparation and Licensure Board.
10            A visiting international educator endorsement on
11        an Educator License with Stipulations is valid for 3
12        years and shall not be renewed.
13            (J) Paraprofessional educator. A paraprofessional
14        educator endorsement on an Educator License with
15        Stipulations may be issued to an applicant who holds a
16        high school diploma or its recognized equivalent and
17        either holds an associate's degree or a minimum of 60
18        semester hours of credit from a regionally accredited
19        institution of higher education or has passed a test of
20        basic skills required under Section 21B-30 of this
21        Code. The paraprofessional educator endorsement is
22        valid until June 30 immediately following 5 years of
23        the endorsement being issued and may be renewed through
24        application and payment of the appropriate fee, as
25        required under Section 21B-40 of this Code. An
26        individual who holds only a paraprofessional educator

1        endorsement is not subject to additional requirements
2        in order to renew the endorsement.
3            (K) Chief school business official. A chief school
4        business official endorsement on an Educator License
5        with Stipulations may be issued to an applicant who
6        qualifies by having a master's degree or higher, 2
7        years of full-time administrative experience in school
8        business management or 2 years of university-approved
9        practical experience, and a minimum of 24 semester
10        hours of graduate credit in a program approved by the
11        State Board of Education for the preparation of school
12        business administrators and by passage of the
13        applicable State tests, including a test of basic
14        skills and applicable content area test.
15            The chief school business official endorsement may
16        also be affixed to the Educator License with
17        Stipulations of any holder who qualifies by having a
18        master's degree in business administration, finance,
19        accounting, or public administration and who completes
20        an additional 6 semester hours of internship in school
21        business management from a regionally accredited
22        institution of higher education and passes the
23        applicable State tests, including a test of basic
24        skills and applicable content area test. This
25        endorsement shall be required for any individual
26        employed as a chief school business official.

1            The chief school business official endorsement on
2        an Educator License with Stipulations is valid until
3        June 30 immediately following 5 years of the
4        endorsement being issued and may be renewed if the
5        license holder completes renewal requirements as
6        required for individuals who hold a Professional
7        Educator License endorsed for chief school business
8        official under Section 21B-45 of this Code and such
9        rules as may be adopted by the State Board of
10        Education.
11            The State Board of Education shall adopt any rules
12        necessary to implement Public Act 100-288.
13            (L) Provisional in-state educator. A provisional
14        in-state educator endorsement on an Educator License
15        with Stipulations may be issued to a candidate who has
16        completed an Illinois-approved educator preparation
17        program at an Illinois institution of higher education
18        and who has not successfully completed an
19        evidence-based assessment of teacher effectiveness but
20        who meets all of the following requirements:
21                (i) Holds at least a bachelor's degree.
22                (ii) Has completed an approved educator
23            preparation program at an Illinois institution.
24                (iii) (Blank). Has passed a test of basic
25            skills and applicable content area test, as
26            required by Section 21B-30 of this Code.

1                (iv) Has attempted an evidence-based
2            assessment of teacher effectiveness and received a
3            minimum score on that assessment, as established
4            by the State Board of Education in consultation
5            with the State Educator Preparation and Licensure
6            Board.
7            A provisional in-state educator endorsement on an
8        Educator License with Stipulations is valid for one
9        full fiscal year after the date of issuance and may not
10        be renewed.
11            (M) School support personnel intern. A school
12        support personnel intern endorsement on an Educator
13        License with Stipulations may be issued as specified by
14        rule.
15            (N) Special education area. A special education
16        area endorsement on an Educator License with
17        Stipulations may be issued as defined and specified by
18        rule.
19        (3) Substitute Teaching License. A Substitute Teaching
20    License may be issued to qualified applicants for
21    substitute teaching in all grades of the public schools,
22    prekindergarten through grade 12. Substitute Teaching
23    Licenses are not eligible for endorsements. Applicants for
24    a Substitute Teaching License must hold a bachelor's degree
25    or higher from a regionally accredited institution of
26    higher education.

