AMENDMENT TO HOUSE BILL 97

2    AMENDMENT NO. ______. Amend House Bill 97 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Circuit Courts Act is amended by changing
5Sections 1 and 2a and by adding Section 2f-12 as follows:
 
6    (705 ILCS 35/1)  (from Ch. 37, par. 72.1)
7    Sec. 1. Judicial circuits created. The county of Cook shall
8be one judicial circuit and the State of Illinois, exclusive of
9the county of Cook, shall be and is divided into judicial
10circuits as follows:
11    First Circuit--The counties of Alexander, Pulaski, Massac,
12Pope, Johnson, Union, Jackson, Williamson and Saline.
13    Second Circuit--The counties of Hardin, Gallatin, White,
14Hamilton, Franklin, Wabash, Edwards, Wayne, Jefferson,
15Richland, Lawrence and Crawford.
16    Third Circuit--The counties of Madison and Bond.

1    Fourth Circuit--The counties of Clinton, Marion, Clay,
2Fayette, Effingham, Jasper, Montgomery, Shelby and Christian.
3    Fifth Circuit--The counties of Vermilion, Edgar, Clark,
4Cumberland and Coles.
5    Sixth Circuit--Before December 7, 2020, the counties of
6Champaign, Douglas, Moultrie, Macon, DeWitt and Piatt. On and
7after December 7, 2020, the county of Champaign The counties of
8Champaign, Douglas, Moultrie, Macon, DeWitt and Piatt.
9    Seventh Circuit--The counties of Sangamon, Macoupin,
10Morgan, Scott, Greene and Jersey.
11    Eighth Circuit--The counties of Adams, Schuyler, Mason,
12Cass, Brown, Pike, Calhoun and Menard.
13    Ninth Circuit--The counties of Knox, Warren, Henderson,
14Hancock, McDonough and Fulton.
15    Tenth Circuit--The counties of Peoria, Marshall, Putnam,
16Stark and Tazewell.
17    Eleventh Circuit--The counties of McLean, Livingston,
18Logan, Ford and Woodford.
19    Twelfth Circuit--The county of Will.
20    Thirteenth Circuit--The counties of Bureau, LaSalle and
21Grundy.
22    Fourteenth Circuit--The counties of Rock Island, Mercer,
23Whiteside and Henry.
24    Fifteenth Circuit--The counties of Jo Daviess, Stephenson,
25Carroll, Ogle and Lee.
26    Sixteenth Circuit--Before December 3, 2012, the counties

1of Kane, DeKalb, and Kendall. On and after December 3, 2012,
2the County of Kane.
3    Seventeenth Circuit--The counties of Winnebago and Boone.
4    Eighteenth Circuit--The county of DuPage.
5    Nineteenth Circuit--Before December 4, 2006, the counties
6of Lake and McHenry. On and after December 4, 2006, the County
7of Lake.
8    Twentieth Circuit--The counties of Randolph, Monroe, St.
9Clair, Washington and Perry.
10    Twenty-first Circuit--The counties of Iroquois and
11Kankakee.
12    Twenty-second Circuit--On and after December 4, 2006, the
13County of McHenry.
14    Twenty-third Circuit--On and after December 3, 2012, the
15counties of DeKalb and Kendall.
16    Twenty-fourth Circuit--On and after December 7, 2020, the
17counties of Douglas, Moultrie, Macon, DeWitt and Piatt.

20    Sec. 2a. In any circuit, other than Cook County, the 6th
21circuit, and the 23rd circuit, in which is situated any State
22institution providing educational or welfare facilities for
23more than 25,000 persons, 4 circuit judges shall be elected
24unless that circuit is entitled to a greater number under
25Section 2.

2    (705 ILCS 35/2f-12 new)
3    Sec. 2f-12. 6th and 24th judicial circuits.
4    (a) On December 7, 2020, the 6th judicial circuit is
5divided into the 6th and 24th judicial circuits as provided in
6Section 1 of the Circuit Courts Act. This division does not
7invalidate any action taken by the 6th judicial circuit or any
8of its judges, officers, employees, or agents before December
97, 2020. This division does not affect any person's rights,
10obligations, or duties, including applicable civil and
11criminal penalties, arising out of any action taken by the 6th
12judicial circuit or any of its judges, officers, employees, or
13agents before December 7, 2020.
14    (b) Of the 5 circuit judgeships elected at large in the 6th
15circuit before the general election in 2020, the Supreme Court
16shall assign 3 to the 6th circuit and 2 to the 24th circuit,
17based on residency of the circuit judges then holding those
18judgeships. The 2 assigned to the 24th circuit shall continue
19to be elected at large. The 3 resident judgeships elected from
20Champaign County before the 2020 general election shall become
21at large circuit judgeships for the 6th circuit on December 7,
222020.
23    (c) An individual seeking election or retention during the
242020 general election to one of the 6 at large judgeships
25assigned to the 6th circuit as provided in subsection (b) shall

1seek election or retention solely within the boundaries of
2Champaign County. An individual seeking election or retention
3during the 2020 general election to one of the 2 at large
4judgeships assigned to the 24th circuit as provided in
5subsection (b) shall seek election or retention solely within
6the boundaries of DeWitt, Douglas, Macon, Moultrie, and Piatt
7counties.
8    (d) The 2 resident judgeships elected from Macon County
9before or at the 2020 general election shall become resident
10judgeships from Macon County in the 24th circuit on December 7,
112020. The 2 resident judgeships elected from Moultrie County
12before or at the 2020 general election shall become resident
13judgeships from Moultrie County in the 24th circuit on December
147, 2020. The one resident judgeship elected from Douglas County
15before or at the 2020 general election shall become a resident
16judgeship from Douglas County in the 24th circuit on December
177, 2020. The one resident judgeship elected from DeWitt County
18before or at the 2020 general election shall become a resident
19judgeship from DeWitt County in the 24th circuit on December 7,
202020.
21    (e) Before December 7, 2020, the Supreme Court shall
22allocate the associate judgeships of the 6th circuit between
23the 6th and 24th circuits. The number of associate judges
24allocated to the 6th circuit shall be no less than 5.
25    (f) Before December 7, 2020, the Supreme Court shall
26allocate personnel, books, records, documents, property (real

1and personal), funds, assets, liabilities, and pending matters
2concerning the 6th circuit between the 6th and 24th circuits
3based on the population and staffing needs of those circuits
4and the efficient and proper administration of the judicial
5system. The rights of employees under applicable collective
6bargaining agreements are not affected by this Section.
7    (g) The judgeships set forth in this Section include the
8judgeships authorized under Section 2i. The judgeships
9authorized in that Section are not in addition to those set
10forth in this Section.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.".
