AMENDMENT TO SENATE BILL 741

2    AMENDMENT NO. ______. Amend Senate Bill 741, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Department of Public Health Powers and
6Duties Law of the Civil Administrative Code of Illinois is
7amended by changing Section 2310-650 as follows:
 
8    (20 ILCS 2310/2310-650)
9    Sec. 2310-650. Influenza vaccination program. The
10Department of Public Health may require certified local health
11departments and any facility licensed by the Department to
12implement an influenza vaccination program that ensures that
13the health care personnel employees of the facility are offered
14the opportunity to be vaccinated against seasonal influenza and
15any other novel or pandemic influenza viruses as vaccines
16become available.

1    Nothing in this Section prohibits certified local health
2departments and any facility licensed by the Department from
3implementing more stringent influenza vaccination policies,
4strategies, or programs, including a mandatory health care
5personnel influenza vaccination program that contains measures
6to protect patients from potential exposure to influenza and
7improve health care personnel vaccination rates that are
8consistent with existing law and rules.
9    The Department may adopt rules setting forth the
10requirements of the influenza vaccination program, along with
11exceptions for personnel who may be exempt for medical or
12religious reasons. Medical exemptions shall be consistent with
13current guidelines issued by the Centers for Disease Control
14and Prevention. General philosophical or moral reluctance to
15influenza vaccinations is not a sufficient basis for an
16exemption.

18    Section 99. Effective date. This Act takes effect upon
19becoming law.".