1        Substitute Teaching Licenses are valid for 5 years.
2        Substitute Teaching Licenses are valid for substitute
3    teaching in every county of this State. If an individual
4    has had his or her Professional Educator License or
5    Educator License with Stipulations suspended or revoked,
6    then that individual is not eligible to obtain a Substitute
7    Teaching License.
8        A substitute teacher may only teach in the place of a
9    licensed teacher who is under contract with the employing
10    board. If, however, there is no licensed teacher under
11    contract because of an emergency situation, then a district
12    may employ a substitute teacher for no longer than 30
13    calendar days per each vacant position in the district if
14    the district notifies the appropriate regional office of
15    education within 5 business days after the employment of
16    the substitute teacher in the emergency situation. An
17    emergency situation is one in which an unforeseen vacancy
18    has occurred and (i) a teacher is unable to fulfill his or
19    her contractual duties or (ii) teacher capacity needs of
20    the district exceed previous indications, and the district
21    is actively engaged in advertising to hire a fully licensed
22    teacher for the vacant position.
23        There is no limit on the number of days that a
24    substitute teacher may teach in a single school district,
25    provided that no substitute teacher may teach for longer
26    than 90 school days for any one licensed teacher under

1    contract in the same school year. A substitute teacher who
2    holds a Professional Educator License or Educator License
3    with Stipulations shall not teach for more than 120 school
4    days for any one licensed teacher under contract in the
5    same school year. The limitations in this paragraph (3) on
6    the number of days a substitute teacher may be employed do
7    not apply to any school district operating under Article 34
8    of this Code.
9        A school district may not require an individual who
10    holds a valid Professional Educator License or Educator
11    License with Stipulations to seek or hold a Substitute
12    Teaching License to teach as a substitute teacher.
13        (4) Short-Term Substitute Teaching License. Beginning
14    on July 1, 2018 and until June 30, 2023, the State Board of
15    Education may issue a Short-Term Substitute Teaching
16    License. A Short-Term Substitute Teaching License may be
17    issued to a qualified applicant for substitute teaching in
18    all grades of the public schools, prekindergarten through
19    grade 12. Short-Term Substitute Teaching Licenses are not
20    eligible for endorsements. Applicants for a Short-Term
21    Substitute Teaching License must hold an associate's
22    degree or have completed at least 60 credit hours from a
23    regionally accredited institution of higher education.
24        Short-Term Substitute Teaching Licenses are valid for
25    substitute teaching in every county of this State. If an
26    individual has had his or her Professional Educator License

1    or Educator License with Stipulations suspended or
2    revoked, then that individual is not eligible to obtain a
3    Short-Term Substitute Teaching License.
4        The provisions of Sections 10-21.9 and 34-18.5 of this
5    Code apply to short-term substitute teachers.
6        An individual holding a Short-Term Substitute Teaching
7    License may teach no more than 5 consecutive days per
8    licensed teacher who is under contract. For teacher
9    absences lasting 6 or more days per licensed teacher who is
10    under contract, a school district may not hire an
11    individual holding a Short-Term Substitute Teaching
12    License. An individual holding a Short-Term Substitute
13    Teaching License must complete the training program under
14    Section 10-20.67 or 34-18.60 of this Code to be eligible to
15    teach at a public school. This paragraph (4) is inoperative
16    on and after July 1, 2023.

24    (a) This Section applies beginning on July 1, 2012.
25    (b) The State Board of Education, in consultation with the

1State Educator Preparation and Licensure Board, shall design
2and implement a system of examinations, which shall be required
3prior to the issuance of educator licenses. These examinations
4and indicators must be based on national and State professional
5teaching standards, as determined by the State Board of
6Education, in consultation with the State Educator Preparation
7and Licensure Board. The State Board of Education may adopt
8such rules as may be necessary to implement and administer this
9Section.
10    (c) (Blank). Except as otherwise provided in this Article,
11applicants seeking a Professional Educator License or an
12Educator License with Stipulations shall be required to pass a
13test of basic skills before the license is issued, unless the
14endorsement the individual is seeking does not require passage
15of the test. All applicants completing Illinois-approved,
16teacher education or school service personnel preparation
17programs shall be required to pass the State Board of
18Education's recognized test of basic skills prior to starting
19their student teaching or starting the final semester of their
20internship. An institution of higher learning, as defined in
21the Higher Education Student Assistance Act, may not require an
22applicant to complete the State Board's recognized test of
23basic skills prior to the semester before student teaching or
24prior to the semester before starting the final semester of an
25internship. An individual who passes a test of basic skills
26does not need to do so again for subsequent endorsements or

