SYNOPSIS AS INTRODUCED:
 
10 ILCS 5/9-9.5

    Amends the Election Code. Provides that the disclosure requirements for political communications shall also apply to any political committee, organized under the Code, making a political communication utilizing any social media platform.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing Section
59-9.5 as follows:
 
6    (10 ILCS 5/9-9.5)
7    Sec. 9-9.5. Disclosures in political communications.
8    (a) Any political committee, organized under the Election
9Code, that makes an expenditure for a pamphlet, circular,
10handbill, Internet or telephone communication, radio,
11television, or print advertisement, or other communication,
12including, but not limited to, utilizing any social media
13platform, directed at voters and mentioning the name of a
14candidate in the next upcoming election shall ensure that the
15name of the political committee paying for any part of the
16communication, including, but not limited to, its preparation
17and distribution, is identified clearly within the
18communication as the payor. This subsection does not apply to
19items that are too small to contain the required disclosure.
20This subsection does not apply to an expenditure for the
21preparation, distribution, or publication of any communication
22directed at constituents of a member of the General Assembly if
23the expenditure is made by a political committee in accordance

1with subsection (c) of Section 9-8.10. Nothing in this
2subsection shall require disclosure on any telephone
3communication using random sampling or other scientific survey
4methods to gauge public opinion for or against any candidate or
5question of public policy.
6    Whenever any vendor or other person provides any of the
7services listed in this subsection, other than any telephone
8communication using random sampling or other scientific survey
9methods to gauge public opinion for or against any candidate or
10question of public policy, the vendor or person shall keep and
11maintain records showing the name and address of the person who
12purchased or requested the services and the amount paid for the
13services. The records required by this subsection shall be kept
14for a period of one year after the date upon which payment was
15received for the services.
16    (b) Any political committee, organized under this Code,
17that makes an expenditure for a pamphlet, circular, handbill,
18Internet or telephone communication, radio, television, or
19print advertisement, or other communication, including, but
20not limited to, utilizing any social media platform, directed
21at voters and (i) mentioning the name of a candidate in the
22next upcoming election, without that candidate's permission,
23or (ii) advocating for or against a public policy position
24shall ensure that the name of the political committee paying
25for any part of the communication, including, but not limited
26to, its preparation and distribution, is identified clearly

1within the communication. Nothing in this subsection shall
2require disclosure on any telephone communication using random
3sampling or other scientific survey methods to gauge public
4opinion for or against any candidate or question of public
5policy.
6    (c) A political committee organized under this Code shall
7not make an expenditure for any unsolicited telephone call to
8the line of a residential telephone customer in this State
9using any method to block or otherwise circumvent that
10customer's use of a caller identification service.
