AMENDMENT TO SENATE BILL 741

2    AMENDMENT NO. ______. Amend Senate Bill 741, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Department of Public Health Powers and
6Duties Law of the Civil Administrative Code of Illinois is
7amended by changing Section 2310-650 as follows:
 
8    (20 ILCS 2310/2310-650)
9    Sec. 2310-650. Influenza vaccination program. The
10Department of Public Health may require certified local health
11departments with jurisdiction over areas with more than 500,000
12residents and any facility licensed by the Department to
13implement an influenza vaccination program that ensures that
14the health care personnel employees of the facility are offered
15the opportunity to be vaccinated against seasonal influenza and
16any other novel or pandemic influenza viruses as vaccines

2    Nothing in this Section prohibits certified local health
3departments and any facility licensed by the Department from
4implementing more stringent influenza vaccination policies,
5strategies, or programs, including a mandatory health care
6personnel influenza vaccination program that contains measures
7to protect patients from potential exposure to influenza and
8improve health care personnel vaccination rates that are
9consistent with existing law and rules.
10    The Department may adopt rules setting forth the
11requirements of the influenza vaccination program, along with
12exceptions for personnel who may be exempt for medical or
13religious reasons. Medical exemptions shall be consistent with
14current guidelines issued by the Centers for Disease Control
15and Prevention. General philosophical or moral reluctance to
16influenza vaccinations is not a sufficient basis for an
17exemption.

19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
