| 1 | | AMENDMENT TO SENATE RESOLUTION 1761
| 2 | | AMENDMENT NO. ___. Amend Senate Resolution 1761 by | 3 | | replacing everything with the following:
| 4 | | "WHEREAS, The State of Illinois has had a long-standing
| 5 | | statutory goal of spending 20% of all procurement dollars on
| 6 | | minority, women, or veteran-owned businesses; and | 7 | | WHEREAS, Investing in minority, women, or veteran-owned | 8 | | businesses
is a central economic development strategy for the | 9 | | State to
ensure the businesses that prosper from the State's | 10 | | need for
goods and services reflects the diversity of the | 11 | | entire State;
and | 12 | | WHEREAS, Legal services is one of the components that the
| 13 | | State's statutory goal for spending 20% for minority, women, or | 14 | | veteran-owned businesses apply towards; and |

| 1 | | WHEREAS, The last year where full data is available on
| 2 | | actual spending with minority, women, or veteran-owned | 3 | | businesses is
FY2015; and | 4 | | WHEREAS, In FY2015, the State spent more than $35,000,000
| 5 | | on outside law firms in legal services; and
| 6 | | WHEREAS, Only 4% of the State's legal services in FY15 were
| 7 | | with minority, women, or veteran-owned businesses; and | 8 | | WHEREAS, The total spent on African-American owned law
| 9 | | firms in FY15 was under $200,000, which is significantly less
| 10 | | than 1% of the total spent on legal services the entire fiscal
| 11 | | year; and | 12 | | WHEREAS, Governor Rauner's administration was only
| 13 | | responsible for half of the legal services spent in FY15 as the
| 14 | | Governor was not inaugurated until the middle of that fiscal
| 15 | | year; and | 16 | | WHEREAS, While complete data for FY16 is not yet available,
| 17 | | there have been a series of procurements for legal services
| 18 | | that did not include any goal for minority, women, or | 19 | | veteran-owned businesses, including one posted April 8th for a | 20 | | Swaps Bond Counsel
for the Governor's Office of Management and | 21 | | Budget; and |

| 1 | | WHEREAS, Unless the Rauner administration makes a
| 2 | | significant effort to increase the participation of minority, | 3 | | women, or veteran-owned businesses in legal spending, the | 4 | | administration is
likely on track to dramatically fall short of | 5 | | the statutory
goal of 20% participation; therefore, be it | 6 | | RESOLVED, BY THE SENATE OF THE NINETY-NINTH GENERAL
20 | 7 | | ASSEMBLY OF THE STATE OF ILLINOIS, that the Rauner | 8 | | administration is urged to comply with the statutory goal of
| 9 | | 20% participation with minority, women, or veteran-owned | 10 | | businesses, particularly as it relates to professional | 11 | | services and legal
services; and be it further | 12 | | RESOLVED, That the Rauner administration is urged to make | 13 | | every effort for FY16 to satisfy the 20% goal for participation
| 14 | | with minority, women, or veteran-owned businesses in | 15 | | professional services as that is the first full fiscal year | 16 | | completely administered by
the Rauner administration; and be it | 17 | | further | 18 | | RESOLVED, That a suitable copy of this resolution be
| 19 | | delivered to Governor Rauner." |