1other educator licenses.
2    (d) (Blank). All applicants seeking a State license shall
3be required to pass a test of content area knowledge for each
4area of endorsement for which there is an applicable test.
5There shall be no exception to this requirement. No candidate
6shall be allowed to student teach or serve as the teacher of
7record until he or she has passed the applicable content area
8test.
9    (e) (Blank).
10    (f) Except as otherwise provided in this Article, beginning
11on September 1, 2015, all candidates completing teacher
12preparation programs in this State and all candidates subject
13to Section 21B-35 of this Code are required to pass a teacher
14performance assessment approved by the State Board of
15Education, in consultation with the State Educator Preparation
16and Licensure Board.
17    (g) The Tests of basic skills and content area knowledge
18and the teacher performance assessment shall be a test the
19tests that from time to time is are designated by the State
20Board of Education, in consultation with the State Educator
21Preparation and Licensure Board, and may be a test tests
22prepared by an educational testing organization or a test tests
23designed by the State Board of Education, in consultation with
24the State Educator Preparation and Licensure Board. The areas
25to be covered by a test of basic skills shall include reading,
26language arts, and mathematics. The test of content area

1knowledge shall assess content knowledge in a specific subject
2field. The test tests must be designed to be racially neutral
3to ensure that no person taking the test tests is discriminated
4against on the basis of race, color, national origin, or other
5factors unrelated to the person's ability to perform as a
6licensed employee. The score required to pass the test tests
7shall be fixed by the State Board of Education, in consultation
8with the State Educator Preparation and Licensure Board. The
9test tests shall be administered not fewer than 3 times a year
10at such time and place as may be designated by the State Board
11of Education, in consultation with the State Educator
12Preparation and Licensure Board.
13    The State Board shall implement a test or tests to assess
14the speaking, reading, writing, and grammar skills of
15applicants for an endorsement or a license issued under
16subdivision (G) of paragraph (2) of Section 21B-20 of this Code
17in the English language and in the language of the transitional
18bilingual education program requested by the applicant.
19    (h) Except as provided in Section 34-6 of this Code, the
20provisions of this Section shall apply equally in any school
21district subject to Article 34 of this Code.
22    (i) The rules developed to implement and enforce the
23testing requirements under this Section shall include without
24limitation provisions governing test selection, test
25validation and determination of a passing score,
26administration of the tests, frequency of administration,

1applicant fees, frequency of applicants taking the tests, the
2years for which a score is valid, and appropriate special
3accommodations. The State Board of Education shall develop such
4rules as may be needed to ensure uniformity from year to year

10    Sec. 21B-35. Minimum requirements for educators trained in
11other states or countries.
12    (a) Any applicant who has not been entitled by an
13Illinois-approved educator preparation program at an Illinois
14institution of higher education applying for a Professional
15Educator License endorsed in a teaching field or school support
16personnel area must meet the following requirements:
17        (1) the applicant must:
18            (A) hold a comparable and valid educator license or
19        certificate, as defined by rule, with similar grade
20        level and content area credentials from another state,
21        with the State Board of Education having the authority
22        to determine what constitutes similar grade level and
23        content area credentials from another state; and
24            (B) have a bachelor's degree from a regionally
25        accredited institution of higher education; or

1        (2) the applicant must:
2            (A) have completed a state-approved program for
3        the licensure area sought, including coursework
4        concerning methods of instruction of the exceptional

8            (B) have a bachelor's degree from a regionally
9        accredited institution of higher education;
10            (C) have successfully met all Illinois examination
11        requirements, except that:
12                (i) an applicant who has successfully
13            completed a test of basic skills, as defined by
14            rules, at the time of initial licensure in another
15            state is not required to complete a test of basic
16            skills;
17                (ii) an applicant who has successfully
18            completed a test of content, as defined by rules,
19            at the time of initial licensure in another state
20            is not required to complete a test of content; and
21                (iii) an applicant for a teaching endorsement
22            who has successfully completed an evidence-based
23            assessment of teacher effectiveness, as defined by
24            rules, at the time of initial licensure in another
25            state is not required to complete an
26            evidence-based assessment of teacher

