AMENDMENT TO SENATE BILL 2293

2    AMENDMENT NO. ______. Amend Senate Bill 2293 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 8-102 and by adding Section 3-414.5 as
6follows:
 
7    (625 ILCS 5/3-414.5 new)
8    Sec. 3-414.5. Multi-year registration.
9    (a) The Secretary of State shall permit the owner of a
10motor vehicle of the first division or a motor vehicle of the
11second division weighing not more than 8,000 pounds or a motor
12vehicle of the second division applying for a C class
13registration plate to register the motor vehicle for a period
14of 2 years if the owner selects to register his or her motor
15vehicle under this Section.
16        (1) If the motor vehicle to be registered is required

1    to undergo emissions inspections, the 2-year registration
2    must coincide with the emissions inspection cycle. If the
3    technology is available, the Secretary shall provide
4    notice to a motorist of his or her emissions cycle and the
5    type of registration he or she is eligible for.
6        (2) An applicant for a 2-year registration shall apply
7    online or by completing and mailing the appropriate 2-year
8    registration application form to the address indicated on
9    the form.
10        (3) The owner of a motor vehicle with a 2-year
11    registration may transfer that registration to another
12    motor vehicle with the same emissions inspection
13    requirements, if applicable. The owner of a motor vehicle
14    with a 2-year registration who discontinues use of the
15    registration before the expiration of the 2-year period is
16    not entitled to a complete or a prorated refund of the
17    registration fee.
18        (4) The fee for a 2-year registration shall be twice
19    the applicable annual registration fee for the motor
20    vehicle being registered. If the owner a motor vehicle
21    issued registration under this subsection is subject to an
22    annual surcharge under Section 3-806 or 3-815, the
23    Secretary of State shall collect the surcharge for each
24    registration year of the multi-year registration at the
25    same time the Secretary of State collects the one-time
26    registration fee.

1    (b) The Secretary of State shall permit the owner of a
2trailer to register the trailer for a period of either one year
3or up to an extended 5-year registration period.
4        (1) The registration shall be based on a recurring
5    5-year registration period. The trailer owner may apply for
6    an annual registration, registration for the full 5 years,
7    or for the number of years remaining in the current 5-year
8    cycle at the time of the registration application.
9        (2) An applicant for a 5-year trailer registration
10    shall apply online or by completing and mailing the
11    appropriate 5-year registration application form to the
12    address indicated on the form.
13        (3) The owner of a trailer with a 5-year registration
14    may transfer that registration to another trailer of the
15    same weight class. The owner of a trailer with a 5-year
16    registration who discontinues use of the registration
17    before the expiration of the 5-year period is not entitled
18    to a complete or a prorated refund of the registration fee.
19        (4) The fee for a 5-year registration shall be the same
20    as the applicable annual registration fee for the trailer
21    being registered multiplied by the number of years
22    remaining in the current 5-year cycle at the time of the
23    registration application.
24    (c) The Secretary of State may adopt rules to implement
25this Section.

2    Sec. 8-102. Alternate methods of giving proof.
3    (a) Except as provided in subsection (b), proof Proof of
4financial responsibility, when required under Section 8-101 or
58-101.1, may be given by filing with the Secretary of State one
6of the following:
7        1. A bond as provided in Section 8-103;
8        2. An insurance policy or other proof of insurance in a
9    form to be prescribed by the Secretary as provided in
10    Section 8-108;
11        3. A certificate of self-insurance issued by the
12    Director;
13        4. A certificate of self-insurance issued to the
14    Regional Transportation Authority by the Director naming
15    municipal or non-municipal public carriers included
16    therein;
17        5. A certificate of coverage issued by an
18    intergovernmental risk management association evidencing
19    coverages which meet or exceed the amounts required under
20    this Code.
21    (b) Beginning January 1, 2020, in lieu of filing the
22documents required by subsection (a), each owner of a vehicle
23required to obtain minimum liability insurance under Section
248-101 or 8-101.1 shall attest that the vehicle is insured in at
25least the minimum required amount.
26        (1) The Secretary shall create a form on which the

1    vehicle owner shall attest that the vehicle is insured in
2    at least the minimum required amount. The attestation form
3    shall be submitted with each registration application.
4        (2) The attestation form shall be valid for the full
5    registration period; however, if at any time the Secretary
6    has reason to believe that the owner does not have the
7    minimum required amount of insurance for a vehicle, the
8    Secretary may require the owner to file with the Secretary
9    documentation as set forth in subsection (a) of this
10    Section.
11        (3) If the owner fails to provide the required
12    documentation within 7 calendar days after the request is
13    made, the Secretary may suspend the vehicle registration.
14    The registration shall remain suspended until such time as
15    the required documentation is provided to and reviewed by
16    the Secretary.
17        (4) The owner of a vehicle that is self-insured shall
18    attest that the funds available to pay liability claims
19    related to the operation of the vehicle are equivalent to
20    or greater than the minimum liability insurance
21    requirements under Section 8-101 or 8-101.1.
22    (c) The Secretary of State may adopt rules to implement
23this Section.
