1    AN ACT concerning flood control.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Flood Control Act of 1945 is amended by
5adding Section 8.5 as follows:
 
6    (615 ILCS 15/8.5 new)
7    Sec. 8.5. Flood Control Commission.
8    (a) The Flood Control Commission is created to study and
9develop an integrated floodplain management coalition of
10communities in the Fox River Watershed to serve as an example
11and catalyst to other watershed communities in the DuPage,
12Kane, Lake, McHenry, and Will County region to jointly leverage
13community resources and collaborate on flood preparedness,
14flood protection, flood response, flood recovery, future flood
15damage reduction, and necessary floodplain management
16education to mitigate future flooding events, prevent property
17damage and threats to public health, and save taxpayer money.
18    (b) The Commission shall be chaired by the Director of
19Natural Resources or his or her designee and consist of the
20following members:
21        (1) 5 members appointed by the President of the Senate;
22        (2) 5 members appointed by the Minority Leader of the
23    Senate;

1        (3) 5 members appointed by the Speaker of the House of
2    Representatives;
3        (4) 5 members appointed by the Minority Leader of the
4    House of Representatives;
5        (5) one member appointed by the chairman of the county
6    board with the advice and consent of the county board from
7    the DuPage County Stormwater Management Planning
8    Committee;
9        (6) one member appointed by the chairman of the county
10    board with the advice and consent of the county board from
11    the Kane County Stormwater Management Planning Committee;
12        (7) one member appointed by the chairman of the county
13    board with the advice and consent of the county board from
14    the Lake County Stormwater Management Planning Committee;
15        (8) one member appointed by the chairman of the county
16    board with the advice and consent of the county board from
17    the McHenry County Stormwater Management Planning
18    Committee;
19        (9) one member appointed by the county executive of the
20    county board with the advice and consent of the county
21    board from the Will County Stormwater Management Planning
22    Committee;
23        (10) one member appointed by the chairman of the county
24    board with the advice and consent of the county board from
25    a municipality in each of the following counties: (i)
26    DuPage County; (ii) Kane County; (iii) Lake County; and

1    (iv) McHenry County;
2        (11) one member appointed by the county executive with
3    the advice and consent of the county board from a
4    municipality in Will County;
5        (12) the Governor or his or her designee; and
6        (13) the Director of the Illinois Emergency Management
7    Agency or his or her designee.
8    (c) The Commission shall catalog current shortfalls in
9existing flood control practices in the Fox River Watershed.
10The Commission shall make suggestions for the improvement of
11such practices, including, but not limited to, the development
12of an example integrated floodplain management coalition of
13communities in the Fox River Watershed.
14    (d) The Commission shall conduct a survey and submit a
15report of the survey to the General Assembly by December 31,
162019. The report shall include, but is not limited to, the
17following information:
18        (1) the extent and character of the areas affected;
19        (2) current shortfalls in existing flood control
20    practices in the Fox River Watershed;
21        (3) the basic structure of an integrated floodplain
22    management coalition of communities in the Fox River
23    Watershed to jointly leverage community resources and
24    collaborate on flood preparedness, flood protection, flood
25    response, flood recovery, future flood damage reduction,
26    and necessary floodplain management education;

1        (4) a recommended strategy and schedule for
2    implementing the coalition of communities in the Fox River
3    Watershed;
4        (5) an explanation of how such a coalition could
5    advance future flood damage reduction measures in the
6    watershed; improve flood preparedness, flood protection,
7    flood response, and flood recovery; and advocate necessary
8    floodplain management education in the region;
9        (6) an explanation of how such a coalition could save
10    taxpayer dollars; and
11        (7) a statement of special or local benefit that will
12    accrue to communities participating in the coalition and a
13    statement of general or statewide benefits, with
14    recommendations as to what local cooperation,
15    participation, and cost sharing shall be required, if any,
16    on account of the special or local benefit.
17    The report to the General Assembly shall be filed with the
18Clerk of the House of Representatives and the Secretary of the
19Senate in electronic form only, in the manner that the Clerk
20and the Secretary shall direct.
21    (e) The Chicago Metropolitan Agency for Planning shall
22provide information to the Commission upon request.
23    (f) The Department of Natural Resources shall provide
24administrative support to the Commission.
25    (g) This Section is repealed on January 1, 2021.
