AMENDMENT TO HOUSE BILL 3684

2    AMENDMENT NO. ______. Amend House Bill 3684 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Food Handling Regulation Enforcement Act is
5amended by changing Section 3 as follows:
 
6    (410 ILCS 625/3)  (from Ch. 56 1/2, par. 333)
7    Sec. 3. Each food service establishment shall be under the
8operational supervision of a certified food service sanitation
9manager in accordance with rules promulgated under this Act.
10    By July 1, 1990, the Director of the Department of Public
11Health in accordance with this Act, shall promulgate rules for
12the education, examination, and certification of food service
13establishment managers and instructors of the food service
14sanitation manager certification education programs. Beginning
15January 1, 2018, any individual who has completed a minimum of
168 hours of Department-approved training for food service

1sanitation manager certification, inclusive of the
2examination, and received a passing score on the examination
3set by the certification exam provider accredited under
4standards developed and adopted by the Conference for Food
5Protection or its successor organization, shall be considered
6to be a certified food service sanitation manager. Beginning
7July 1, 2014, any individual seeking a food service sanitation
8manager certificate or a food service sanitation manager
9instructor certificate must complete a minimum of 8 hours of
10Department-approved training, inclusive of the examination,
11and receive a passing score on the examination set by the
12certification exam provider accredited under standards
13developed and adopted by the Conference for Food Protection or
14its successor organization. A food service sanitation manager
15certificate issued by the exam provider and a food service
16sanitation manager instructor certificate shall be valid for 5
17years, unless revoked by the Department of Public Health, and
18shall not be transferable from the individual to whom it was
19issued. A food service sanitation manager instructor
20certificate issued by the Department shall be valid for 5 years
21and shall be renewable if standards adopted by the Department
22are met, unless revoked by the Department, and shall not be
23transferable from the individual to whom it was issued.
24Beginning July 1, 2014, recertification for food service
25sanitation manager certification shall be accomplished by
26presenting evidence of completion of 8 hours of

1Department-approved training, inclusive of the examination,
2and having received a passing score on the examination set by
3the certification exam provider accredited under standards
4developed and adopted by the Conference for Food Protection or
5its successor organization.
6    For purposes of certification and recertification for food
7service sanitation manager certification, the Department shall
8accept only training approved by the Department and
9certification exams accredited under standards developed and
10adopted by the Conference for Food Protection or its successor.
11The Department shall charge a fee of $35 for each new and
12renewed food service sanitation manager certificate and $10 for
13each replacement certificate. All fees collected under this
14Section shall be deposited into the Food and Drug Safety Fund.
15    Any fee received by the Department under this Section that
16is submitted for the renewal of an expired food service
17sanitation manager certificate may be returned by the Director
18after recording the receipt of the fee and the reason for its
19return.
20    The Department shall approve award an Illinois certificate
21to anyone presenting a valid certificate issued by another
22state, so long as the holder of the certificate provides proof
23of having passed an examination accredited under standards
24developed and adopted by the Conference for Food Protection or
25its successor. The $35 issuance fee applies. The reciprocal
26Illinois certificate shall expire on the same date as the

1presented certificate. On or before the expiration date, the
2holder must have met the Illinois recertification requirements
3in order to be reissued an Illinois certificate. Reciprocity is
4only for individuals who have moved to or begun working in
5Illinois in the 6 months prior to applying for reciprocity. Any
6individual presenting an out-of-state certificate may do so
7only once.

9    Section 99. Effective date. This Act takes effect January
