Amends the Registered Surgical Assistant and Registered Surgical Technologist Title Protection Act. Provides that a person qualifies for registration as a surgical assistant if he or she is currently certified by the National Commission for the Certification of Surgical Assistants (rather than the National Surgical Assistant Association). Provides that in order for a registrant to renew his or her surgical assistant registration or surgical technologist registration, he or she must maintain certain current certification. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Registered Surgical Assistant and | 5 | | Registered Surgical
Technologist Title Protection Act is | 6 | | amended by changing Sections 45 and 60 as follows:
| 7 | | (225 ILCS 130/45)
| 8 | | (Section scheduled to be repealed on January 1, 2024)
| 9 | | Sec. 45. Registration requirements; surgical assistant. A | 10 | | person shall
qualify for
registration as a surgical assistant | 11 | | if he or she has applied in writing on the
prescribed form, has | 12 | | paid the required fees, and meets all of the following
| 13 | | requirements:
| 14 | | (1) Is at least 21 years of age.
| 15 | | (2) Has not violated a provision of Section 75 of this | 16 | | Act. In addition
the
Department may take into consideration | 17 | | any felony conviction of the applicant,
but a
conviction | 18 | | shall not operate as an absolute bar to registration unless | 19 | | otherwise provided by law.
| 20 | | (3) Has completed a medical education program approved | 21 | | by the Department
or has graduated from a United States | 22 | | Military Program that emphasizes surgical
assisting.

completed a national certifying |

| 1 | | examination approved by the Department.
| 2 | | (5) Is currently certified by the National Commission | 3 | | for the Certification of Surgical Assistants National | 4 | | Surgical Assistant Association
as a Certified Surgical | 5 | | Assistant,
the National Board of Surgical Technology and | 6 | | Surgical Assisting as a
Certified Surgical First | 7 | | Assistant, or the American Board of Surgical Assistants as | 8 | | a Surgical Assistant-Certified.

| 12 | | Sec. 60. Expiration; restoration; renewal. In order to | 13 | | renew his or her surgical assistant registration, a registrant | 14 | | must maintain current certification as required by paragraph | 15 | | (5) of Section 45 of this Act. In order to renew his or her | 16 | | surgical technologist registration, a registrant must maintain | 17 | | current certification as required by paragraph (6) of Section | 18 | | 50 of this Act. The expiration date and
renewal period for each | 19 | | certificate of registration issued under this Act
shall be set | 20 | | by the
Department by rule. Renewal shall be conditioned on | 21 | | paying the required fee
and meeting other requirements as may | 22 | | be established by rule.
| 23 | | A registrant who has permitted his or her
registration to | 24 | | expire or
who has had his or her registration on inactive | 25 | | status may have the
registration restored by making application |

| 1 | | to the Department, by filing
proof
acceptable to
the Department | 2 | | of his or her fitness to have the registration restored,
and
by
| 3 | | paying the required fees. Proof of fitness may include sworn | 4 | | evidence
certifying to active lawful practice in another | 5 | | jurisdiction.
| 6 | | If the registrant has not maintained an active practice
in
| 7 | | another jurisdiction satisfactory to the Department, the | 8 | | Department shall
determine, by an evaluation program | 9 | | established by rule, his or her
fitness
for restoration of the | 10 | | registration and shall establish procedures and
requirements
| 11 | | for
restoration.
However, a registrant whose registration | 12 | | expired while he or
she
was (1) in federal service on active | 13 | | duty with the Armed Forces of the United
States or the State | 14 | | Militia called into service or training or (2) in
training or
| 15 | | education under the supervision of the United States before
| 16 | | induction
into the military service, may have the registration | 17 | | restored without paying
any
lapsed
renewal fees if within 2 | 18 | | years after honorable termination of the
service,
training, or | 19 | | education he or she furnishes the Department with
satisfactory
| 20 | | evidence to the effect that he or she has been so engaged and | 21 | | that his
or
her service, training, or education has been so | 22 | | terminated.

| 24 | | Section 99. Effective date. This Act takes effect upon | 25 | | becoming law.
