| 2 | | AMENDMENT NO. ______. Amend Senate Bill 511 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 1. Short title. This Act may be cited as the | 5 | | Complete Streets Act. | 6 | | Section 5. Definitions.
As used in this Act: | 7 | | "Advisory Board" means the Complete Streets Advisory | 8 | | Board.
| 9 | | "Department" means the Department of Transportation.
| 10 | | "Multimodal" refers to the various modes of travel or | 11 | | transportation, including travel by motor vehicle, bicycling, | 12 | | and walking.
| 13 | | "Multimodal planning" or "multimodal transportation | 14 | | planning" means plans concerning the improvement of the various | 15 | | modes of transportation in terms of safety, access, and | 16 | | mobility for users.

| 1 | | "User" or "users" means pedestrians, bicyclists, public | 2 | | transportation vehicles and their passengers, motorists, | 3 | | transporters of commercial goods, persons with disabilities, | 4 | | older adults, and children.
| 5 | | Section 10. Complete Streets Initiative: scope and effect.
| 6 | | (a) Vehicular, public transportation, bicycle, and | 7 | | pedestrian modes of travel are integral to the transportation | 8 | | system, and the Illinois Department of Transportation shall | 9 | | view all transportation improvements as opportunities to | 10 | | improve safety, access, and mobility for all travelers.
| 11 | | (b) All transportation projects receiving federal or State | 12 | | funds shall work to improve safety, access, and mobility for | 13 | | users of all ages and abilities, including pedestrians, | 14 | | bicyclists, public transportation vehicles and their | 15 | | passengers, motorists, transporters of commercial goods, | 16 | | persons with disabilities, older adults, and children.
| 17 | | (c) Accommodations for all users shall be included in the | 18 | | planning, design, construction, reconstruction, | 19 | | rehabilitation, maintenance, and operations of any State, | 20 | | county, or local transportation facility receiving funds from | 21 | | the Department. The Department shall aim to create a safe, | 22 | | comprehensive, integrated, and connected network to | 23 | | accommodate all users in a manner that is suitable to the | 24 | | rural, suburban, or urban context.
| 25 | | (d) The Department shall use the latest and best design |

| 1 | | standards as applied to bicycle, pedestrian, transit, and | 2 | | highway facilities, including the latest editions of the | 3 | | following resources:
| 4 | | (1) A Policy on Geometric Design of Highways and | 5 | | Streets;
| 6 | | (2) Designing Walkable Urban Thoroughfares: A Context | 7 | | Sensitive Approach: An ITE Recommended Practice;
| 8 | | (3) Guide for the Development of Bicycle Facilities;
| 9 | | (4) Guide for the Planning, Design, and Operation of | 10 | | Pedestrian Facilities;
| 11 | | (5) Public Rights-of-Way Accessibility Guidelines; or
| 12 | | (6) other relevant State, federal, or local | 13 | | guidelines.
| 14 | | (e) The Department may provide assistance to and coordinate | 15 | | with local and regional agencies in developing and implementing | 16 | | complementary Complete Streets Initiative policies. In the | 17 | | development of projects within municipal boundaries, the | 18 | | Department and the municipality shall share expertise in | 19 | | multimodal transportation planning.
| 20 | | (f) The Department shall modify its procedures, documents, | 21 | | training systems, and performance measures in a timely manner | 22 | | to ensure that the needs of all users of the transportation | 23 | | system are included in all phases of all projects. The | 24 | | Department shall create an implementation plan, including a | 25 | | schedule and a public, local, or regional government outreach | 26 | | plan, in consultation with the Advisory Board.

