AMENDMENT TO SENATE BILL 298

2    AMENDMENT NO. ______. Amend Senate Bill 298 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2TTT as follows:
 
6    (815 ILCS 505/2TTT new)
7    Sec. 2TTT. Standard services.
8    (a) It is not a fraudulent, unfair, or deceptive act or
9practice under this Act to differentiate prices for services
10based upon factors that include, but are not limited to, amount
11of time, difficulty, cost of providing the services, methods,
12procedure, or equipment used to accomplish the service, upon
13the qualifications, experience, or expertise of the individual
14or business providing the services, market conditions specific
15to the service or the business, or geographic region where the
16services are completed or the business is located.

1    (b) The following sellers shall provide the consumer with a
2standard services price list upon request:
3        (1) Tailors or businesses providing aftermarket
4    clothing alterations.
5        (2) Barbershops or hair salons.
6        (3) Dry cleaners and laundries providing services to
7    individuals.
8    The price list may be provided in any format and may be
9based on customary industry pricing practices.
10    As used in this subsection, "standard service" means the 10
11most frequently requested services provided by the seller.
12    (c) If a seller identified in subsection (b) is found to be
13in violation of this Section, the seller shall have 30 days to
14remedy the violation. Upon a second or subsequent violation
15within 2 years after the 30-day remediation period, the seller
16shall be liable for penalties pursuant to this Act.".
