SYNOPSIS AS INTRODUCED:
 
505 ILCS 110/7  from Ch. 5, par. 407

    Amends the Illinois Seed Law. Provides that specified provisions do not apply to seed distributed within this State by means of noncommercial, interpersonal seed sharing activities, including, but not limited to, seed libraries, seed exchanges, or other formal or informal seed sharing activities. Effective immediately.

1    AN ACT concerning agriculture.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Seed Law is amended by changing
5Section 7 as follows:
 
6    (505 ILCS 110/7)  (from Ch. 5, par. 407)
7    Sec. 7. Exemptions. The provisions of Sections 4 through
84.5 and Sections 5 and 5.1 do not apply:
9    (1) To seed or grain not intended for sowing purposes.
10    (2) To seed in storage in, or being transported or
11consigned to a cleaning or conditioning establishment for
12cleaning or conditioning, provided, that the invoice or
13labeling accompanying any shipment of said seed bears the
14statement "seed for conditioning"; and provided that any
15labeling or other representation which may be made with respect
16to the uncleaned or unconditioned seed shall be subject to this
17Act.
18    (3) To any carrier in respect to any seed transported or
19delivered for transportation in the ordinary course of its
20business as a carrier; provided, that such carrier is not
21engaged in producing, processing, or marketing agricultural,
22vegetable or other seeds designated by the Department of
23Agriculture subject to the provisions of this Act.

1    (4) To seed distributed within this State by means of
2noncommercial, interpersonal seed sharing activities,
3including, but not limited to, seed libraries, seed exchanges,
4or other formal or informal seed sharing activities.

6    Section 99. Effective date. This Act takes effect upon
7becoming law.