2            (D) for an applicant for a teaching endorsement,
3        have completed student teaching or an equivalent
4        experience or, for an applicant for a school service

7    (b) In order to receive a Professional Educator License
8endorsed in a teaching field or school support personnel area,
9applicants trained in another country must meet all of the
10following requirements:
11        (1) Have completed a comparable education program in
12    another country.
13        (2) Have had transcripts evaluated by an evaluation
14    service approved by the State Superintendent of Education.
15        (3) Have a degree comparable to a degree from a
16    regionally accredited institution of higher education.
17        (4) Have completed coursework aligned to standards
18    concerning methods of instruction of the exceptional
19    child, methods of reading and reading in the content area,
20    and instructional strategies for English learners.
21        (5) (Blank).
22        (6) (Blank).
23        (7) Have successfully met all State licensure
24    examination requirements. Applicants who have successfully
25    completed a test of basic skills, as defined by rules, at
26    the time of initial licensure in another country shall not

8    initial licensure in another country shall not be required
9    to complete an evidence-based assessment of teacher
10    effectiveness.
11        (8) Have completed student teaching or an equivalent
12    experience.
13    (b-5) All applicants who have not been entitled by an
14Illinois-approved educator preparation program at an Illinois
15institution of higher education and applicants trained in
16another country applying for a Professional Educator License
17endorsed for principal or superintendent must hold a master's
18degree from a regionally accredited institution of higher
19education and must hold a comparable and valid educator license
20or certificate with similar grade level and subject matter
21credentials, with the State Board of Education having the
22authority to determine what constitutes similar grade level and
23subject matter credentials from another state, or must meet all
24of the following requirements:
25        (1) Have completed an educator preparation program
26    approved by another state or comparable educator program in

1    another country leading to the receipt of a license or
2    certificate for the Illinois endorsement sought.
3        (2) Have successfully met all State licensure
4    examination requirements, as required by Section 21B-30 of

6    test of basic skills, as defined by rules, at the time of
7    initial licensure in another state or country shall not be
8    required to complete a test of basic skills. Applicants who
9    have successfully completed a test of content, as defined
10    by rules, at the time of initial licensure in another state
11    or country shall not be required to complete a test of
12    content.
13        (2.5) Have completed an internship, as defined by rule.
14        (3) (Blank).
15        (4) Have completed coursework aligned to standards
16    concerning methods of instruction of the exceptional
17    child, methods of reading and reading in the content area,
18    and instructional strategies for English learners.
19        (5) Have completed a master's degree.
20        (6) Have successfully completed teaching, school
21    support, or administrative experience as defined by rule.
22    (b-7) All applicants who have not been entitled by an
23Illinois-approved educator preparation program at an Illinois
24institution of higher education applying for a Professional
25Educator License endorsed for Director of Special Education
26must hold a master's degree from a regionally accredited

8        (2) Have 2 years of full-time experience providing
9    special education services.
10        (3) Have successfully completed all examination
11    requirements, as required by Section 21B-30 of this Code.
12    Applicants who have successfully completed a test of
13    content, as identified by rules, at the time of initial
14    licensure in another state or country shall not be required
15    to complete a test of content.
16        (4) Have completed coursework aligned to standards
17    concerning methods of instruction of the exceptional
18    child, methods of reading and reading in the content area,
19    and instructional strategies for English learners.
20    (b-10) All applicants who have not been entitled by an
21Illinois-approved educator preparation program at an Illinois
22institution of higher education applying for a Professional
23Educator License endorsed for chief school business official
24must hold a master's degree from a regionally accredited
25institution of higher education and must hold a comparable and
26valid educator license or certificate with similar grade level

2Education having the authority to determine what constitutes
3similar grade level and subject matter credentials from another
4state, or must meet all of the following requirements:

7        (2) Have successfully completed an internship in
8    school business management or have 2 years of experience as
9    a school business administrator.
10        (3) Have successfully met all State examination
11    requirements, as required by Section 21B-30 of this Code.
12    Applicants who have successfully completed a test of
13    content, as identified by rules, at the time of initial
14    licensure in another state or country shall not be required
15    to complete a test of content.
16        (4) Have completed modules aligned to standards
17    concerning methods of instruction of the exceptional
18    child, methods of reading and reading in the content area,
19    and instructional strategies for English learners.
20    (c) The State Board of Education, in consultation with the
21State Educator Preparation and Licensure Board, may adopt such
22rules as may be necessary to implement this Section.

1    Sec. 21B-50. Alternative educator licensure program.
2    (a) There is established an alternative educator licensure
3program, to be known as the Alternative Educator Licensure
4Program for Teachers.
5    (b) The Alternative Educator Licensure Program for
6Teachers may be offered by a recognized institution approved to
7offer educator preparation programs by the State Board of
8Education, in consultation with the State Educator Preparation
9and Licensure Board.
10    The program shall be comprised of 4 phases:
11        (1) A course of study that at a minimum includes
12    instructional planning; instructional strategies,
13    including special education, reading, and English language
14    learning; classroom management; and the assessment of
15    students and use of data to drive instruction.
16        (2) A year of residency, which is a candidate's
17    assignment to a full-time teaching position or as a
18    co-teacher for one full school year. An individual must
19    hold an Educator License with Stipulations with an
20    alternative provisional educator endorsement in order to
21    enter the residency and must complete additional program
22    requirements that address required State and national
23    standards, pass the assessment of professional teaching
24    before entering the second residency year, as required
25    under phase (3) of this subsection (b), and be recommended
26    by the principal or qualified equivalent of a principal, as

1    required under subsection (d) of this Section, and the
2    program coordinator to continue with the second year of the
3    residency.
4        (3) A second year of residency, which shall include the
5    candidate's assignment to a full-time teaching position
6    for one school year. The candidate must be assigned an
7    experienced teacher to act as a mentor and coach the
8    candidate through the second year of residency.
9        (4) A comprehensive assessment of the candidate's
10    teaching effectiveness, as evaluated by the principal or
11    qualified equivalent of a principal, as required under
12    subsection (d) of this Section, and the program
13    coordinator, at the end of the second year of residency. If
14    there is disagreement between the 2 evaluators about the
15    candidate's teaching effectiveness, the candidate may
16    complete one additional year of residency teaching under a
17    professional development plan developed by the principal
18    or qualified equivalent and the preparation program. At the
19    completion of the third year, a candidate must have
20    positive evaluations and a recommendation for full
21    licensure from both the principal or qualified equivalent
22    and the program coordinator or no Professional Educator
23    License shall be issued.
24    Successful completion of the program shall be deemed to
25satisfy any other practice or student teaching and content
26matter requirements established by law.

1    (c) An alternative provisional educator endorsement on an
2Educator License with Stipulations is valid for 2 years of
3teaching in the public schools, including without limitation a
4preschool educational program under Section 2-3.71 of this Code
5or charter school, or in a State-recognized nonpublic school in
6which the chief administrator is required to have the licensure
7necessary to be a principal in a public school in this State
8and in which a majority of the teachers are required to have
9the licensure necessary to be instructors in a public school in
10this State, but may be renewed for a third year if needed to
11complete the Alternative Educator Licensure Program for
12Teachers. The endorsement shall be issued only once to an
13individual who meets all of the following requirements:
14        (1) Has graduated from a regionally accredited college
15    or university with a bachelor's degree or higher.
16        (2) Has a cumulative grade point average of 3.0 or
17    greater on a 4.0 scale or its equivalent on another scale.
18        (3) Has completed a major in the content area if
19    seeking a middle or secondary level endorsement or, if
20    seeking an early childhood, elementary, or special
21    education endorsement, has completed a major in the content
22    area of reading, English/language arts, mathematics, or
23    one of the sciences. If the individual does not have a
24    major in a content area for any level of teaching, he or
25    she must submit transcripts to the State Board of Education
26    to be reviewed for equivalency.