| 1 | | (g) The provisions of subsections (c) and (d) concerning | 2 | | facilities shall not be required if the Department determines, | 3 | | with respect to a highway, road, or street, that:
| 4 | | (1) use of the transportation facility by pedestrians, | 5 | | bicyclists, or other users is prohibited by law;
| 6 | | (2) the cost of new accommodation would be excessively | 7 | | disproportionate to the need or probable use; or
| 8 | | (3) there is a demonstrated absence of future need as | 9 | | determined by factors, including current and future land | 10 | | use, current and projected user volumes, population | 11 | | density, and crash data.
| 12 | | (h) The Department shall consult local and regional plans | 13 | | and leaders in assessing any further necessary exceptions to | 14 | | the provisions of this Section.
| 15 | | (i) Documentation on any granted exemption shall be made | 16 | | publicly available and shared with the Advisory Board.
| 17 | | (j) This Section shall apply to transportation projects for | 18 | | which a preliminary design has been completed on or after | 19 | | September 1, 2017. | 20 | | Section 15. Advisory Board.
| 21 | | (a) There is created the Complete Streets Advisory Board | 22 | | within the Department for the following purposes:
| 23 | | (1) providing education and advice to the counties, | 24 | | municipalities, interest groups, and the public concerning | 25 | | safety, access, and mobility across the various modes of |

| 1 | | transportation; and
| 2 | | (2) making recommendations to the Department on | 3 | | restructuring procedures, updating design guidance, | 4 | | providing education opportunities to employees, and | 5 | | establishing new measures to track success in multimodal | 6 | | planning and design.
| 7 | | (b) The members of the Advisory Board shall be appointed by | 8 | | the Governor and shall include the following members:
| 9 | | (1) one representative from the Department;
| 10 | | (2) one representative from the Illinois Department of | 11 | | Health;
| 12 | | (3) one licensed engineer with expertise in | 13 | | transportation;
| 14 | | (4) one representative from the Illinois Chapter of the | 15 | | American Planning Association;
| 16 | | (5) one representative from the Illinois County | 17 | | Association;
| 18 | | (6) one representative from the Illinois Municipal | 19 | | League;
| 20 | | (7) one representative from the Illinois Office of | 21 | | AARP;
| 22 | | (8) one representative from an organization advocating | 23 | | bicycling as a mode of travel;
| 24 | | (9) one representative from an organization advocating | 25 | | walking as a mode of travel;
| 26 | | (10) one representative from an organization |

| 1 | | representing persons with disabilities;
| 2 | | (11) one representative from an automobile or trucking | 3 | | transport organization; | 4 | | (12) one representative from an organization | 5 | | advocating on behalf of children; and | 6 | | (13) any other interested party as determined by the | 7 | | Governor.
| 8 | | (c) Members of the Advisory Board shall be appointed to a | 9 | | term of 4 years and shall serve without compensation. | 10 | | (d) The Advisory Board, in coordination with a | 11 | | representative or representatives of the Department, shall | 12 | | prepare a report on the status of the implementation of the | 13 | | Complete Streets Initiative as outlined in Section 10 of this | 14 | | Act. The report shall include the following information:
| 15 | | (1) a summary of specific actions taken by the | 16 | | Department in the preceding year to improve safety, access, | 17 | | and mobility of roadways for all users;
| 18 | | (2) any identified statutory recommendations to | 19 | | facilitate Complete Streets Initiative implementation;
| 20 | | (3) modifications made to or recommended for | 21 | | protocols, guidance, standards, or other requirements to | 22 | | facilitate Complete Streets Initiative implementation;
| 23 | | (4) the status of the development of multimodal | 24 | | performance indicators;
| 25 | | (5) information collected from agencies on the | 26 | | percentage of trips made by foot, bicycle, and public |

| 1 | | transportation, together with the target level of the use | 2 | | of these modes;
| 3 | | (6) crash statistics by mode, age, type, location, and | 4 | | other relevant factors; and
| 5 | | (7) other related information that may be requested by | 6 | | the Governor.
| 7 | | (e) The Advisory Board shall submit its initial report and | 8 | | recommendations to the Governor, the Department, and the | 9 | | General Assembly on or before January 1, 2018, and annually on | 10 | | January 1 of each subsequent year.
| 11 | | Section 99. Effective date. This Act takes effect upon | 12 | | becoming law.".
