SYNOPSIS AS INTRODUCED:
 
20 ILCS 2310/2310-697 new

    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department of Public Health shall require every provider of mammography services to, if a patient's mammogram demonstrates dense breast tissue, provide notification to the patient in any summary of the mammography report sent to the patient pursuant to the federal Mammography Quality Standards Act that shall include, but not be limited to, certain information.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-697 as follows:
 
7    (20 ILCS 2310/2310-697 new)
8    Sec. 2310-697. Breast cancer; duty of providers of
9mammography services to notify and inform.
10    (a) As used in this Section, "dense breast tissue" means
11heterogeneously dense or extremely dense tissue as defined in
12nationally recognized guidelines or systems for breast imaging
13reporting of mammography screening, including, but not limited
14to, the Breast Imaging Reporting and Data System of the
15American College of Radiology, and any equivalent new terms, as
16such guidelines or systems are updated.
17    (b) The Department shall require every provider of
18mammography services to, if a patient's mammogram demonstrates
19dense breast tissue, provide notification to the patient in any
20summary of the mammography report sent to the patient pursuant
21to the federal Mammography Quality Standards Act that shall
22include, but not be limited to, the following information:
23        "Your mammogram shows that your breast tissue is dense.

1    Dense breast tissue is very common and is not abnormal.
2    However, dense breast tissue can make it harder to find
3    cancer on a mammogram and may also be associated with an
4    increased risk of breast cancer.
5        This information about the result of your mammogram is
6    given to you to raise your awareness. Use this information
7    to talk to your doctor about your own risks for breast
8    cancer. At that time, ask your doctor if more screening
9    tests might be useful, based on your risk. A report of your
10    results was sent to your physician.".
