AMENDMENT TO HOUSE BILL 4953

2    AMENDMENT NO. ______. Amend House Bill 4953 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Professional Regulation Law
5of the Civil Administrative Code of Illinois is amended by
6adding Section 2105-15.5 as follows:
 
7    (20 ILCS 2105/2105-15.5 new)
8    Sec. 2105-15.5. Continuing education; sexual harassment
9prevention training.
10    (a) As used in this Section, "sexual harassment" means any
11unwelcome sexual advances or requests for sexual favors or any
12conduct of a sexual nature when: (i) submission to such conduct
13is made either explicitly or implicitly a term or condition of
14an individual's employment; (ii) submission to or rejection of
15such conduct by an individual is used as the basis for
16employment decisions affecting such individual; or (iii) such

1conduct has the purpose or effect of substantially interfering
2with an individual's work performance or creating an
3intimidating, hostile, or offensive working environment. For
4the purpose of this definition, "working environment" is not
5limited to a physical location that an employee is assigned to
6perform his or her duties and does not require an employment
7relationship.
8    (b) For license renewals occurring on or after January 1,
92020 for a profession that has continuing education
10requirements, the required continuing education hours shall
11include at least one hour of sexual harassment prevention
12training.
13    (c) The Department may adopt rules for the implementation
14of this Section.".
