1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing Section
512-5 as follows:
 
6    (10 ILCS 5/12-5)  (from Ch. 46, par. 12-5)
7    Sec. 12-5. Notice for public questions.
8    (a) Except as otherwise provided in subsection (b), for For
9all elections held after July 1, 1999, notice of public
10questions shall be required only as set forth in this Section
11or as set forth in Section 17-3 or 19-3 of the School Code. Not
12more than 30 days nor less than 10 days before the date of a
13regular election at which a public question is to be submitted
14to the voters of a political or governmental subdivision, and
15at least 20 days before an emergency referendum, the election
16authority shall publish notice of the referendum. The notice
17shall be published once in a local, community newspaper having
18general circulation in the political or governmental
19subdivision. The notice shall also be given at least 10 days
20before the date of the election by posting a copy of the notice
21at the principal office of the election authority. The local
22election official shall also post a copy of the notice at the
23principal office of the political or governmental subdivision,

1or if there is no principal office at the building in which the
2governing body of the political or governmental subdivision
3held its first meeting of the calendar year in which the
4referendum is being held. The election authority and the
5political or governmental subdivision may, but are not required
6to, post the notice electronically on their World Wide Web
7pages. The notice, which shall appear over the name or title of
8the election authority, shall be substantially in the following
9form:
10        NOTICE IS HEREBY GIVEN that at the election to be held
11    on (insert day of the week), (insert date of election), the
12    following proposition will be submitted to the voters of
13    (name of political or governmental subdivision):
14    (insert the public question as it will appear on the
15    ballot)
16        The polls at the election will be open at 6:00 o'clock
17    A.M. and will continue to be open until 7:00 o'clock P.M.
18    of that day.
19        Dated (date of notice)
20        (Name or title of the election authority)
21The notice shall also include any additional information
22required by the statute authorizing the public question. The
23notice may include an explanation, in neutral and plain
24language, of the question and its purposes supplied by the
25governing body of the political or governmental subdivision to
26whose voters the question is to be submitted. The notice shall

1set forth the precincts and polling places at which the
2referendum will be conducted only in the case of emergency
3referenda.
4    (b) Notice of any public question published in a local,
5community newspaper having general circulation in the
6political or governmental subdivision to which such public
7question relates more than 30 days but not more than 35 days
8prior to the general election held on November 8, 2016 that
9otherwise complies with the requirements of this Section is
10sufficient notice to satisfy the newspaper publication
11requirement of this Section, such notice shall for all purposes
12be deemed to have been given in accordance with this Section,
13any bonds approved by the voters at such election are hereby
14authorized to be issued in accordance with applicable law
15without further referendum approval and taxes to be levied
16pursuant to any limiting rate increases approved by the voters
17at such election are hereby authorized to be levied and
18extended without further referendum approval.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.
