1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Dental Service Plan Act is amended by
5changing Section 32 as follows:
 
6    (215 ILCS 110/32)  (from Ch. 32, par. 690.32)
7    Sec. 32. A dental service plan corporation may enter into
8agreements with dentists qualified as set forth herein, under
9which such dentists become participating dentists in a plan
10operated by the corporation. Such corporation may make to such
11dentists such payments as have accrued to them by reason of
12services performed under the plan. Payment for dental services
13may be made to participating or nonparticipating dentists, or
14to nonparticipating licensed physicians, at rates adopted by
15the board of trustees. A dental service plan corporation may
16enter into contracts for the payment of dental services to the
17subscribers or members of similar dental service plan
18corporations of other states, subject to the supervision of
19such other states, and shall have the right to reimburse any
20other dental service plan corporation or dentists of another
21state or of the geographic areas of this State in which the
22corporation does not transact business for services rendered to
23its subscribers, or beneficiaries named in the certificates

1issued to such subscribers, at the same rate paid participating
2dentists under the certificate of the subscriber.
3    All payments from a dental service plan corporation for
4services performed under a dental service plan must be paid
5directly to the participating or nonparticipating dental
6practice, professional entity, or provider performing the
7service at the rate that has been adopted and agreed to under
8the plan as long as the assignment of benefits clause of the
9policy has been signed by the patient. Nothing in this Section
10shall require the dental service plan corporation to pay for
11services not covered under the plan.
