AMENDMENT TO SENATE BILL 3104

2    AMENDMENT NO. ______. Amend Senate Bill 3104 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Construction Minority and Female
5Building Trades Act is amended by changing Section 35-10 and by
6adding Section 35-11 as follows:
 
7    (30 ILCS 577/35-10)
8    Sec. 35-10. Apprenticeship reports. Each labor
9organization and other entity in Illinois with one or more
10apprenticeship programs for construction trades, whether or
11not recognized and certified by the United States Department of
12Labor, Bureau of Apprenticeship and Training, must report to
13the Illinois Department of Labor the information required to be
14reported to the Bureau of Apprenticeship and Training by labor
15organizations with recognized and certified apprenticeship
16programs that lists the race, gender, ethnicity, and national

1origin of apprentices in that labor organization or entity. The
2information must be submitted to the Illinois Department of
3Labor as provided by rules adopted by the Department. For labor
4organizations with recognized and certified apprentice
5programs, the reporting requirement of this Section may be met
6by providing the Illinois Department of Labor, on a schedule
7adopted by the Department by rule, copies of the reports
8submitted to the Bureau of Apprenticeship and Training. Failure
9to submit this report is a violation of this Act.

12    Sec. 35-11. Penalties. If the Department of Labor
13determines that an entity has violated Section 35-10 of this
14Act, it shall provide the entity reasonable notice of
15noncompliance for a first violation and inform the entity that
16it has 45 days to provide the information required under
17Section 35-10 of this Act without penalty. If the first
18violation is not remedied within 45 days' notice, the entity
19shall be subject to a civil penalty not to exceed $100 for each
20day after the 45th day following notice that the entity is in
21violation of this Act.
22    For a second violation the entity shall be subject to a
23civil penalty not to exceed $250 for each day that the entity
24is in violation of this Act.
25    For any violation by an entity after the second violation,

1the entity shall be subject to a civil penalty not to exceed
2$500 for each day that the entity is in violation of this Act.
3    In determining the amount of a penalty, the Director shall
4consider the appropriateness of the penalty to the entity.".