1        (4) Has successfully completed phase (1) of subsection
2    (b) of this Section.
3        (5) (Blank). Has passed a test of basic skills and
4    content area test required for the specific endorsement for
5    admission into the program, as required under Section
6    21B-30 of this Code.
7    A candidate possessing the alternative provisional
8educator endorsement may receive a salary, benefits, and any
9other terms of employment offered to teachers in the school who
10are members of an exclusive bargaining representative, if any,
11but a school is not required to provide these benefits during
12the years of residency if the candidate is serving only as a
13co-teacher. If the candidate is serving as the teacher of
14record, the candidate must receive a salary, benefits, and any
15other terms of employment. Residency experiences must not be
16counted towards tenure.
17    (d) The recognized institution offering the Alternative
18Educator Licensure Program for Teachers must partner with a
19school district, including without limitation a preschool
20educational program under Section 2-3.71 of this Code or
21charter school, or a State-recognized, nonpublic school in this
22State in which the chief administrator is required to have the
23licensure necessary to be a principal in a public school in
24this State and in which a majority of the teachers are required
25to have the licensure necessary to be instructors in a public
26school in this State. A recognized institution that partners

1with a public school district administering a preschool
2educational program under Section 2-3.71 of this Code must
3require a principal to recommend or evaluate candidates in the
4program. A recognized institution that partners with an
5eligible entity administering a preschool educational program
6under Section 2-3.71 of this Code and that is not a public
7school district must require a principal or qualified
8equivalent of a principal to recommend or evaluate candidates
9in the program. The program presented for approval by the State
10Board of Education must demonstrate the supports that are to be
11provided to assist the provisional teacher during the 2-year
12residency period. These supports must provide additional
13contact hours with mentors during the first year of residency.
14    (e) Upon completion of the 4 phases outlined in subsection
15(b) of this Section and all assessments required under Section
1621B-30 of this Code, an individual shall receive a Professional
17Educator License.
18    (f) The State Board of Education, in consultation with the
19State Educator Preparation and Licensure Board, may adopt such
20rules as may be necessary to establish and implement the
21Alternative Educator Licensure Program for Teachers.

4programs designed to provide an alternative route to
5superintendent endorsement on a Professional Educator License.
6    (b) Entities offering an alternative route to
7superintendent endorsement program must have the program
8approved by the State Board of Education, in consultation with
9the State Educator Preparation and Licensure Board.
10    (c) All programs approved under this Section shall be
11comprised of the following 3 phases:
12        (1) A course of study offered on an intensive basis in
13    education management, governance, organization, and
14    instructional and district planning.
15        (2) The person's assignment to a full-time position for
16    one school year as a superintendent.
17        (3) A comprehensive assessment of the person's
18    performance by school officials and a recommendation to the
19    State Board of Education that the person be issued a
20    superintendent endorsement on a Professional Educator
21    License.
22    (d) In order to serve as a superintendent under phase (2)
23of subsection (c) of this Section, an individual must be issued
24an alternative provisional superintendent endorsement on an
25Educator License with Stipulations, to be valid for only one
26year of serving as a superintendent. In order to receive the

1provisional alternative superintendent endorsement under this
2Section, an individual must meet all of the following
3requirements:
4        (1) Have graduated from a regionally accredited
5    college or university with a minimum of a master's degree
6    in a management field.
7        (2) Have been employed for a period of at least 5 years
8    in a management level position other than education.
9        (3) Have successfully completed phase (1) of
10    subsection (c) of this Section.
11        (4) (Blank). Have passed a test of basic skills and a
12    content area test for admission into the program, as
13    required by Section 21B-30 of this Code.
14    (e) Successful completion of an alternative route to
15superintendent endorsement program shall be deemed to satisfy
16any other supervisory, administrative, or management
17experience requirements established by law, and, once
18completed, an individual shall be eligible for a superintendent
19endorsement on a Professional Educator License.
20    (f) The State Board of Education, in consultation with the
21State Educator Preparation and Licensure Board, may adopt such
22rules as may be needed to establish and implement these
23alternative route to superintendent endorsement programs.
