1 AMENDMENT TO SENATE BILL 3220
2     AMENDMENT NO. ______. Amend Senate Bill 3220 by replacing
3 everything after the enacting clause with the following:

4     "Section 5. The School Code is amended by adding Section
5 21B-107 as follows:

6     (105 ILCS 5/21B-107 new)
7     Sec. 21B-107. Educator preparation program; appeal.
8     (a) A not-for-profit institution or institution of higher
9 education that is denied an initial recommendation for
10 recognition by the State Educator Preparation and Licensure
11 Board may appeal the denial of recommendation for recognition
12 to the State Board of Education, as provided by rules adopted
13 by the State Board of Education under this Section.
14     (b) A for-profit institution that is denied an initial
15 recommendation for recognition by the State Educator
16 Preparation and Licensure Board may appeal the denial of

1 recommendation for recognition to the State Board of Education,
2 as provided by rules adopted by the State Board of Education
3 under this Section. These rules must include at minimum all of
4 the following:
5         (1) The State Board of Education must convene a public
6     hearing immediately preceding its next regularly scheduled
7     board meeting after the State Educator Preparation and
8     Licensure Board's denial of recommendation for
9     recognition.
10         (2) The public hearing must include an opportunity for
11     public participants to present comments on the appeal to
12     the State Board of Education.
13         (3) The public hearing must include an opportunity for
14     members of the State Educator Preparation and Licensure
15     Board and the State Board of Education to comment on the
16     issues raised in the appeal.
17         (4) The public hearing must include an opportunity for
18     the institution filing the appeal to present comments and
19     information to the State Board of Education in support of
20     its appeal.
21         (5) The State Board of Education must take action to
22     adopt, modify, or overturn the denial of recommendation for
23     recognition immediately after the public hearing.
24     (c) The State Board of Education shall adopt rules to
25 implement this Section.".
